Junk And Debris Date Of Service: March 7, 2013 Inspector: Christi Flannigan Inspector Flannigan presented the Case and submitted into Evidence "` WS -1' which is the CD (Compact Disc) of all the (PowerPoint) Presentations tonight; 'WS-2' is the United States Postal Service Notice of Violation that was mailed on 11/28/2012; 'WS-3' is the United States Postal Service Notice of Code Violation, the second time; 'WS-4' is also for the second Notice of Violation that was mailed to the bank; 'WS-5' is the Affidavit of Posting for the Code Board Hearing; and 'WS-6' is the United States Postal Service Notice for the Code Board Hearing." Continuing, Inspector Flannigan noted "This was first observed November 27th, 2012. There is a large pile of junk and debris in the front and the side yards. There was originally large piles of wood, some containers, blocks, and fence pieces that were piled in the yard. Notice of Violation was mailed on November 281h, 2012 to the owner of Record, which was delivered on November 301h, 2012. In researching the property, the bank was also notified on the concern. A Notice was mailed on January 14, 2013 and the Owner of Record was also Re- Noticed. There has been no contact with the owner, other than the day the property was Posted. I was informed that there was no junk and debris and the items in the carport were okay, because somebody else had advised him that it was his garage space. On March 251h, 2013 while at the property for a separate issue — speaking with the owner Ronald ( Lesage), who is here tonight — he was advised that due to the continual issue that the Case would still be presented to the Board for Finding of Fact. Notice of Code Board (Hearing) was mailed on March 7th, 2013. The United States Postal Service website shows the Notice was delivered. Code Board Notice was also Posted at the property on March 6th " Photographs were shown from the PowerPoint Presentation. Further comments. Next, Inspector Flannigan stated, "I was out there yesterday and I spoke with the Owner of Record. The property has been brought into Compliance at this time. I am requesting that it just be entered as a Finding of Fact for the junk and debris, because it has been a continual complaint issue." CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - MARCH 26, 2013 PAGE 9 OF 12 Mr. Ronald Lesage, 31 North Cortez Avenue, Winter Springs, Florida: explained that he has many commitments which keep him busy, and noted, "I did purchase a piece of property in Longwood, so I can start keeping my jet skis; my extra trailers; and anything that I had at home that I can't put behind the face of the house. I have purchased and am renting in Longwood now. I've laid sod, sprinklers, and done everything to try and beautify it. The day I did get cited, I was actually working. I moved onto the backyard and sometimes, as you all know, in order to clean something it might look worse at first. So, I was pulling stuff out and I was doing trailer runs and while I was gone is when I got coded." Further comments. Discussion followed on the Code Inspector recommendation. "I MOVE TO FIND THE RESPONDENT VIOLATED THE CITY CODE AND FAILED TO CORRECT THE VIOLATION BY THE TIME SPECIFIED FOR CORRECTION BY THE CODE INSPECTOR; THAT THE VIOLATION IS CURRENTLY CORRECTED; AND THAT NO FINE BE IMPOSED. ANY SUBSEQUENT VIOLATION OF THE SAME CITY CODE PROVISIONS BY RESPONDENT WITHIN FIVE (5) YEARS FROM THE DATE OF THIS ORDER SHALL BE CONSIDERED A REPEAT VIOLATION, FOR WHICH A FINE OF UP TO FIVE HUNDRED DOLLARS ($500.00) PER DAY MAY BE IMPOSED." Junk And Debris Date Of Service: October 3, 2014 Inspector: Jim Flannigan Corporal Jim Flannigan, Code Enforcement Division, Police Department presented the Case. