The Community Development Department, Planning Division, is requesting that the City
Commission consider an application to vacate a portion of a platted 15 -foot utility and
drainage easement located on Lot 20 in the Greens at Tuscawilla.
SYNOPSIS:
On June 9, 2015, TGD Orlando, LLC submitted a building permit application for the
construction of a townhome located at 1537 Corkery Court, also known as Lot 20, the
Greens at Tuscawilla. Upon review of the building permit application, it was determined
that the building on Lot 20 would encroach on a portion of a platted 15 -foot utility and
drainage easement. It was conveyed to the applicant that they could petition the City
Commission to vacate a portion of the easement to permit the construction of the townhouse
as originally proposed.

The applicant is the developer of the Greens at Tuscawilla. The Final Engineering Plan for
the Greens at Tuscawilla was approved by the City Commission in 2011. According to a
survey provided by the applicant, dated June 2015, there is a platted utility and drainage
easement along the east portion of Lot 20. The applicant has submitted a building permit
application for the construction of a townhome on Lot 20. Upon review of the building
permit application, it was determined that the building on Lot 20 would encroach on
a portion of a platted 15 -foot utility and drainage easement. The plat shows the 15 -foot
utility and drainage easement, however, this easement was not shown on the final
engineering plan that was approved by the City Commission on October 10, 2011. It was
conveyed to the applicant that they could petition the City Commission to vacate a portion
of the easement to permit the construction of the townhouse as proposed. Resolution 2015-
16 proposes vacation a 169 square foot portion of the platted utility and
drainage easement in order to permit construction of the townhome.
The applicant has obtained letters of approval from applicable utility providers including the
City of Winter Springs, Bright House Networks, and Duke Energy. Vacation of the 169
square foot portion of the easement to permit construction of the townhome does not impact
any necessary infrastructure.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have

RECOMMENDATION:
The Community Development Department - Planning Division requests the City
Commission review and approve Resolution 2015 -16, which proposes vacation of a 169
square foot portion of a platted utility and drainage easement located at 1537 Corkery Court
in The Greens at Tuscawilla.

A RESOLUTION OF THE CITY COMMISSION OF WINTER
SPRINGS, FLORIDA RELATING TO THE VACATION OF A
PORTION OF A 15 -FOOT UTILITY AND DRAINAGE
EASEMENT WITHIN THE CITY OF WINTER SPRINGS
LOCATED ON LOT 20, THE GREENS AT TUSKAWIL,LA, AS
RECORDED IN PLAT BOOK 76, PAGES 58 THROUGH 61,
PUBLIC RECORDS IN AND FOR SEMINOLE COUNTY,
FLORIDA; PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS; SEVERABILITY; AND AN
EFFECTIVE DATE.
WHEREAS, the owner of real property generally located at 1537 Corkery Court in the
City of Winter Springs, more particularly described herein, has requested the vacation of a
portion of a platted 15 -foot utility and drainage easement for the construction of a townhouse;
and,
WHEREAS, the City of Winter Springs is not currently using, nor has any plans to use,
the subject utility and drainage easement; and
WHEREAS, each provider of utilities within the City of Winter Springs has indicated in
writing, copies of which are on file with the Community Development Department, that it has no
objection to the vacation of the subject utility and drainage easement; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds
this resolution to be in the best interest of the public health, safety, and welfare of the citizens of
Winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
WINTER SPRINGS, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The following recitals are true and correct and hereby fully
incorporated herein by this reference as part of this Resolution.

Section 2. Easement Vacation. The City Commission of the City of Winter
Springs hereby vacates that certain portion of a 15 -foot utility and drainage easement generally
located at 1537 Corkery Court, Winter Springs Florida, Lot 20, The Greens at Tuscawilla, as
recorded in Plat Book 76, Pages 58 through 61, Official Records in and for Seminole County,
Florida, which vacated portion is legally described and depicted in Exhibit "A ", attached hereto
and fully incorporated herein by this reference.
Section 3. Recording. Following adoption of this resolution by the City
Commission, the City Clerk shall record same in the Official Land Records for Seminole County,
Florida.
Section 4. Repeal of Prior Inconsistent Resolutions. All prior inconsistent
resolutions adopted by the City Commission, or parts of resolutions in conflict herewith,
are hereby repealed to the extent of the conflict.
Section 5. Severability. If any section, subsection, sentence, clause, phrase,
word or provision of this resolution is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, whether for substantive, procedural, or any other reason, such
portion shall be deemed a separate, distinct and independent provision, and such holding shall
not affect the validity of the remaining portions of this resolution.
Section 6. Effective Date. This Resolution shall take effect immediately upon
adoption by the City Commission.
RESOLVED by the City Commission of the City of Winter Springs, in a regular meeting
assembled on the day of , 2015.

The Board of Supervisors for the Shingle Creek Community
Development District will hold two Public hearings and a regular meeting
on August 5, 2015 at 1:00 p.m. at 1520 Oasis Club Boulevard,
Championsgate, Florida 33896
The purpose of the first public hearing is to receive Public comment and
blectlons on the Fiscal Year 2016 Proposed Budget. The -first Public
hearing is being conducted Pursuant to Chapter 190, Florida Statutes. The
Purpose of the second Public hearing is to consider the Imposition of
pecial assessments to fund the District's Proposed budget for Fiscal Year
2016 upon the Ion located within the District, a depiction of which lands
is shown below, consider the adoption of on assessment roll, and to
Provide for the levy, collection, and enforcement of the assessments. The
second Public hearing Is being conducted Pursuant to Florida low
including Chapters 190 and 197, Florida Statutes. At the conclusion of the
Public hearings, the Board will, by resolution, adopt a budget and levy
assessments as finally approved by the Board. A regular board meeting
of the District will also be held where the Board may consider any other
business that may Properly come before It.
A copy of the Proposed budget, preliminary assessment roll, and the
agenda for the hearings and meeting may be obtained at the offices of the
District Manager, located at 12051 Corporate Boulevard, Orlando, Florida

The special assessments are annually recurring assessments and are in
addition to debt assessments to be levied in the future. The table below
