ORDER IMPOSING PENALTY ON FIRST VIOLATION
THIS CAUSE having come on for consideration, after being duly noticed, before the Code Enforcement
Board of the City of Winter Springs, Florida, on April 23, 2013 to determine whether any violations of the City of
Winter Springs Code of Ordinances ( "City Code ") exist or existed on the Property. The Board, having heard the
arguments of the parties and the evidence and testimony presented, and having reviewed the record and being
otherwise fully advised, the following Findings of Fact and Conclusions of Law are incorporated into this Order as
set forth herein.
Findings of Fact and Conclusions of Law
Based upon the evidence and testimony presented at this hearing, the Code Enforcement Board finds:
1. That Respondent was provided a Notice of Violation in accordance with Section 2 -59 of the City Code
and consistent with sections 162.06 and 162.12, Florida Statutes;
2. That a violation of IPMC 303.2 Enclosures., and 304.2 Protective Treatment. exist(s) or existed upon the
Property and that Respondent was further provided a reasonable time to correct said violation(s);
3. That Respondent either failed or refused to correct such violation(s) within the reasonable time period
provided in the Notice of Violation; that the Respondent was provided notice of hearing before the Code Enforcement
Board and was not present at the hearing;
3. That based on the testimony and evidence presented, Respondent has violated the IPMC, to wit:
303.2 Enclosures., and 304.2 Protective Treatment.;
5. That said violation(s) exist(s) or existed within the City of Winter Springs and that such constitute(s)
violation(s) of the City of Winter Springs Code of Ordinances.

BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY ORDERED:
Respondent be given until May 15, 2013 to correct the violation(s) of the City Code on the Property; and
2. If Respondent fails to correct the violation(s) within the time period set forth herein, the Code
Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and Respondent shall be
duly noticed and given an opportunity to appear and present evidence as to the status of the violation(s) on the Property.
Upon a finding by the Code Enforcement Board that the Property remains in violation, a fine will be immediately entered
upon a filing of a Notice of Non - Compliance by the Code Enforcement Officer, in the amount of ONE HUNDRED
DOLLARS ($100.00) per day until the violation(s) is /are corrected and full compliance is confirmed by the Code
Enforcement Officer. Respondent shall be responsible to provide notice of such violation(s) being corrected to the Code
Enforcement Officer. Upon such confirmation, the Code Enforcement Officer shall promptly file a Notice of Compliance;
Any fine imposed pursuant to this paragraph shall be retroactively imposed beginning on April 23, 2013;
3. If Respondent fails to correct any and all violations on the property within the time period prescribed
herein, the Clerk of the Code Enforcement Board shall be directed to record a certified copy of this Order in the public
records for Seminole County, Florida, which shall serve as a lien against the Property and any other real or personal
property owned by the Respondent;
4. Any and all future recurrence(s) of any violation(s) addressed herein after same have been corrected shall
necessitate further proceedings before the Code Enforcement Board without necessarily providing Respondent(s) an
opportunity to correct such violation(s) and that the Code Enforcement Board, upon finding such repeat violation(s) exist(s)
shall impose a fine not to exceed Five Hundred Dollars ($500.00) per day for each repeat violation, beginning on the first
day the repeat violation(s) is / are found to exist.
5. The Code Enforcement Board hereby reserves the right to take further necessary action against the
Respondent(s) to enforce this Order and correct any violation(s) on Respondent's property, in accordance with Section
162.09, Florida Statutes, and City of Winter Springs Code, Chapter 2, Article III, Division 2.

Related to this Case, Inspector Flannigan offered into Evidence "` WS -2, which is the
United States Postal Service print-out for the Notice of Violation; 'WS-3' is the United
States Postal [Service] print-out for Code Board Hearing; 'WS-4' is the Affidavit of
Posting for Code Board.
On March 5th, 2013 1 observed that the pool enclosure had fallen screens. There has been
a portion of the patio that has unprotected wood. Notice of Violation was mailed on
March 13th, 2013 and was delivered on March 16'h from the United States Postal Service
website. There has been no contact with the Owner of Record. Notice of Hearing was
mailed on April 0, 2013. According to United States Postal Service website it was
delivered April 8th, 2013. The Notice was also Posted at the property and at City Hall on
April 2nd, 2013."
Photographs of the Violations were shown from previously submitted 'WS-l'. Further
comments.
Continuing, Inspector Flannigan stated, "in regards to this Case, I am recommending the
Owner be given until May 15th, 2013 to correct the Violations. If found in Non-
Compliance, a Fine of a hundred dollars ($100.00) a day be imposed retroactive to April
23", 2013."
Assistant to the City Clerk Beaudet swore in Mr. Glen Peter Ahlers,
Mr. Glen Peter A hlers, 1100 Gator Lane, Winter Springs, Florida: noted he was residing
at the property as part of a lease to buy transaction; and said that the landlord was not
making the mortgage payments and the bank is foreclosing on the property; and inquired
as to whom was actually receiving the Code Violation Notices.
Assistant City Attorney Latorre remarked, "Because it's Titled under the LLC (Limited
Liability Corporation) name, the LLC (Limited Liability Corporation) gets the Notices."
Chairperson Wood said, "You are not the Owner, but we appreciate you being here, very
much so." Further discussion.

