HomeMy WebLinkAboutTuskawilla Borrow Pits-1992 RESPONSE TO QUESTIONS AND RECOMMENDATIONS FOR BORROW PITS TUSCAWILLA UNITS 14C & 15 A. RECOMMENDATIONS FROM CITY ENGINEER DATED MARCH 2 , 1992 1 . THE BORROW PITS, (EXCAVATION) IS TO BE CONSTRUCTED IN ACCORDANCE WITH THE APPROVED ENGINEERING AND DOCUMENTS SUBMITTED ON FEBRUARY 28 , 1992 WITH REVISIONS DATED MARCH 2 , 1992 . RESPONSE: Agreed. The construction will be supervised and monitored on a regular basis by Michael D. Sims, Geotechnical Engineer, for compliance with the approved documents and monitoring of groundwater effects. The City will be provided with copies of such reports in connection with these activities. 2 . A PERFORMANCE BOND SHALL BE POSTED TO COVER THE PROPER COMPLETION OF BORROW PITS IN ACCORDANCE WITH THE APPROVED ENGINEERING DESIGN. RESPONSE: Agreed. A performance bond or a bond in the aggregate amount of $905,000 has been requested by the City Engineer and will be posted to insure proper construction and reclamation according to permit conditions and City codes. 3 . A PERFORMANCE BOND IS TO BE PROVIDED TO COVER ANY DAMAGE TO SENECA BOULEVARD WHERE THE "BRIDGE CROSSING" IS TO BE PLACED. RESPONSE: Agreed. $7, 000 is included in the performance bond, with a specific provision to cover any damage to Seneca Boulevard. Sullivan Materials, Inc. ("Applicant") agrees to repair any damage that may occur and restore the road to the conditions existing prior to the excavation work. 4 . A CONSTRUCTION FENCE IS TO BE IN PLACE AROUND THE AREA WHERE EXCAVATION IS ON-GOING. RESPONSE: Agreed. A four (4) foot high barbed-wire fence will be constructed and maintained (in conjunction with existing fencing) during the entire operation and will be removed upon completion of final sloping of lake banks. 5. NO RESIDUAL MATERIAL WILL BE LEFT IN MOUNDS OR IN ANY OTHER UNSIGHTLY MANNER. RESPONSE: Agreed. UPON COMPLETION OF EACH PHASE OF THE EXCAVATION, THE AREA WILL BE STABILIZED WITH SOD. RESPONSE: Agreed. As each individual lake is completed, Applicant will grade, seed and mulch the sideslopes and plant native vegetation in accordance with permit requirements. Applicant will not wait until the very end of the project to finish the shorelines, but will engage in continuous reclamation as the project progresses. 7 . THE SIDESLOPES OF THE EXCAVATIONS (BORROW PITS) WILL BE STABILIZED AGAINST EROSION AND AVOID SLOPE MATERIAL SLIDING INTO THE PITS. RESPONSE: Agreed. The sideslopes will be stabilized by seeding, mulching and the planting of native vegetation on the sideslopes. In addition, Applicant has agreed to build sideslopes at a 4- to-1 slope in accordance with the City Engineer' s recommendation. 8 . MAINTENANCE OF THESE BORROW PITS SHOULD BE DETERMINED AND ASSIGNED TO A SPECIFIC ENTITY. RESPONSE: Agreed. See Item #19. 9 . ALL APPROPRIATE STATE AND FEDERAL PERMITS MUST BE ACQUIRED FROM THE APPROPRIATE AGENCIES AND COPIES PROVIDED TO THE CITY PRIOR TO COMMENCEMENT OF WORK. RESPONSE: Agreed. The Florida Department of Environmental Regulation has extensively reviewed all engineering and drawings and has agreed to issue permits on Tuesday, March 24, 1992. The St. Johns River Water Management District has reviewed all documentation and studies. No work will commence until the developer has obtained the requisite permits and the City has received copies. It is specifically understood that approval is conditioned upon St. Johns River Water Management District and Florida Department of Environmental Regulation permit issuance. 