The Public Works Department requesting the City Commission: 1) validate the Staff
recommendation finding the RiZE sitework to be built in substantial accordance with the
Final Engineering plans, subject to satisfactory completion of the remaining open punchlist
items; 2) accept the public infrastructure improvements for ownership and maintenance; and
3) authorize reimbursement in the amount of $200,000 to the developer after completion
and final Staff approval of the roadways, in accordance with the approved Developer's
Agreement.
SYNOPSIS:
Sitework for the RiZE apartment project is substantially complete and has been
conditionally approved by the applicable City Departments. This agenda item provides the
site acceptance necessary before a final certificate of occupancy can be issued by the
building official. In addition, this agenda item provides authorization to reimburse the
developer, Grandeville at Winter Springs LLLP, in the amount of $200,000 for completion
of public roadway improvements, in accordance with the terms of the approved Developer's
Agreement.
CONSIDERATIONS:
APPLICABLE CODE:
Section 9 -178. Required Improvements to be completed prior to building on lots;
exceptions.
(c) Where the building official has an authoritative method of assurance that the

improvements will be completed in accordance with approved plans, such as
withholding occupancy, the building official may issue building permits upon
advising the developer that all or partial occupancy will be restricted until satisfactory
completion of the improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are
accepted by the city commission.
RiZE is a 244 unit, 4 -story apartment complex by LeCesse Development Corporation
located on a 4.78 -acre parcel immediately east of City Hall. The RiZE project was
previously referred to as "Grandeville at Town Center."
The Final Engineering Plans were conditionally approved by the City Commission at
the February 25, 2013 City Commission meeting. Sitework commenced in August 2014
and the building is expected to have a phased occupancy starting in late March 2016.
This agenda item is for the conditional acceptance of the site improvements. The sitework
has been constructed in substantial compliance with the Final Engineering plans approved
by the City Commission, except as noted on the attached punchlist, Exhibit A. All items on
the punchlist must be complete, subject to Staff approval, prior to issuance of the
final certificate of occupancy.
The Developer's Agreement approved by the City Commission on February 25, 2013
included provisions for reimbursing the developer in the amount of $200,000 after
completion and acceptance of roadway improvements being dedicated to the City. The
publicly owned roadway improvements consist of Doran Drive from Blumberg Boulevard
to the high school access road, and the new roadway along the north side of the RiZE
building that connects the City Hall parking lot to Doran Drive. The roadway
improvements have been substantially completed, subject to open punchlist items that must
be completed and approved by Staff prior to issuance of the reimbursement.
The site acceptance includes the developer's conveyance of the right -of -way to the City for
the new public road between City Hall and Doran Drive along the north side of RiZE
property. As part of the site acceptance, the developer is dedicating the right -of -way for
this road to the City by warranty deed, in a format that is subject to review and approval by
the City Attorney.
FISCAL IMPACT:
The $200,000 reimbursement for roadway improvements is budgeted in the Road
Improvement Fund (One Cent Sales Tax, 2nd Generation).
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This

information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends that the City Commission: 1) validate the Staff recommendation finding
the RiZE sitework to be built in substantial accordance with the Final Engineering plans,
subject to satisfactory completion of the remaining open punchlist items; 2) accept the
public infrastructure improvements for ownership and maintenance; and 3) authorize
reimbursement in the amount of $200,000 to the developer after completion and final Staff
approval of the roadways, in accordance with the approved Developer's Agreement.

1. Submit Engineer of Record's Certification Letter to the City
2. Submit a complete set of record drawings to the City (all civil sheets in one digital file in
PDF format)
3. Complete all sitework and pass the final engineering inspection. The final inspection,
including preparation of a final punchlist, will occur after receipt of the record drawings
from the engineer -of- record.
4. Submit 2 -Year Maintenance Letter of Credit or Cash Escrow Deposit (10% of the value of
the improvements to be owned and maintained by the City, as listed on the Bill of Sale)
5. Right -of -Ways and Easements Dedicated and Recorded at Seminole County. As of
March 4, the utility easement is at the city for review and signature, and the warranty
deed is also under review by the city.
6. Submit a copy of the Letter from the Engineer to SJRWMD Certifying Improvements
( SJRWMD standard certification form)
Additional items to be completed prior to closeout (this is not a complete punchlist):
• Repair damaged asphalt on Doran Drive
• Repair damaged curb on Doran Drive
• Correct smoothness deficiencies on Doran Drive and Edge Drive
• Eliminate standing water on asphalt surfaces and in gutter lines after rains
• Complete sidewalk construction on SR 434, City Hall, and Edge Drive sides
• Provide video inspection of all sanitary and storm sewer mains and sanitary service
laterals. Remove sediment and debris if needed.
• Clean and restore areas outside of new sidewalks on Doran Drive
• Install detectable warning mats at all curb ramps
• Complete installation of thermoplastic pavement markings
• Install decorative street signs per the Town Center District City Code
• Remove erosion and sedimentation control devices
• Clean all construction debris and trash from the site and surrounding areas, including
the stormwater pond behind City Hall.
• Provide irrigation as -built drawings and complete onsite irrigation
walkthrough /inspection with City staff