Next, Chairperson Wood noted that the City wanted "The screen to be repaired and as I
understand it, just the wood to be painted. Correct, is that what you are asking the owner
to do ?" Inspector Flannigan answered, "Correct. If that's part of the porch, then it still
has got to have some kind of protective treatment." Discussion.

Note from the Assistant to the City Clerk The date noted above is what was noted on the
Agenda but as shown in the following documented comments, the date of April 23rd, 2013
is when the Case was originally heard, not the April 24`h, 2013 date.
Inspector Flannigan presented the Case and submitted into Evidence, "'WS-l', the CD
(Compact Disc) for tonight; 'WS-2' is the Return Receipt for the Code Board Order;
'WS-3' is the United States Postal Service, Code Board Notice; 'WS-4', is the Certified
Notice for the Code Board Hearing; 'WS-5' is the Affidavit of Posting."
Next, Inspector Flannigan stated, "April 23rd, 2013, the Case was originally heard and
found in Violation. The owner was given until May 15th, 2013 to correct the Violations.
If found in Non - Compliance, a Fine of a hundred dollars ($100.00) a day retroactive to
April 23rd would be imposed. The Order of the Board was signed for by Robert Jennings
and Samuel Etzen.
Notice of Hearing was posted at the property and City Hall on February 11th, 2014. The
Notice of Hearing was also mailed on February 7th, 2014. According to the Unites States
Postal Service website, on February 11th, 2014 the Notice was left and there was no
authorized recipient available. There have been no improvements made to the property.
Also, there has been no contact from the owners."

Concluding her testimony, Inspector Flannigan recommended the original Order of the
Code Enforcement Board be entered as a Lien. Discussion.
Note: The Respondent was not present.

The Winter Springs City Commission has the discretionary authority to reduce or release a lien or line according to the procedure established
in Ordinance Sec. 2.61 -5. A person or entity requesting a reduction or release has no right to the reduction or release of o fine or lien.
Applications will not be accepted if the Lien Address (praperty subject to the lien) has any active codes cases.
Once an application is received and the $50.00 non - refundable (uppiicatipn fee and recording roses) is paid, the Community Development
Director will confirm through the Code Enforcement Department that the violation ho been brought into compliance.
Next, the Community Development Director will review the application end place the application upon the agenda of the next regularly
scheduled meeting of the Code Enforcement Board for the City of winter Springs.
At the hearing before the Code Enforcement Board, the board shall review and consider the application for satisfaction or release of lien.
provide the violator with an opportunity to address the hoard regarding the application for satisfaction or release of lien, and to take the
testimony of other interested parties, including but not limited to city staff.
Upon review of the application and any testimony presented, the Code Enforcement Board shat! recommend to the City Commission
approval, approval with conditions, or denial of the opplicotion for satisfaction or release of lien.
The Cade Enforcement Board, in determining its recommendation, sllull consider the following factors:
a. The gravity at the violotlon;
p. The time in whith it took the violator to come into compliance;
The accrued amount of the code enforcement fine or lien:

e. Any financial hardship;

After a recommendation has been rendered by the Code Enforcement Board, the Community Development Director shall place the application
for satisfaction or release of lien upoo the agenda of the next regularly scheduled City Commission meeting. The City Commission may take
action solely based upon The sworn application and recommendation of the Code Enforcement Board, and information provided by the
violator in regard to the application for SatlSfaCtian ar release of lien;
(9) The City Commission may approve, approve with conditions, or deny the application to satisfy or release of lien, if the City Commission
approves the application to satisfy or release the lien and the approval is conditioned upon the violator paying a reduced penalty, fine, or
any other condition, the satisfaction or release of hen shall not be prepared or recorded until the conditions) placed by the Camml5510n

The violator shall have thirty (3,B) days in which to comply with the conditions imposed by the City Commission. Failure of the violator to
comply will result in the automatic denial of the application for satisfaction or release of lien.
If the application is denied or if the application is automatically denied due to the failure of the violator to comply with the conditions
imposed by the City CammlS5lon, the vtointot shall thereaher be barred from applying for a subsequent reduction or forgiveness of the lien
for u period of one (1) year from the dote of denial. During the one -year period: the lien may only be satisfied and released upon full
payment of the fine or penalty imposed in accordance with this chapter.

arguments of the parties and the evidence and testimony presented, and having reviewed the record and being
otherwise fully advised, the following Findings of Fact and Conclusions of Law are incorporated into this Order as
set forth herein.