10. TRAFFIC CONTROL WILL HAVE TO BE PROVIDED DURING THE COURSE OF THE EXCAVATION ACTIVITY. RESPONSE: Agreed. There will be no hauling activities on any public roads except for the crossings at Seneca Boulevard and Winter Springs Boulevard and within the Expressway R.O.W. at 434. NO CONSTRUCTION VEHICLES ARE TO TRAVEL THE CITY ROADS, SUCH AS WINTER SPRINGS BOULEVARD, SENECA BOULEVARD EXCEPT FOR THE "ASPHALT BRIDGE CROSSING" , VISTAWILLA DRIVE AND THE RAILROAD CROSSING EXCEPT VISTAWILLA DRIVE EXTENSION WHICH REMAINS PRIVATELY OWNED. RESPONSE: Agreed. Trucks hauling the fill materials will be strictly "off-road" type. Except for the stated crossings, these vehicles will not be on the City roads. 12 . THE ROADS SUCH AS WINTER SPRINGS BOULEVARD, SENECA BOULEVARD AND VISTAWILLA AT THE RAILROAD CROSSING ARE TO BE VIDEOED PRIOR TO COMMENCEMENT OF WORK. RESPONSE: Agreed. All roads will be video taped prior to commencement of construction activity. If damage should occur, it will be the responsibility of the Applicant to repair. 13 . THE WINTER SPRINGS DEVELOPMENT J.V. AND/OR SULLIVAN MATERIALS INC. IS TO T.V. THE SEWER LINES ON SENECA BOULEVARD AT THE "ASPHALT BRIDGE CROSSING" BEFORE THE WORK BEGINS AND AFTER THE WORK IS COMPLETED. RESPONSE: Agreed. Sewer lines at Seneca will be video taped prior to commencement of construction activity. If damage should occur, it will be the responsibility of the Applicant to repair. 14 . THE WATER LINES ON VISTAWILLA DRIVE EXTENSION ARE TO BE PRESSURE TESTED AND BACTERIOLOGICALS TAKEN AFTER WORK IS COMPLETED. RESPONSE: Agreed. Pressure testing and bacteriologicals will be performed after work is completed. 15. THE STORM WATER PIPES ARE TO BE TELEVISED AND VISTAWILLA DRIVE EXTENSION ON SENECA BOULEVARD BEFORE WORK BEGINS AND AFTER WORK IS COMPLETED. RESPONSE: Agreed. 16 . IF THE CONTRACT BETWEEN SULLIVAN MATERIALS INC. AND HUBBARD CONSTRUCTION IS NOT CONSUMMATED FOR THE BORROW PIT EXCAVATIONS IN TUSCAWILLA UNITS 14-C AND 15, THIS PERMIT IS TO BECOME NULL AND VOID. RESPONSE: Agreed. Applicant will not be allowed to commence the project until a contract is executed with the Expressway contractor (Hubbard) . ADDITIONAL RECOMMENDATIONS FROM CITY ENGINEER DATED MARCH 9, 1992 17 . HOURS OF OPERATION (TO BE DETERMINED) . DAYS OF OPERATION (TO BE DETERMINED) . RESPONSE: 7: 00 AM - 6: 00 PM, Monday through Saturday for excavation and delivery of material. There will be pumps operating 24 hours per day only during the dewatering phase of the project. Any exceptions to this schedule will require city approval. 18 . ALL MATERIAL EXCAVATED MUST BE USED EXCLUSIVELY FOR THE EXPRESSWAY CONSTRUCTION. RESPONSE: Agreed. An established precondition of permit is an agreement with the Expressway contractor for delivery of materials exclusively for Expressway. Some of the material may be used on-site as would be the case in most developments. 19 . THERE IS TO BE POSTED A MAINTENANCE BOND FOR EACH LAKE (POND) AFTER CONSTRUCTION IS COMPLETED FOR A PERIOD OF THREE YEARS FOR 20% OF THE TOTAL COST OF CONSTRUCTING THE LAKES (PONDS) . RESPONSE: Parcel 15 - Winter Springs Development Joint Venture intends to form a maintenance association comprised of the commercial and residential sites of Tract 15 in conjunction with the development of this Tract. The association will collect assessments and provide for continued maintenance of the lakes as a condition of the development order. Applicant will post a maintenance bond with the City of