WORKSHOP
MAY 24, 2016
CALL TO ORDER
The Regular Meeting of Tuesday, May 24, 2016 of the Code Enforcement Board was
called to Order by Chairperson Gregg Roero at 5:36 p.m., in the Commission Chambers
of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.

700. Office of the City Attorney
The Office Of The City Attorney Requests To Review With The Code Enforcement
Board Sunshine Law, General Code Enforcement Procedures, And Other Board
Activities.
Senior City Attorney Jennifer Nix began by introducing the Agenda Item.

While reviewing the contents of the informational packet, Senior Attorney Nix gave an
overview of the Sunshine Law and noted "gavel to gavel ", as a reminder that this is the
only time that Board business should be discussed. Additional comments regarding the
Sunshine Law and Violations related to Sunshine Law followed.
Continuing, Senior Attorney Nix referred to the City Code regarding the powers of this
Board, as well as Florida Statutes Chapter 162. Discussion ensued on definitions of
commonly used terms. The definition and examples of Repeat Violations were further
addressed. Senior Attorney Nix then briefly mentioned the organization of the Board.
Next, Senior Attorney Nix commented on the enforcement procedures, conduct, due
process, voting procedures, Finding of Fact and Conclusions of Law, and other Board
Orders, and mentioned that the applicable Florida Statutes are provided in the back of the
packet. Further comments ensued.
Board Member Maurice Kaprow asked for clarification regarding Repeat Violations.
Discussion followed.
Mr. Bill Poe left the dais at 6:08 p.m.
Vice - Chairperson Matthew Criswell asked about the City suing for a Lien after three (3)
months. Further comments followed.
Mr. Bill Poe returned to the dais at 6:13 p.m.
Captain Chris Deisler, Code Enforcement Division, Police Department noted, `Be
mindful when the Code Officers are bringing these Cases, that they may not be prepared
to defend or answer questions about `Are they a Repeat Violator', `Don't they own other
properties in the City', so on and so forth; because quite honestly, you're going to catch
them off guard — we'll bring them when we can."
Senior Attorney Nix added, "The ultimate goal is Compliance. If it's a house, and I'm
just mentioning this generally — where some of the thoughts of the City may or may not
be — but if the goal is Compliance and they're eventually getting that, there's always a
balancing act I think, as far as what the City's interests are and how debt wants to be
assessed and moved forward upon."
Assistant to the City Clerk Jessica Ghersetich departed the Workshop at 6 :23 p.m.

Senior Attorney Nix then commented on quasi-judicial decisions including related
procedures and conduct, procedural due process, consensual requirements of the law, and
that decisions must be supported by competent and substantial evidence on Record.

Lastly, Senior Attorney Nix referred to scenario examples that were provided in the
informational packet and then offered additional comments. In closing, Senior Attorney
Nix noted additional information had been included for future reference in the
informational packets.