Based upon the evidence and testimony presented at this hearing, the Code Enforcement Board finds:
1. That Respondent was provided a Notice of Violation in accordance with Section 2 -59 of the City Code
and consistent with sections 162.06 and 162.12, Florida Statutes;
2. That a violation of IPMC 303.2 Enclosures_, and 304.2 Protective Treatment. exist(s) or existed upon the
Property and that Respondent was further provided a reasonable time to correct said violation(s);
3. That Respondent either failed or refused to correct such violation(s) within the reasonable time period
provided in the Notice of Violation; that the Respondent was provided notice of hearing before the Code Enforcement
Board and was not present at the hearing;
3. That based on the testimony and evidence presented, Respondent has violated the IPMC, to wit:
303.2 Enclosures., and 304.2 Protective Treatment.;
5. That said violation(s) exist(s) or existed within the City of Winter Springs and that such constitute(s)
violation(s) of the City of Winter Springs Code of Ordinances.

BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY ORDERED:
Respondent be given until May 15, 2013 to correct the violation(s) of the City Code on the Property; and
2. If Respondent fails to correct the violation(s) within the time period set forth herein, the Code
Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and Respondent shall be
duly noticed and given an opportunity to appear and present evidence as to the status of the violations) on the Property.
Upon a finding by the Code Enforcement Board that the Property remains in violation, a fine will be immediately entered
upon a filing of a Notice of Non-Compliance by the Code Enforcement Officer, in the amount of ONE HUNDRED
DOLLARS (S100.00) per day until the violation(s) is/am corrected and full compliance is confirmed by the Code
Enforcement Officer. Respondent shall be responsible to provide notice of such violation(s) being corrected to the Code
Enforcement Officer. Upon such confirmation, the Code Enforcement Officer shall promptly file a Notice of Compliance;
Any fine imposed pursuant to this traranWh shall be, retroactively imposed be inning on AD6123, 2013;
3. if Respondent fails to correct any and all violations on the property within the time period prescribed
herein, the Clerk of the Code Enforcement Board shall be directed to record a certified copy of this Order in the public
records for Seminole County, Florida, which shall serve as a lien against the Property and any other teal or personal
property owned by the Respondent;
4. Any and all future recurrence(s) of any violation(s) addressed herein after same have been corrected shall
necessitate further proceedings before the Code Enforcement Board without necessarily providing Respondents) an
opportunity to correct such violation(s) and that the Code Enforcement Board, upon finding such repeat violations) exist(s)
shall impose a fine not to exceed Five Hundred Dollars (5500.00) per day for each repeat violation, beginning on the fast
day the repeat violation(s) is I are found to exist.
5. The Code Enforcement Board hereby reserves the right to take furtber necessary action against the
Respondent(s) to enforce this Order and correct any violation(s) on Respondent's property, in accordance with Section
152.09, Florida Statutes, and City of Winter Springs Code, Chapter 2, Article III, Division 2.

Addendum to Final Judgment
This addendum is a part of the final judgment to which It Is attached. The rights and interest@ of
the parties and aayone acquiri ng title to the mortgaged property at fo reel osure sale are subject to and
governed by the Helping Families Save Their Haines Act of 2009,13 U-%.C. 5301, This means among other
things that.
The party acquiring.tille through foreclosure sale fakes subject to the interests of tenants as
follows:
1. if the property is occupied by a beta fide tenant who has an unexpired written lease then
the party acquiring title at the foreclosure sale shall honor all terms and conditions of the existing lease.
The tenant mast also honor all terms and conditions of [he esJsting lease. However, if the party aicgoiring
the property at foreclosure sale Intends to occupy it as their primary residence then they may terminate
tire_ lease by glvGug the tenant a 90 day written notice before terminaling the tenancy. Until the lease is
terminated boor parties must perform an terms and conditions of the existing lease.
Z. If the property is occupied'by a bona fide tenant without a lease or with a lease terminable
at will under Florida law then the party acquiring title through foreclosure sale shall give the tenant a
minimum 90 day written notice• before terminating the tenancy, Until the tenancy is terminated both
parties must perform all terms and conditions of the tenancy.
3. If the tenant is s porticipantin the Section 9 voucher program the now owner takes the
property subject to the Section S lease and the Section S Housing Assistance Payments contract provided,
however, If the new owner wants to five in the property then be sbalI give the tenant a minimum 90 day
written notice before terminating the tenawy. Until the tenancy ES terminated both parties must perform
all terms and conditions of the tenancy.
A lease or tenancy is considered bona fide only if;
a. The mortgagor or the child, spouse, or parent of the
mortgagor udder the contract is not the tenant;
b. The ltaoe or tenancy was the result of as arms length
transaction; and
c. The lease or tenancy requires the reseipt of rent that Is not substantially Ines than
fair market rent for the property or the utsWs mot is reduced or subsidized due to
a Federal, State, or local subsidy.
