FLORIDA 3E771 August 10 , 1972 • Mr. Ron Bergman, City Manager City of Casselberry % City Hall Casselberry, Florida Dear Ron: In reply to your letter of August 8 , the Board' s policy regarding installation of traffic signals at inter- sections of State highways and County roads in the un- incorporated areas involves several steps. Once the Board is cognizant that a problem may exist, we direct the County Engineer to make an initial survey for recommendations to the Board, After the recommendations are received, the Board would either pursue it no further if no problem exists; or, should a problem exist, a resolution is adopted requesting the State Department of Transportation to make a comprehensive study. Upon completion of the study by the Department of Transportation, recommendations are made by that agency. If these recommendations indicate a need, the Board enters into a contract with the State Department of Transportation for the signal with the cost of installation and continuing maintenance being borne by the County from this County' s share of the State Local Revenue Sharing Funds . Upon completion of installation, the County continues to pay the annual electrical expense as well as providing maintenance and repairs as the need arises. Several years ago, we adopted the policy wherein any development creates the necessity for installation of a traffic signal the developer must provide the funding for the signal necessitated by his profit-making operation. This equitable policy precludes the taxpayers subsidizing special interests . The proper time to call for the developer to provide the funds is not belatedly if the need arises , but rather at the time of consideration of the zoning item. • Mr. Ron Bergman August 10 , 1972 Page -2- The City of Casselberry and the other cities are in a position to assist the County taxpayers in not subsidizing developers by requiring them, at the time of zoning, to provide any and all traffic signals necessitated by a proposed develop- ment,, whether or not the intersection is in the County or in the City. While touching upon this latter point, I would like to also point out that this would be the appropriate time to look to the developer for any costs necessitated by his development for median cuts , acceleration lanes , storage lanes , and de- celeration lanes on State , County, and City roads. Once zoning is approved, the governing bodies have very little chance to provide this equitable savings to the taxpayers.
