REQUEST:
The Community Development Department - Planning Division requests the City
Commission approve an 18 month extension for an Aesthetic Review and Final Engineering
Plan approval which permitted the development of a Racetrac gas station and convenience
store located on the southeast corner of SR 419 and US 17-92. These requests were
approved by the City Commission on May 13, 2013 under Agenda Item 500.
SYNOPSIS:
Section 9-604 of the City Code of Ordinances states the duration of approval for an
Aesthetic Review is valid for a maximum of eighteen (18) months. At the end of this period,
the City Commission's approval expires. Reasonable extensions may be granted by the City
Commission upon good cause shown. Section 9-74(b) states the period of approval for Final
Engineering Plans is two (2) years from the date of City Commission approval. If
construction of the proj ect has not been completed and inspected by the City prior to the end
of this period, the Final Engineering Plan is required to be resubmitted and reapproved by
the City Commission.

DISCUS SION:
On May 13, 2013, the City Commission approved an Aesthetic Review and Final
Engineering Plan for a Racetrac gas station and convenience store located on the southeast
corner of SR 419 and US 17-92. The duration of approval for an Aesthetic Review is valid
for a maximum of eighteen (18) months, and two (2) years from the date of City
Commission approval for a Final Engineering Plan. Racetrac is formally requesting an 18
month extension for the above referenced approvals. A combination of variable economic
conditions, increased competition, and internal design changes have prevented this project
from commencing. Racetrac needs the additional 18 months to finalize their approach.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends the City Commission approve an 18 month extension for the Aesthetic
Review approval and Final Engineering Plan approval for Racetrac gas station and
convenience store located on the southeast corner of SR 419 and US 17-92.
