The Public Works Department, Arbor Division, requests that the City Commission consider
the request of Kimberlee Frank, 110 South Edgemon Avenue, to remove a specimen live
oak from the rear of her home.
SYNOPSIS:
A live oak, approximately 40" in diameter, is growing less than 1' from the rear of 110
South Edgemon Avenue. To eliminate the risk of damage to the home, Kimberlee Frank is
requesting approval to remove the tree. Section 5 -8(b) of Chapter 5, Tree Protection and
Preservation, states that a specimen tree shall not be removed except under extraordinary
circumstance or hardship, and only by approval of the City Commission.
CONSIDERATIONS:
Based on assessment of the tree made by City Arborist, Stephanie Monica, on March 17th,
2016, approval of the request to remove the live oak is recommended. The tree is
approximately 40" in diameter and is growing less than 1' from the home and is physically
touching the house in several places. While no physical damage to the house was observed,
the tree is so close that future damage is likely.
FISCAL IMPACT:
If approved, the applicant will pay a $25 permit fee to the arbor fund.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,

City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends that the City Commission approve the request to remove one specimen
live oak from 110 South Edgemon Avenue. The tree is located less than V from the house
and is touching the home in several places. While there is currently no obvious physical
damage, there is potential for future damage to occur based on the proximity of the tree to
the house. Staff finds that this qualifies as an extraordinary circumstance or hardship as
referenced in Section 5 -8(b) of Chapter 5, Tree Protection and Preservation.
