The Commission was extremely sensitive to the fact that this is a temporary site, and the need for users of this site to understand its temporary status. Relatedly, since your organization is the focal point of user support for the Paw Park I am requesting that you sign this Memorandum of Understanding simply asking you and your members to acknowledge the terms under which the park is being made available, and to assist in making dog enthusiasts who may not be members of your organization aware of these terms. The purpose of this Memorandum of Understanding is to make people aware of the terms under which the park is being made available. There is obviously nothing in the memorandum that obligates FLOP to any penalties or sanctions for failure to perform any of the terms of the memorandum. Sincerely, Ronald W. McLemore City Manager /iP cc: Mayor and Commission City Attorney MEMORANDUM OF UNDERSTANDING A MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITY OF WINTER SPRINGS HEREIN REFERRED TO AS CITY, AND FRIENDS OF LEASH OPTIONAL PARKS, INC., HEREIN REFERRED TO AS FLOP. WHEREAS, as the City and FLOP agree that a current need exists for a Park dedicated to the purpose of off leash training and recreational opportunities the City and FLOP acknowledge the following: 1. The City will make available approximately two acres of land located on what is commonly referred to as the Wincey Tract at Central Winds Park, further described in Exhibit "A" attached hereto for the operations of a temporary dog park to be used for off leash training and recreational opportunities. 2. The Park shall be known as the Temporary Site of the Winter Springs Paw Park. 3. This facility is being located on the site of a future water reclamation facility and which requires that this site be made available as a temporary only site for the Paw Park. 4. The temporary period of use will begin at such time the City completes the improvements necessary to make the Park operational and shall be terminated on September 30, 2007. 5. The Commission may extend the use of the site for use as a Paw Park at its discretion if it determines that the site is not needed for a water reclamation facility or other municipal purpose, and that the operations of the facility has proven to be an acceptable use of the site compatible with uses surrounding the site. 6. Funding for the FY03 use of the Temporary Paw Park has been appropriated in the amount of $15,000 including $12,000 in City General Funds, and $3,000 from FLOP donations, as further described in Exhibit "C" attached hereto. 7. Future year funding shall be based upon available general fund revenues and FLOP donations. 8. The operations of the Temporary Paw Park shall be under the exclusive responsibility and management of the City. 9. FLOP and all other users of the park shall be strictly governed by the Paw Park Rules adopted by the City, further described in Exhibit "B" attached hereto. 10. The City shall not be responsible for or liable for any injuries to animals or persons visiting the temporary Paw Park. 11. FLOP shall distribute this memorandum to its members and to the extent possible to other users of the park. ONLY DOGS AND THEIR OWNERSMANDLERS ARE PERMITTED IN THIS PARK. 2. ALL DOGS ENTERING THIS PARK MUST BE LICENSED AND VACCINATED AND THEIR CURRENT DOG LICENSE TAG MUST BE VISIBLY DISPLAYED. NO DOGS UNDER FOUR (4) MONTHS OF AGE ARE PERMITTED IN THIS PARK. 4. FEMALE DOGS IN HEAT ARE PROHIBITED FROM THE PARK. 5. DOGS MUST BE LEASHED WHEN ENTERING AND LEAVING THIS PARK, AND DOG OWNERS /HANDLERS MUST HAVE A LEASH IN THEIR POSSESSION AT ALL TIMES WHILE IN THIS PARK. 6. NO MORE THAN THREE DOGS PER OWNER/HANDLER WILL BE ALLOWED IN THIS PARK AT r:WcIrIaIIUT 1 7. PERSONS WHO BRING CHILDREN INTO THIS PARK MUST KEEP THEM UNDER STRICT SUPERVISION AT ALL TIMES. AN ADULT DOG OWNERMANDLER MUT BE IN THE PARK, WITHIN VIEW AND VOICE COMMAND OF THEIR DOG(S) AT ALL TIMES. 9. AGGRESSIVE DOGS ARE PROHIBITED FROM THIS PARK. IN ADDITION, ANY DOG EXHIBITING AGGRESSIVE BEHAVIOR WITHIN THIS PARK SHALL BE IMMEDIATELY REMOVED FROM THIS PARK BY THE DOG'S OWNER/HANDLER. 10. DOG WASTE MUST BE CLEANED UP BY THE DOG'S OWNERMANDLER. 11. DOG OWNERS /HANDLERS MUST IMMEDIATELY FILL ANY HOLES THAT THEIR DOGS CREATE IN THIS PARK. 12. DOG OWNERS /HANDLERS ARE RESPONSIBLE FOR THEIR DOGS'S ACTIONS AND FOR ENSURING THAT THEIR DOGS DO NOT ESCAPE THE FENCED -IN AREA OF THIS PARK. ANY PERSON ENTERING THIS PARK DOES SO AT THEIR OWN RISK AND AGREES TO HOLD HARLESS THE CITY OF WINTER SPRINGS FROM ANY INJURY, CLAIM, OR DAMAGE ARISING FROM OR IN CONNECTION WITH THE USE OF THIS PARK. EXHIBIT "C" COMMISSION AGENDA ITEM 209 12/08/03 Meeting CONSENT X INFORMATIONAL PUBLIC HEARING REGULAR MGR. ! /DEPT Authorization REQUEST: The Parks and Recreation Department is requesting the City Commission's approval to proceed with the Temporary Paw Park on the Central Winds Expansion Property (Wincey) per the Concept Plan. PURPOSE: To obtain Commission approval to proceed with the Paw Park. CONSIDERATION: • At the Tuesday, April 2, 2003, Special Meeting of the City Commission, Resolution 2002 -16 which established the creation of the Paw Park Committee was approved. • The Paw Park Advisory Committee presented its report and recommendations to the City Commission at a Workshop on January 23, 2003. • At the April 14, 2003 meeting, the City Commission approved $ 15,000 for a Temporary Paw Park if the friends of Leash Optional Parks would raise $ 3,000. • The friends of Leash Option Parks raised the $ 3,000, however the Plante Family decided to not short term lease their property to the City for a Paw Park. • A back portion of the Central Winds Expansion Property (Wincey) could be used as a Temporary Paw Park.
