On January 21 , 2015, Sgt. Ken Frein responded to this
home on an unrelated call. During his time, he noticed
several people who were at the home upon his arrival or
who arrived shortly thereafter. All admitted to renting
rooms from the owner, Mr. Cruz.
The residence is a single family home of approximately
1 ,244 living square footage. There were three renters in
addition to Mr. Cruz living there based on Sgt. Frein' s
observations.

This case remained active during the following months as
Sgt. Frein continued to try to follow up with Mr. Cruz.
When he was unsuccessful, he reached out to Code
Enforcement to help. On May 7, 2015, I met with Mr.
Cruz at his request following the receipt of the NCV letter.
Mr. Cruz' s home has what appear to be two main entry
points from the patio: one that is exclusively his and the
other door which leads into the main kitchen and living
room. These two places, although in the same home, are
separated by double-cylinder deadbolt locks.

Down the main hall, there were at least two doors that
were locked with double-cylinder deadbolts and
doorknobs. It was clear that only the person staying in the
particular room was welcome in that exclusive space.
I also noticed there were two refrigerators in the kitchen
although one was not working at the time and empty.
Ordinance definition- Chapter 20
Family: An individual or two (2) or more persons
related by blood or marriage, or a group of not more
than five (5) persons living together as a single
housekeeping unit in a dwelling, who need not be
related by blood or marriage.
*The arrangement seen within the home clearly violates this
section as there is no evidence of a single housekeeping unit.
There has been no additional contact with the owner.

• The Notice of Code violation letter was sent via Certified
mail on April 1 , 2015 and was signed delivered to Mr.
Cruz on April 6, 2015.
• The Notice of Code Board hearing was mailed Certified to
Mr. Cruz on June 2, 2015 and was signed for by him with
no date listed. The LISPS website indicates that date was
June 5 2015. The Notice was also posted on the property
and City Hall on June 2, 2015 by Code Officer Guerra.

In this case, I am recommending the owner be permitted
until August 17, 2015 to correct the violation. If found in
subsequent non-compliance, a fine of $ 100.00 per day be
imposed.
