SYNOPSIS: A Boundary Line Adjustment has been proposed at 383 Vistawilla Drive. This agenda item provides the general information and background of the proposed Boundary Line Adjustment. CONSIDERATIONS: APPLICANT AND PROPERTY INFORMATION: • Property owner's name: Seminole Trail Animal Hospital, Inc. • Property address: 383 Vistawilla Drive and adjacent vacant lot • Property Parcel ID numbers: 05 -21 -31 -505- 0000 -004A, 05 -21 -31 -505- 0000 -0040 • Current zoning designations: PUD (Planned Unit Development) • Current FLUM designations: Commercial BACKGROUND OF PROPERTIES: . At the July 24, 2006 City Commission meeting, the Commission approved a lot split at the Seminole Trail Animal Hospital at 383 Vistawilla Drive (Resolution #2006- 38). The lot split created one 0.6 -acre lot for the animal hospital, and one 1.1 -acre parcel for future commercial development. The animal hospital was completed in 2007 and remains in operation. Consent 302 PAGE 1 OF 2 - February 12, 2018 Seminole Trail Animal Hospital, Inc. (Dr. Paul Williams) currently owns the animal hospital parcel and the adjacent vacant commercial parcel. Dr. Williams has proposed a boundary line adjustment between the two parcels that would increase the size of the animal hospital site from 0.6 -acres to approximately 0.8- acres, and it would decrease the size of the vacant lot from 1.1 -acres to approximately 0.9- acres. The purpose of the boundary line adjustment is to locate the property line such that it will no longer divide the existing parking lot between the two parcels. After the boundary line adjustment, the entire existing parking lot will be located on the animal hospital parcel. The future development parcel will still be accessed by the one existing shared driveway connection to Vistawilla Drive located on the animal hospital parcel, as required by Resolution 2006 -38. The future development parcel will be required to meet its own parking needs on the 0.9 -acre parcel. Resolution 2018 -05 provides the terms of the boundary line adjustment approval, including a provision requiring the property owner to execute a Joinder and Consent form, and the continued requirement for the two lots to maintain in perpetuity a common ingress and egress driveway. . City Commission approval is required for a Boundary Line Adjustment, in accordance with Section 9 -2 of the City Code. FISCAL IMPACT: There is no fiscal impact associated with this Boundary Line Adjustment. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission approve the Boundary Line Adjustment at 383 Vistawilla Drive, and authorize the City Manager and the City Attorney to prepare and execute any and all applicable documents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: Whereas, Seminole Trail Animal Hospital, Inc. is the owner of LOT 4A and 413, TUSCAWILLA TRACT 15, PARCEL 1 -C, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 56, PAGES 29 -32, INCLUSIVE IN THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; and Whereas, said existing Lots were approved by the City Commission by Resolution No. 2006 -38; and Whereas, Seminole Trail Animal Hospital, Inc. has requested that the City approve a boundary line adjustment for the subject Lots 4A and 413, which were previously platted by the City of Winter Springs, for purposes of legally describing two lots; and Whereas, Seminole Trail Animal Hospital, Inc., by written joinder hereto, has recognized and agreed to a common ingress and egress point on Vistawilla Drive TO SERVE Lots 4A and 4B in accordance with the requirements of Resolution No. 2006 -38, and that the boundary line adjustment approved by this Resolution is contingent upon the new Lots 4A and 4B approved hereunder maintaining, in perpetuity, a common ingress and egress point on Vistawilla Drive as more specifically set forth hereunder. SECTION 1. AUTHORITY FOR THIS RESOLUTION. This Resolution is adopted pursuant to the City Commission's authority over the division of lands within the jurisdictional boundaries of the City of Winter Springs including, but not limited to, platting of real property. See Winter Springs City Code, Section 9 -2 et seq. SECTION 2. APPROVAL OF BOUNDARY LINE ADJUSTMENT. The City Commission previously approved, by Resolution No. 2006 -38, a lot split for LOT 4, TUSCAWILLA TRACT 15, PARCEL 1 -C, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 56, PAGES 29 -32, INCLUSIVE IN THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, which created two lots described as Lots 4A and 4B. Subject to the conditions stated in this Resolution, the City Commission hereby approves a boundary lot adjustment for Lots 4A and 4 B in order to legally describe and create new legal descriptions for New Lot 4A and New Lot 4B, as more specifically legally described and depicted on the attached EXHIBIT f°A," Map of Boundary Survey prepared by H & H Survey Consultants, LLC., dated February 1, 2018. Said EXHIBIT "A" depicts and legal describes the existing Lots 4A and 413, the location of the existing driveway, and the New Lots 4A and 4B and is hereby fully incorporated herein by this reference. SECTION 3. COMMON INGRESS AND EGRESS. The New Lots 4A and 4B created by this Resolution shall continue to maintain, in perpetuity, a common ingress and egress driveway to and from Vistawilla Drive. The existing driveway was approved in accordance with the Final Engineering Plans approved by the City Commission on April 24, 2006, and shall be maintained for the common and shared benefit of New Lots 4A and 4B. As a condition of approval of this Resolution by the City Commission, Seminole Trail Animal Hospital, Inc., by execution of the Joinder and Consent required by Section 4 of this Resolution, hereby grants to the owner of New Lot 4B a perpetual ingress and egress easement over and upon the existing driveway located on New Lot 4A for purposes of providing New Lot 4B access to and from Vistawilla Drive. SECTION 4. JOINDER AND CONSENT. The property owner, Seminole Trail Animal Hospital, Inc, shall be required to fully execute the Joinder and Consent, attached hereto as EXHIBIT "B." as a condition of approval of the boundary adjustment authorized by this Resolution. SECTION 5. RECORDATION OF THE RESOLUTION AND JOINDER AND CONSENT. Upon execution and approval of this Resolution and the Joinder and Consent, this Resolution shall be recorded in the Official Records of Seminole County, Florida, and Lots 4A and 4B shall thereafter be legally described as official lots of record for conveyance and development purposes in accordance with the survey attached to this Resolution. SECTION 6. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption, except that the boundary adjustment authorized hereunder shall not take effect until such time as this Resolution and the Joinder and Consent are recorded pursuant to Section 5 herein.
