COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, ADOPTING THE CITY'S FIVE (5) YEAR SCHEDULE OF CAPITAL IMPROVEMENTS IN ACCORDANCE WITH THE COMMUNITY PLANNING ACT; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under Section 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, section 163.3161, et. seq., Florida Statues, "Local Government Comprehensive Planning and Land Development Regulation Act" was redesignated as the "Community Planning Act" by Chapter 2011 -139, Laws of Florida (2011); and WHEREAS, section 163.3167, Florida Statutes, requires each municipality in the State of Florida to maintain a Comprehensive Plan; and WHEREAS, the Five -Year Capital Improvements Program ( "CIP ") serves as a companion to the Comprehensive Plan and the Capital Improvements Element ( "CIE ") of the Comprehensive Plan, by linking capital expenditures with the adopted public policy; and WHEREAS, the CIP is intended to demonstrate that the City can properly meet demands for new and properly maintained infrastructure and facilities in a fiscally responsible manner and in furtherance of section 166.021, Florida Statutes; and WHEREAS, the CIP is required under section 7.04 of the City Charter, is prioritized over a five (5) year period, and is to be reviewed and updated annually; and WHEREAS, the City Commission hereby finds the proposed CIP consistent with the City of Winter Springs Comprehensive Plan; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by City of Winter Springs Ordinance 2017 -15 Page 1 of 2 reference as legislative findings of the City Commission of Winter Springs. Section 2. Adoption of Five -Year Capital Improvements Program. The City Commission of the City of Winter Springs, Florida hereby adopts the Five -Year Capital Improvements Program, attached hereto as "Exhibit A," fully incorporated herein by this reference. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 5. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
