• Meeting with a neighbor observation from his property
showed there is a 3 foot high concrete wall around the pool
in the back yard, there are no gates for the concrete wall.
Inspection also showed there was no fence for the pool.
• Notice of violation was mailed March 4, 2014 it was
signed for on March 10, 2014 by David Smith.
• There has been no contact from the owner.

• Notice of Hearing was mailed on April 8, 2014. According
to the USPS website the business was closed and notice
was left on April 12, 2014.
• Notice of Hearing was also posted at the property and City
Hall on April 8, 2014. Notice of Hearing was signed for by
Paul Smith on April 14, 2014.
• The owner did a fence to the right side of the house (the
driveway side) but not anywhere else.

In regards to this case, I am recommending the owner be given
until May 16, 2014 to correct the violation. If the owner is
found in non-compliance a fine of $200.00 a day be imposed
retroactive to April 22, 2014.
