HomeMy WebLinkAbout2017 10 23 Consent 300 Winter Springs Apartment PlatCOMMISSION AGENDA ITEM 300 REQUEST: Informational Consent X Public Hearings Regular October 23, 2017 KS BF Regular Meeting City Manager Department The Community Development Department requests the City Commission approve the Winter Springs Apartments plat, and authorize the plat to be recorded, subject to satisfaction of the conditions of approval. SYNOPSIS: Winter Springs Apartments is a multi - family residential project in the Town Center District, located on the east side of Tuskawilla Road, north of S.R. 434 and west of Michael Blake Boulevard. The applicant, Catalyst Development Partners, is seeking City approval to record the plat. CONSIDERATIONS: LAND USE & ZONING Zoning: T -C (Town Center District) Future Land Use: Town Center APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code At the December 14, 2015 City Commission meeting, the Commission approved the Final Engineering plans and Aesthetic Review for the Winter Springs Apartments, a multi - family residential project in the Town Center originally proposed by Pollack Shores Real Estate Group. Consent 300 PAGE 1 OF 3 - October 23, 2017 In August 2016, Catalyst Development Partners, LLC took over the project from Pollack Shores. At the January 9, 2017 City Commission meeting, the City Commission approved a First Modification of the Development Agreement, which reduced the total number of multi- family apartment units permitted on the property from 300 to 283. Sitework construction commenced in March of 2017 and is currently in progress, along with construction of the 10- building apartment project (281 total apartment units). The Winter Springs Apartments Plat includes the recording of new city rights -of -way for Tree Swallow Road (east of Tuskawilla Road), Eagle Edge Lane, and Sea Hawk Way. These streets form the primary public street network on the east side of Tuskawilla Road, along with the previously recorded right -of -way for Michael Blake Boulevard. The proposed plat also creates future commercial development parcels along S.R. 434 and Tuskawilla Road. The property east of Michael Blake Boulevard remains owned by Winter Springs Holdings. Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes. City Staff, including the City's independent surveyor, Southeastern Surveying and Mapping Corporation, have reviewed and approved the plat. The following conditions of approval must be satisfied before the plat can be recorded: 1. Provide executed joinder(s) from all mortgage holders. 2. City Attorney verification that any applicable remaining open legal comments have been addressed. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media /Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.
