HomeMy WebLinkAbout2014 05 12 Consent 305 Tree Removal Request 1771 Owasco StreetCOMMISSION AGENDA ITEM 305 REQUEST: Informational Consent X Public Hearings Regular May 12, 2014 KS RS Regular Meeting City Manager Department The Community Development Department, Arbor Division, asks that the City Commission approve the request of Carl Skoglin to remove (1) specimen tree from his property at 1771 Owasco Street in Chelsea Woods. The resident is concerned about the damage the tree has caused to the driveway, fence, and it's potential to damage the home. SYNOPSIS: Carl Skoglin of 1771 Owasco Street has requested approval to remove (1) 26" diameter live oak tree, which has caused damage to his driveway, is touching his fence, and is within 15' of his house. Section 5 -8 (b) of the arbor ordinance states that a specimen tree shall not be removed except for extraordinary circumstances, hardships, and only by approval of the City Commission. CONSIDERATIONS: Based on an assessment of the tree made by the City Arborist and Urban Beautification Manager in March 2014 and review of pictures and other pertinent information by Staff, approval of the request to remove the tree is recommended. The tree has caused significant damage to the driveway, is pushing against the fence, has lifted underground cable and irrigation lines, and is within 15' of the home. FISCAL IMPACT: If this request is approved, the applicant will pay a $25 arbor permit fee to the arbor fund and be required to install (4) replacement credits or pay a total of $1,000 into the tree bank. Consent 305 PAGE 1 OF 2 - May 12, 2014 COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission approve the request of Carl Skoglin to remove (1) specimen live oak from his property at 1771 Owasco Street. The resident is concerned with the existing damage the tree has caused, proximity to the home, and potential for future damage. Staff finds the existing damage to the driveway and potential for further damage to be an extraordinary circumstance /hardship as referenced in Section 5 -8(b) of the arbor ordinance.
