The Community Development Department — Planning Division requests that the City
Commission hold a public hearing to consider Second Reading and Adoption of Ordinance
2015 -01, which facilitates the voluntarily annexation of two (2) parcels totaling
approximately 20.48 gross acres, more or less, currently within Seminole County, Florida,
and generally located just east of the intersection of State Road 434 and State Road 417.
SYNOPSIS:
The Community Development Department received a request for voluntary annexation of
two (2) parcels totaling approximately 20.48 gross acres in size. The parcels are located just
east of the intersection of State Road 434 and State Road 417 (see Attachment A -
Location Map). Ordinance 2015 -01 proposes the voluntary annexation of approximately
20.48 gross acres of property for future development within the City of Winter Springs (see
Attachment B - Ordinance 2015 -01). City Commission considered the First Reading of
Ordinance 2015 -01 on January 26, 2015.
At the December 14, 2015 City Commission meeting the Second Reading and Adoption of
this item was postponed to a date certain of the January 11, 2016. At the January 11,
2016 City Commission meeting this item was postponed to a date certain of the February 8,
2016 meeting to allow the City Attorney and Staff to evaluate the issues raised during the
meeting by the adjacent property owner (Hendrix). After further evaluations, it was
recommended by legal counsel that the Ordinance be revised to include a metes and bounds
legal description, a survey and added language addressing the outcome of the pending
litigation and the effect it may have on the boundary of the subject property. It was also
recommended by legal counsel that this ordinance be brought back for an additional first

reading to incorporate the new language associated with the meets and bounds survey and
the pending litigation. City Commission considered First Reading of Ordinance 2015 -01 on
February 8, 2016.

The applicant is petitioning the City to voluntarily annex two (2) parcels totaling
approximately 20.48 gross acres, more or less, currently within Seminole County, Florida
via Ordinance 2015 -01. The subject parcels, currently within Seminole County, are located
just east of the intersection of State Road 434 and State Road 417. The applicant desires to
combine the two (2) county parcels for a future single - family development.
The surrounding area is primarily a mixed use (residential and commercial) corridor serving
as an entry point to the City of Winter Springs. The subject properties are currently vacant
and owned by Janet Mann and William Wilson. The two (2) parcels abut State Road 434,
which is a mixed commercial /residential node. This is an area that is conducive to future
commercial, office, and residential development. The surrounding area is generally
characterized by the following land use and zoning categories.
The requested voluntary annexation petition bears appropriate signatures of all associated
property owners. The subject properties are contiguous with the City's existing boundaries
and are currently located in an unincorporated area of Seminole County adjacent to the City
of Winter Springs. The requested voluntary annexation of the two (2) parcels does not
create any enclaves but, in fact, eliminates all but a small portion of what has been a large
enclave.

The request is consistent with all applicable goals, objectives and policies of the City's
adopted Comprehensive Plan. The City has capacity to provide this parcel with the same
urban services provided to other areas of the City. City water and sewer service are
available to the subject property.
The subject properties are currently designated "Suburban Estate" on the Seminole County
Future Land Use Map and Agriculture "A -1" on the Seminole County Zoning Map.
Properties to the east and west are within the City of Winter Springs. Properties to the south
and west are within both the City of Winter Springs and Seminole County.
Pursuant to Florida Statutes 171.044 (6), the Seminole County Board of County
Commissioners was sent via Certified Mail the notice of annexation for the subject parcels
on December 8, 2015. Adjacent property owners have been notified by U.S. mail on
December 29, 2015. In addition, the properties have been posted with a large yellow sign.
If the property is annexed, the applicant's request for a Large Scale Comprehensive Plan
Amendment changing the Future Land Use to City of Winter Springs "Low Density
Residential" and the request for Rezoning to City of Winter Springs "R -1" will then be
considered by the City Commission during the February 22, 2016 regular meeting as Item
401.
Findings:
In analyzing the annexation request, it appears that all statutory requirements related to
voluntary annexation have been satisfied.
FISCAL IMPACT:
The applicant desires to combine the two (2) county parcels for future development.
Development of the subject property is anticipated to provide an increase to the City's
taxable value. A detailed Fiscal Impact Report will be performed once specific development
plans are made available.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.

was advertised in the Orlando Sentinel on December 10, 2015, February 11, 2016 and
February 18, 2016 (see Attachment E - Advertisement, Orlando Sentinel).
RECOMMENDATION:
The Community Development Department — Planning Division recommends that the City
Commission hold the second reading and adoption of the revised Ordinance 2015 -01, a
voluntarily annexation of two (2) parcels totaling approximately 20.48 gross acres.

AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, ANNEXING TWO
(2) PARCELS OF LAND COMPRISING APPROXIMATELY
20.479 ACRES, MORE OR LESS, CURRENTLY WITHIN
SEMINOLE COUNTY, FLORIDA, AND GENERALLY
LOCATED JUST EAST OF THE INTERSECTION OF
STATE ROAD 434 AND STATE ROAD 417, OVIEDO; SAID
PARCELS BEING MORE PARTICULARLY DEPICTED
AND DESCRIBED ON EXHIBIT "A" ATTACHED HERETO;
PROVIDING FOR THE AMENDMENT OF WINTER
SPRINGS CHARTER, ARTICLE I1, BOUNDARIES, TO
INCORPORATE THE REAL PROPERTY INTO THE CITY

WHEREAS, this is a voluntary annexation which shall be pursuant to the annexation procedures
contained in section 171.044, Florida Statutes; and
WHEREAS, the City Commission has determined that the subject real property is reasonably
compact and contiguous with the boundaries of the City of Winter Springs and will not create an enclave
and otherwise satisfies the requirements for annexation; and
WHEREAS, this annexation is in compliance and consistent with the goals and objectives of the
City of Winter Springs Comprehensive Plan, Charter, and City Code; and
WHEREAS, upon the effective date of this Ordinance, the municipal boundary lines of the City of
Winter Springs, contained in Winter Springs Charter, Article II, shall be redefined to include the subject
real property; and
WHEREAS, the City Commission is aware that one of the property owners petitioning for
annexation, Janet M. Mann, trustee, has fled a quiet -title action in the Seminole County Circuit Court
against the property owner lying adjacent and west of the Mann Property, as a result of a claim that the
adjacent property Walter Lee Hendrix and Bernice Hendrix ( "Hendrix "), are occupying a portion of land
located in the southwest corner of the Mann Property which is the subject of this Ordinance; and
WHEREAS, notwithstanding the aforesaid law suit, Mann is requesting that their real property be
annexed into the jurisdictional limits of the City of Winter Springs at this time; and

WHEREAS, based on the advice of City staff and City Attorney, the City Commission has
determined that the Quiet -Title action does not justify delaying Mann's request to annex their real property
into the City because Mann is the actual owner of record of the real property legally described herein,
provided a contingency is set forth herein; and
WHEREAS, the City Commission desires to adopt this Ordinance subject to a contingency that
provides to the extent that the Court determines, or Mann and Hendrix mutually agree by settlement
agreement and a recorded real estate deed, that Hendrix is the owner of a portion of the southwest portion of
the Mann Property which is subject to the lawsuit and this Ordinance, the portion of the Mann Property
which is declared owned by Hendrix as a result of the lawsuit shall automatically be deemed excluded from
this Ordinance because the City Commission acknowledges that Hendrix has not filed a voluntary petition
to annex their property into to the City of Winter Springs at the time this Ordinance was adopted by the City
Commission; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds that this
Ordinance is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs,
Florida.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS
HEREBY ORDAINS, AS FOLLOWS:
Section 1. Annexation of Real Property. The area of real property, which is more
particularly described in the metes and bounds legal description and map attached hereto as Exhibit "A," is
hereby annexed into the City of Winter Springs by the City Commission. Exhibit "A" is hereby fully
incorporated herein by this reference.
Section 2. City Boundaries Redefined; Winter Springs Charter Amended. Pursuant to
section 166.031(3), Florida Statutes, and section 171.091, Florida Statutes, the City of Winter Springs
Charter, Article II, Section 2.01, shall hereby be amended to redefine the corporate boundaries of the City
of Winter Springs to include the area of real property described in Section 1 of this Ordinance. The City
Clerk shall file the revised Winter Springs Charter, Article II, Section 2.01, with the Department of State
within thirty (30) days upon said approval and shall provide a copy to the Office of Economic and
Demographic Research along with a statement specifying the population census effect and the affected land
area. The City Clerk shall also file this Ordinance with the Clerk of the Circuit Court of Seminole County,
the Chief Administrator of Seminole County, and the Department of State within seven (7) days of the
effective date.
Section 3. Contingency to Address Quiet -Title Action, If Necessary. The City
Commission acknowledges that Janet M. Mann, as Trustee of the Janet M. Mann Revocable Trust, Dated
March 9, 2004 ( "Mann ") has filed a Complaint to Quiet -Title against Walter Lee Hendrix; Bernice Hendrix
and Bank of America ( "Hendrix ") in the Seminole County Circuit Court, Case NO. 2015 CA 001698
140 -K. The basis of the complaint is that Mann alleges that Hendrix may be occupying the southwest
corner of the Mann Property which is the subject of this Annexation. The City Commission hereby finds
that it is not the intent and purpose of this Ordinance to annex any real property owned by Hendrix.
Therefore, to the extent that the Court determines, or Mann and Hendrix mutually agree by settlement
agreement and a recorded real estate deed, that Hendrix is the owner of any portion of the Mann Property
legally described herein, particularly the southwest corner which is subject to the lawsuit and this

Ordinance, the portion of the Mann Property which is declared owned by Hendrix as a result of the lawsuit
shall automatically be deemed excluded from this Ordinance and not annexed into the jurisdictional limits
of the City. If such exclusion occurs after the adoption of this Ordinance, the City boundaries shall be
redefined accordingly to remove the excluded property pursuant to Section 2 of this Ordinance, and the City
Clerk is authorized to make the necessary corrections with the appropriate governmental agencies and to
the City Charter. Further, to the extent that any City map incorporates the excluded property into the
jurisdictional limits of the City including, but not limited to maps set forth in the City's Comprehensive
Plan and Official Zoning Map, the City staff is directed to modify the City maps accordingly to remove the
excluded property.
Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All ordinances
and resolutions or parts of ordinances and resolutions in conflict herewith are hereby repealed to the extent
of the conflict.
Section 5. Severability. Should any section or provision of this Ordinance, or any portion
hereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder hereto as a whole or part thereof to be declared
invalid.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular meeting
assembled on the th day of February, 2016.