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - OCTOBER 28, 2014 PAGE 3 OF 15 Submitted into Evidence was "'WS-l', which is the CD (Compact Disc) of tonight's presentations; 'WS-2' is the Order of the (Code Enforcement) Board; 'WS-3' is the NCV (Notice of Code Violation); 'WS-4' is the NCV (Notice of Code Violation) Return Receipt; 'WS-5' is the Code Board Return Receipt; and 'WS-6' is the Affidavit of Posting at the property and City Hall." Continuing, Corporal Flannigan testified, "On March 26th, 2013 the Code Board issued a Finding of Fact for this property, which is the same owner in regards to the junk and debris (Violation). The Finding of Fact was signed for by G. Coutant on April 24th, 2013. On July 26th, 2014 I observed debris being stored in the front and side of the house and other Violations - that were corrected. There were Notice of Code Violations mailed on August 10th, 2014. This Notice was signed for by Tyler Lesage on August 13th, 2014. Notice of Code Board was mailed on October 3rd, 2014. This Notice was signed for by R. Lesage on October 27th, 2014. The Notice was also Posted at the property and at City Hall on October 4th, 2014." Photographs were shown from "WS -1 ", with further comments. Corporal Flannigan added, "On October 201h, I had been in contact with the owner. He is also here this evening. On October 22nd, this property did come into Compliance. He has cleaned up all the junk and debris." Staff recommendation was, "The owner be found in Repeat Violation for junk and debris on the property and a Fine of a hundred dollars a day be imposed." Board Member Carole Giltz noted, "You are saying that it came into Compliance ?" Corporal Flannigan replied, "On October 22nd, when I checked the property, the property came into Compliance on that date. So, that is when the Fines would stop." Board Member Matthew Criswell in turn inquired, "From October 3rd (2014) to October 22ndT" Corporal Flannigan clarified the Fines, "Would be from July until October." Brief comments ensued on a recreational vehicle; and Code Enforcement Board Members inquired about the total amount of the Fine. In determining the amount owed by the respondent for the Violation, Corporal Flannigan confirmed the start date of the Fine would be August 13th, 2014 and end on October 22nd, 2014 at a hundred dollars ($100.00) per day. Corporal Flannigan mentioned that Staff simply makes a recommendation and the final decision is made by the Code Enforcement Board. Mr. Robert Lesage, 31 North Cortez Avenue, Winter Springs, Florida: noted that he had corrected the Violations after the original Hearing. However, Mr. Lesage added that he brought materials home with him from his various jobs and he has been working to improve the appearance of his property. He also noted that the recreational vehicle was his father's who was visiting and that it was no longer on the property. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - OCTOBER 28, 2014 PAGE 4 OF 15 Mr. Lesage also mentioned that he was recently in a car accident and going through physical therapy, which had caused hardships. Discussion. Board Member Matthew Criswell believed the Fine for the Repeat Violation could be excessive. Chairperson Hugh Fisher added that the Code Enforcement Board had the discretion to reduce the penalty amount or any other option regarding the fine, but did not believe the penalty should be waived. Further, Board Member Criswell asked, "How much has the City incurred in hard costs on this Non - Compliance Case ?" Captain Deisler replied, "Generically speaking, it is part of our duty. We are going to go out and do what we have to do. But, if you want to put a fine on it — two hundred dollars ($200.00) maybe ?" Discussion ensued on the original Order of the Code Enforcement Board, which imposed a Fine of one hundred dollars ($100.00) per day, if the property was found in Non - Compliance. Board Member Maurice Kaprow noted he was sympathetic to the hardships Mr. Lesage had encountered recently, but believed that Mr. Lesage knew the property needed to remain in Compliance; that the City had already incurred costs involving the property; and requested that "If another occurrence of this (Violation), that the Fine goes up to two hundred and fifty dollars ($250.00) a day." In turn, Board Member Giltz said, "I could go along with that." "I WOULD MAKE A MOTION TO FIND THE PROPERTY IN COMPLIANCE AS OF TODAY. BUT, A FINE OF TWO HUNDRED AND FIFTY DOLLARS ($250.00) WOULD BE IMPOSED TODAY. AND SHOULD THE VIOLATION OCCUR AGAIN, THE FEE FROM A HUNDRED DOLLARS ($100.00) PER DAY WOULD GO UP TO TWO HUNDRED AND FIFTY DOLLARS ($250.00) PER DAY." MOTION BY BOARD MEMBER CRISWELL.
