The Regular Meeting of the City Council of the City of Winter Springs, Florida, was called to order by Deputy Mayor John Torcaso. The invocation was given by Councilman Martin Trencher. The pledge of allegiance to the flag was led by Councilman Jim Hartman. Roll Call: Mayor Troy Piland, absent Deputy Mayor John Torcaso, present City Manager Richard Rozansky, present City Attorney Wallace Stalnaker, present Councilmen: Jim Hartman, present Wilfred Arnold, present Martin Trencher, present Maureen Boyd, present Motion was made by Councilman Boyd to approve the minutes of May 12 and May 19, 1981. Seconded by Councilman Trencher. Discussion. Vote on the motion: Councilman Trencher, aye; Councilman Boyd, aye; Councilman Hartman, aye; Councilman Arnold, aye; motion carried. Public Input: Mr. Art Harris, 20 Sable Court, discussed changes to a planned unit development and the concerns of the Tuscawilla residents and about being notified of any changes that may be requested, in particular the stable area. Councilman Arnold asked the City Manager if any requests have come in from Winter Springs Development Corporation to change the stable area and the City Manager said not to his knowledge. . General Agenda: Public Hearing for Ordinance No. 235, Land Development OrE.~n~?f~. Second Reading. Motion was made by Councilman Arnold to read Ordinance No. 235 by title only. Seconded by Councilman Trencher. Discussion. Vote on the motion: Councilman Boyd, aye; Councilman Hartman, aye; Councilman Arnold, aye; Councilman Trencher, aye; motion carried. Attorney Stalnaker read Ordinance No. 235 by title only on second reading. Deputy Mayor John Torcaso recessed the Council Meeting and opened the public hearing for purposes of hearing comment on proposed Ordinance No. 235. There was discussion of Section 14-3_2 on page 4, Section l4-41'4)and Section 14-124. No changes were made. No one in the audience spoke against the ordinance. Deputy Mayor Torcaso closed the public hearing and reconvened the Council Meeting. Motion was made by Councilman Arnold to adopt Ordinance No. 235. Seconded by Councilman Trencher. Discussion. Vote on the motion: Councilman Hartman, aye; Councilman Arnold, aye; Councilman Trencher, aye; Councilman Boyd, aye; motion carried. Continued Public Hearing for Ordinance No. 240, making the granting of all conditional uses sub;ect to hearing before the Board of Ad;ustment, etc. Attorney Stalnaker read Ordinance No. 240 by title only on second reading. Deputy Mayor John Torcaso recessed the Council Meeting and opened the public hearing for purposes of hearing comment on proposed Ordinance No. 240. No one spoke against the ordinance. Council discussed Variances, but decided to leave as is. Deputy Mayor Torcaso closed the public hearing and reconvened the Council Meeting. . Reg. First Reading of Ordinance No. 241, Charter Revision: Councilman Arnold asked if it was worth going through the time, effort and expense of adopting Ordinance No. 241 and having a referendum for really one change - a change from two years to three year term. There were other changes, but in his opinion, merely cosmetic. The question was raised if this was put on the November ballot and the people elected would they serve a three year term? It was explained that if the Charter Revision passed, they would serve a three year term because the term of office begins in December. City Attorney Stalnaker said another area to be looked at is that the Council has delegated some of the authority of the Mayor to the City Manager. However, Council has made it permissive to have a city manager which could have the effect if Council opts to not have a city manager who is going to delegate the authorities which have been taken away from the Mayor - there is no provision for delegation otherwise. Council agreed that the following be added in Section 5.01: Under appointment qualification compensation, after 1st paragraph: insert at the end of the paragraph- In the event the commission does not appoint a City Manager, the administrative duties of the Manager shall be the responsibility of the Mayor unless otherwise provided in this charter. Council agreed that the following be added in Section 4.05, after first sentence after the word "law": additionally, the Hayor shall have the responsibility of the admini- strative duties of the City Manager in the event the City Commission does not appoint a City Manager, unless otherwise provided in this charter. . Council was in agreement to have this placed on the November ballot instead of having a special election. The public hearing is to be set for June 23, 1981. Copies of Ordinance No. 241 are to be made available for the residents if they would like a copy. Motion was made by Councilman Trencher to read Ordinance No. 241 by title only. Seconded by Councilman Arnold. Discussion.Vote on the motion: Councilman Arnold, aye; Councilman Trencher, aye; Councilman Boyd, aye; Councilman Hartman,aye; motion carried. Attorney Stalnaker read the first reading of Ordinance No. 241 by title only. Planning and Zoning Board Appointment - Seat III: Deputy Mayor John Torcaso read the letter of resignation of Mr. John Burford from the Planning and Zoning Board. Motion was made by Councilman Trencher to appoint Mrs. Lee Ann Grove to the Planning and Zoning Board. Seconded by Councilman Boyd.Discussion.Vote on the motion: Councilman Boyd,aye;Councilman Hartman, aye; Councilman Arnold, aye; Councilman Trencher, aye; motion carried. Deputy Mayor John Torcaso read the Clean Up Proclamation proclaiming the week of June 8 through June 13 as Clean Up Week. Deputy Mayor John Torcaso discussed the memo from Mr. Tom Binford reference the terms of office that will expire on June 10th on the Board of Adjustment. Councilman Hartman said that H&W has never provided a date when large items would be picked up. . . . . , Reg. Meeting, City Council, May 26, 1981 Page 3 80-81-22 The letter from Watsky & Company in reference to the H. & W. Refuse Company audit was discussed. City Manager Richard Rozansky said he intends to have H&W on the agenda in June to discuss a rate increase. Council was of the opinion that Mr. Carione could provide some cost information as to costs at the landfill dumps, gas costs, how much equipment he has bought, etc.in lieu of an audit. Mr. Dave Dearolph, Tuscawilla, spoke in discussion. Councilman Trencher asked the City Manager about the progress of the recreation program plan.