Garganese said he would like to review and analyze the document and suggested that if there was litigation, this

the voluntarily annexation of two (2) parcels totaling approximately 20.48 gross acres, more or less,
currently within Seminole County, Florida, and generally located just east of the intersection of State Road
434 and State Road 417.
FISCAL IMPACT:
The applicant desires to combine the two (2) county parcels for future development. Development of the
subject property is anticipated to provide an increase to the City's taxable value. A detailed Fiscal Impact
Report will be performed once specific development plans are made available.

REQUEST:
The Community Development Department — Planning Division requests that the City Commission hold a
Public Hearing to consider Second Reading and Adoption for both the Large -Scale Future Land Use Map
Amendment and Rezoning for approximately 20.48 acres, generally located just east of the intersection of
State Road 434 and State Road 417 as described within Ordinances 2015 -02 and 2015 -03. In addition, staff
recommends placing the subject property within Traffic Concurrency Exemption Area (TCEA) Zone C
and simultaneously updating the existing City of Winter Springs TCEA Zone Map to reflect said change.
FISCAL IMPACT:
The proposed Large Scale future Plan Amendment will increase the possibility of additional taxable value
to the City and potentially spur the increase of future residential, commercial and /or office development
activity within this particular area. A detailed Fiscal Impact Report will be performed once specific
development plans are made available.

reading of: 1) Ordinance 2015 -08, which proposes the rezoning of a 39.81 acre property from GID
(Greeneway Interchange District) to PUD (Planned Unit Development), 2) Development Agreement, and 3)
Master Plan for the 39.81 acre property located on the north side of SR 434, across from the Creeks Run
subdivision.
FISCAL IMPACT:
Development of the property will provide an increase in taxable value to the City. A fiscal analysis report is
attached.

The applicant held public information meetings on May 19, 2015 and November 17, 2015 with members of

RECOMMENDATION:
At the December 2, 2015 Planning & Zoning Board meeting, the Planning & Zoning Board unanimously
recommended denial of Ordinance 2015 -08, the Development Agreement, and Master Plan for the subject

Mayor Lacey introduced this Agenda Item and commented, "As I said at the very beginning,
the companion item to this "401" for the Zoning on it, Future Land Use Map will be
postponed when we get to that."
Continuing, Mayor Lacey remarked "This is the First Reading of a Revised Ordinance. So,
we have heard it before but this is back for the First Reading for the Annexation of that
property. Do we have a Motion to read by `Title' only."
RELATED TO THIS ORDINANCE 2015 -01, "MOTION TO READ BY "TITLE"
ONLY." MOTION BY DEPUTY MAYOR HOVEY. SECONDED

Attorney Garganese read Ordinance 2015 -01 by "Title" only and noted "This matter is
regarding the annexation of what we have called the Mann Wilson property and if you recall,
in between First and Second Reading, there was information brought to the City's attention
regarding a pending lawsuit; and we got a copy of the lawsuit, we evaluated it and apparently
Janet Mann, the Trustee has filed a Quiet Title action against adjacent property owners the
Hendrix's, regarding the southwest corner of their particular piece of property.
Based on our evaluation of that lawsuit, we went forward and requested that the Applicant
provide a boundary survey to the City to review, and a copy of that survey and metes and
bounds legal description is on the dais this evening. It was inadvertently left out of the
package and what you can note from that boundary survey — in the southwest corner there
appears to be a driveway and a one (1) story residence, on the southwest corner of the Mann
property and that's what I believe to be at issue in the Quiet Title action. Regardless, the legal
description of record for the Mann property is recorded in the official records of Seminole
County.
We have a voluntary petition for Annexation filed by the Mann property owner, as well as
Wilson and the City is moving forward with a Voluntary Annexation of both those properties
based on the legal descriptions that are of record. And I think it's appropriate for the City to
move forward in that fashion. That required us to make some changes to the Ordinance which
requires First Reading all over again; and with all of that said, we built a contingency into this
Ordinance that depending on what the results of the Quiet Title action are, in the event that it
is declared or agreed to, that Hendrix owns a portion of the southwest corner of the property,
this Ordinance will automatically exclude that portion of the property from this Annexation
because the Hendrix's have not filed a Voluntary Annexation petition."

matter and noted the two (2) surveys in question.
Attorney Garganese commented, "If it's later determined that they own a portion of this
property and it's carved out, then they're free to request Voluntary Annexation with the City
at that time."
With further remarks, Dr. Bowles added, "They're okay with that."
