SYNOPSIS: The Police Department has recently prepared a complete rewrite of the City's Comprehensive Emergency Management Plan ("CEMP") in order to update the City's policies, strategies, operational goals and objectives through which the City will be able to effectively mobilize resources and conduct response and recovery activities in the event of a major natural disaster or emergency event. The CEMP details an all hazards emergency management framework embodying all aspects of prevention, mitigation, preparedness, response, and recovery, and also establishes the City's policies and protocols under which emergency operations are to be conducted. CONSIDERATIONS: 1. Municipal comprehensive emergency management plans are the municipal counterparts of the county comprehensive emergency management plan, and must be consistent with and subject to the applicable county plan. Municipalities are encouraged, but not required to develop a municipal comprehensive emergency management plan. Rule 27P-6.002, F.A.C. 2. Municipal comprehensive emergency management plans are required by section 252.35 (2)(b), Florida Statutes, to comply with all of the standards and requirements applicable to county comprehensive management plans. 3. Consistent with the requirements of Rule 27P-6.010, Florida Administrative Code, the Consent 302 PAGE 1 OF 3-March 10,2014 Seminole County Office of Emergency Management has reviewed the City's CEMP proposed for adoption by Resolution No. 2014-01 and has found that it complies with all standards and requirements applicable to county emergency management plans and is consistent with the Seminole County Comprehensive Emergency Management Plan (see Attachment 1). 4. Following the County's determination that the City's CEMP is in compliance with the terms of Chapter 27P-6, Florida Administrative Code, the City Commission is required to adopt the CEMP by resolution in order for the plan to officially become effective as the City's CEMP. Rule 27P-6.010(8), F.A.C. 5. Pursuant to section 119.071(2)(4), Florida Statutes, the CEMP is exempt from public records disclosure under section 119.07(l), Florida Statutes, and section 24(a), Article I of the State Constitution and unavailable for inspection, except by personnel authorized by a state or local law enforcement agency, the office of the Governor, the Department of Legal Affairs, the Department of Law Enforcement, or the Division of Emergency Management as having an official need for access to the CEMP. For this reason, the CEMP document is being provided to the Mayor and members of the City Commission for their review and consideration independently from the City Commission agenda. FISCAL IMPACT: There is no fiscal impact associated with this item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: The Police Chief requests that the City Commission consider adopting Resolution No. 2014- 01 approving the Winter Springs Comprehensive Emergency Management Plan, 2014. WHEREAS, Florida municipalities are encouraged to develop municipal comprehensive emergency management plans to serve as counterparts to county comprehensive emergency management plans; and WHEREAS, the City of Winter Springs has recently prepared a complete rewrite of its Comprehensive Emergency Management Plan ("CEMP") in order to update the City's policies, strategies, operational goals and objectives consistent with applicable federal and state regulations in order to effectively mobilize resources and conduct response and recovery activities following a major natural disaster or emergency event; and WHEREAS,municipal comprehensive emergency management plans are required by section 252.35(2)(b), Florida Statutes, to comply with all of the standards and requirements applicable to county comprehensive management plans; and WHEREAS, pursuant to Rule 27P-6.010, Florida Administrative Code, the Seminole County Office of Emergency Management has reviewed the City's CEMP proposed for adoption by this Resolution and has found that it complies with all standards and requirements applicable to county emergency management plans; and WHEREAS,the City Commission desires to approve this Resolution to expressly adopt the revised CEMP in order to attain the City's aforementioned goals; and WHEREAS, the City Commission deems this Resolution to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs, Florida. The City Commission of the City of Winter Springs,pursuant to Rule 27P-6.010(8),Florida Administrative City of Winter Springs Resolution No. 2014-01 Page 1 of 2 Code, hereby adopts the "City of Winter Springs Comprehensive Emergency Management Plan, 2014" ("CEMP"). If any section, subsection, sentence, clause,phrase, word, or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
