CALL TO ORDER
The Regular Meeting of Tuesday, June 24, 2014 of the Code Enforcement Board was
called to Order by Chairperson Hugh Fisher at 5:30 p.m., in the Commission Chambers
of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.

In regards to Agenda Changes, Assistant to the City Clerk Sean Beaudet said that

during this meeting. No objections were noted.
Assistant to the City Clerk Beaudet swore in those who would be providing Testimony
during tonight's Meeting.

Captain Chris Deisler, Code Enforcement Division, Police Department noted that ieszel
PUBLIC HEARINGS — NEW CASES "502.1" was pulled from the Agenda, as the
Respondent requested additional time to correct the Violations due to financial hardship.
Captain Deisler likewise mentioned that the Respondent for PUBLIC HEARINGS —
NEW CASES "502.2" had corrected the Violation(s)prior to the meeting.
Next, Captain Deisler thanked Chairperson Hugh Fisher for his help in selecting a new
Code Enforcement Officer through the Candidate Review Board. Ms. Terri Guerra was
introduced, who mentioned that she had been with the Police Department for 19 years
and was excited to work with the Code Enforcement Board.
Lastly, Captain Deisler briefly explained that a property that had previously come before
the Code Enforcement Board, 221 North Third Street, is once again an issue and will be
coming back to the Code Enforcement Board in the near future.

Inspector: Christi Flannigan
Inspector Christi Flannigan, Code Enforcement Division, Police Department presented
the Case and submitted into Evidence, "`WS-1' the CD (Compact Disc) of the
presentations tonight; `WS-2' is the Return Receipt for the Order of the Board; `WS-3' is
the Return Receipt for the Code Board Notice; `WS-4' is the Affidavit of Posting for
Code Board Hearing."
Continuing, Inspector Flannigan testified, "The original Hearing was held on April 22nd,
2014. Krystal Christopher was found in Violation for a stagnant pool. The Order of the
Board gave the Respondent until May 22nd, 2014 to correct the Violations and if found in
Non-Compliance, a Fine of two [hundred] fifty [dollars] ($250.00) a day would be
imposed. The Order was signed for on April 30th, 2014 by Krystal Christopher. The pool
does have a fence surrounding it.
June 14th, (2014) I spoke with a neighbor who advised that the property owner was
dumping chemicals in the pool, but the pump has not been running. The water remains
stagnant and there is an issue with frogs.
I received a message from Krystal Christopher on May 1st, 2014 advising that they had
left several messages for a return call. I did return her phone call, but there has been no
other contact.
Notice of Hearing was mailed on June 3rd, 2014 and signed for by Krystal Christopher
on June 5th, 2014. The Notice was also Posted at the property and at City Hall on June 3rd,
2014."
Photographs were shown from"WS-1", with further comments.
Concluding her presentation, Inspector Flannigan recommended that the property be
found in Non-Compliance and the original Order of the Code Enforcement Board be
recorded as a Lien.

Non Compliance Hearing Date: November 15, 2011
Inspector: Christi Flannigan
Inspector Flannigan presented the Case and noted that the original Violation was for a
fence in disrepair. Inspector Flannigan covered the process in which Applicants can
request a Lien reduction or release for a property.
Photographs were shown from "WS-1", with further comments.
Continuing, Inspector Flannigan explained, "The amount of the Lien is approximately
fifteen thousand three hundred dollars ($15,300.00). The recommendation is that the
Lien not be reduced any lower than a total of two thousand five hundred and sixty
[dollars] ($2,560.00). That accounts for the Staff costs incurred to file the Liens, present
the Cases, and a standard ten percent (10%) reduction of the total owed to the City for a
new owner who is not going to homestead the property."

Board Member Maurice Kaprow pointed out, "I don't think it is a ten percent (10%)
reduction. It is a ninety percent (90%) reduction. You are only charging them ten percent
(10%) of the Lien." Captain Deisler concurred with Board Member Kaprow and added, saettl
"We are recommending that we go forward to the Commission with a figure owed to the
City of twenty-five hundred and sixty dollars ($2,560.00)." Chairperson Fisher suggested
dropping the word"reduction" from the recommendation.
Board Member Matthew Criswell asked if there were any current, outstanding issues at
the property. Captain Deisler replied, "Apparently there is one (1) piece of board across
the front window of the house right now. But, there is no one living in it. So, we don't
have any other open cases."
Discussion.
Note: The Respondent was not present.
"I WILL MOVE TO RECOMMEND THE CITY COMMISSION REDUCE THE
LIEN ON THIS PROPERTY TO TWO THOUSAND FIVE HUNDRED AND
SIXTY DOLLARS ($2,560.00), AS REQUESTED." MOTION BY BOARD
MEMBER KAPROW. SECONDED BY BOARD MEMBER CALHOUN.

In referencing a presentation improvement, Captain Deisler mentioned that Code
Enforcement Staff has attempted to make the photographs easier to see on the projector
screens during their presentations.
Lastly, Board Member Jim Wentz announced that he had decided not to seek re-
appointment to the Code Enforcement Board, and that he had enjoyed serving on the
Code Enforcement Board.
ADJOURNMENT
Chairperson Fisher adjourned the Regular Meeting at 5:57 p.m.