Winter Springs in the amount of $97,800. This amount is based on bids and actual budgets for maintenance of similar lakes calculated as follows: Mowing $13,990/year x 3 years = $41,970 Planting Maintenance $18,610/year x 3 years = $55,830 Parcel 14C - Applicant will post a maintenance bond to the City of Winter Springs in an amount of $33,150 to insure the proper maintenance of the lakes for a period of five (5) years. The amount is based on $6, 630 per year for shoreline mowing and maintenance of shoreline vegetation. Should the City or other entity desire to assume maintenance responsibility, Applicant will pay direct costs to the City or such entity. 5ao � d � RE.i 247A0001ARTRJDG03.18_ 910315.4 n 20. MOVE THE CHELSEA WOODS ENTRANCE TO THE INTERSECTION OF SENECA BOULEVARD AND WINTER SPRINGS BOULEVARD. RESPONSE: Agreed. Applicant will expend up to $10,000 to construct a new entrance for Chelsea Woods at the intersection of Seneca and Winter Springs Boulevards. In addition to the budget amount for construction, Applicant will provide an easement at each corner to provide land for the entrance and water and electric stub-outs to each corner. The Chelsea Woods homeowners agree to perpetually maintain the new entrance at their cost immediately upon completion of the entrance. C. ADDITIONAL ISSUES AND OUESTIONS 1. IS THERE A POTENTIAL THREAT OF BREACHING THE PROTECTIVE LAYER (HAWTHORNE FORMATION) AND CAUSING ARTESIAN FLOW AND/OR GROUNDWATER CONTAMINATION? Michael D. Sims, in conjunction with FDER and the SJRWMD, has examined this issue and determined that the Hawthorne Formation is satisfactorily dense and in excess of 40 feet in thickness in Tracts 14C and 15. This was determined by extending one deeper boring at each site to the top of the limestones which comprise the Floridan aquifer. The top of the Floridan aquifer was encountered at depths of 82 and 96 feet at Tracts 14C and 15, respectively. It has been concluded by the SJRWMD staff (based on the additional boring data) that there is no concern with respect to any potential penetration of the Hawthorn Formation. It is extremely unlikely, but if a potential problem occurred, the procedure used to cap artesian wells would be used to remedy the situation. 2 . WILL THE DEWATERING CONDUCTED DURING THE EXCAVATION CREATE A LOWERING OF THE WATER TABLE FOR ADJACENT PROPERTIES RESULTING IN PROBLEMS WITH WELLS AND LANDSCAPING? This issue has been specifically addressed and calculated in the geotechnical study. Groundwater will be continuously recirculated on site to above ground holding ponds where the water will percolate back into the ground table. No water will be discharged off-site. Monitoring wells will be placed on the Casscells, property and other properties deemed necessary and routine readings will be reported with a copy sent to the City. If a temporary drop should occur, the contractor will immediately construct a recharge berm to correct the problem. Upon the completion of each excavation, the dewatering ceases and the groundwater resumes its normal seasonal level. RE.::247:000 I ARRSDGO?.18 203:5. 3 . WILL THE FIVE (5) LOTS CREATED ON THE WEST SIDE OF SENECA BOULEVARD CONFORM TO THE EXISTING CHELSEA WOODS SUBDIVISION? Yes, Applicant agrees to adopt the Chelsea Woods current standards which will apply to the five (5) lots. In addition, Applicant agrees to establish haul routes from the lake on the north side of Parcel SAC (to the Beltway) which will not negatively impact any specimen trees.
