CALL TO ORDER
The Regular Meeting of Tuesday, October 22, 2013 of the Code Enforcement Board was
called to Order by Chairperson Hugh Fisher at 5:32 p.m., in the Commission Chambers
of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.

Inspector Christi Flannigan, Code Enforcement Division, Police Department presented
the Case and submitted into Evidence "`WS-1', which is the CD (Compact Disc) of all of
the presentations for today." Subsequently presented was "`WS-2', which is the Return
Receipt for the Notice of Code Violation; `WS-3' is the Certified Mail Receipt for the
Code Violation; `WS-4' is the United States Postal Service print-out; `WS-5' is Affidavit
of Posting for Code Board; and `WS-6' is the Unclaimed envelope for the Code Board
Notice."
Continuing, Inspector Flannigan stated, "I received a complaint in regards to junk in the
yard and cars parked in the yard. I observed there are several vehicles parked in the side
yard along Sunrise Avenue. Initially, there was a trailer parked in the front yard, which
has been moved. There are also unlicensed vehicles parked in the yard.
Notice of Violation was mailed on September 17th, 2013. The United States Postal
Service website shows that the Notice was delivered on September 20th, 2013. The owner
did call and advise that they would be moving the trailer and some parts that were on the
trailer within the week. He also was advised to call and have an Officer come and clarify
the DPA (Designated Parking Area) to him. He advised that he is not sure where it was
supposed to be placed. There has been no work towards a Designated Parking Area.
The Notice of Hearing was mailed on October 3rd, 2013. The Notice was also Posted at
City Hall and at the property on October 1St"

For Staff recommendation, Inspector Flannigan asked that "The owner be given until
November 13th, (2013) to correct the Violations. If found in Non-Compliance, a Fine of
fifty dollars ($50.00) a day be imposed retroactive to October 22nd, (2013)."

Board Member Matthew Criswell inquired, "Are they both dirt driveways or is one of
them paved?" Inspector Flannigan answered, "One is a concrete driveway and the other
one is just dirt." Discussion.

"I MOVE TO FIND THE RESPONDENT, RUSSELL NIELSEN, IN VIOLATION
OF THE CITY CODE AND ORDER THAT THE RESPONDENT BE GIVEN
UNTIL NOVEMBER 13TH, 2013 TO CORRECT THE VIOLATION. IN THE
EVENT THE RESPONDENT FAILS TO COMPLY BY THIS DATE, A FINE IN
THE AMOUNT OF FIFTY DOLLARS ($50.00) FOR EACH DAY THE
VIOLATION CONTINUES THEREAFTER SHALL BE IMPOSED — THE FINE

Corporal Jim Flannigan Code, Code Enforcement Division, Police Department gave
testimony and submitted into Evidence "`WS-1', which would be this evening's Cases;
`WS-2' is the U.S. Postal Service print-out of NCV (Notice of Code Violations) Notice;
`WS-3' is the Return Receipt of Code Board (Hearing); and `WS-4' is Affidavit of
Postings.
On July 22nd, 2013 I observed a boat being stored in the driveway for more than forty-
eight (48) hours. I posted the Violation Notice notifying the owner of the complaint. On
July 23rd, the property owner, Mr. Simmons called and advised that he was in the hospital
and would get it moved as soon as possible. Notice of Code Violation was Certified
Mailed on August 19th, 2013 and signed for on September 18th, 2013.
On October 1St, 2013 a Certified Mail was sent for Notice of Code Board. This was
signed on October 4th, 2013. Notice of Code Board was also Posted on the property on
October 7th, 2013. As of today, October 22nd, (2013) the boat is still in the same location
and no action has been taken to correct the problem.
I did receive a couple phone calls from the owner, Mr. Simmons, who advised he was
going to remove the boat. This was over a month ago. He is out of the hospital. I have
seen him around town and the boat still has not been moved."

Corporal Flannigan concluded by stating, "I recommend that a Fine of a hundred dollars
($100.00) per day be imposed if this Violation is not resolved by November 5th, 2013;
and a Fine of a hundred dollars ($100.00)per day on the first day that it reoccurs."
Board Member Criswell then asked, "How long has he been out of the hospital?"
Corporal Flannigan replied, "Two (2) months. I believe it was mid-August, September."
Further comments ensued.

Corporal Flannigan presented the Case and submitted into Evidence "`WS-1' is the CD
(Compact Disc) of tonight's presentation; `WS-2' is the Return Receipt of the NCV
(Notice of Code Violation); `WS-3' is the United States Postal Service print-out; `WS-4'
is the Code Board Returned envelope; and `WS-5' is the Affidavit of Posting of the
property and here at City Hall.

On September 22nd, 2013 I observed two (2) commercial trucks parked and being stored
behind the fence on this property. A Notice of Code Violation was Certified Mail to the
owner. The Notice was signed for on September 26th, 2013. On October 1St, (2013) I
received a voicemail from Mr. Savoie who advised the vehicles were removed and no
longer on the property. I checked the property after the date he advised me—two (2) days
later, there were still commercial vehicles found on the property. Since those dates, I
have not seen them on the property.
Notice of Code Board was Certified Mail on October 3rd, (2013) and it was received.
Property was Posted on October 7th, 2013 with Notice of Code Board."

Lastly, Corporal Flannigan stated "I am recommending that a Fine of a hundred dollars
($100.00) per day be imposed, if the Violation is not resolved by November 5th, (2013)
and a Fine of a hundred dollars ($100.00)per day if the Violation reoccurs."
Further discussion.
Mr. Jason Savoie, 1204 Deer Run Drive, Winter Springs, Florida: stated that the
vehicles "Have been moved. They were never there on a permanent basis at any time. In
the pictures that you saw — what they are doing there is they are loading up tools. The
truck is actually parked in a storage yard permanently. But, they do have expensive tools
that we keep in my garage. What they do is drive the truck here, pick up the tools, put
them on the truck, and go to the job site. Then they come back to the house, drop the
tools off in the garage, and drive the truck to the facility. I have the facility paperwork
here just to show that it is there."
Board Member Criswell asked, "What facility is that?" Mr. Savoie referenced Evidence
"R-I" and "R-2" and said, "It's a Safe Storage. It is a title property. It just shows that he
has paid for the monthly rental to keep the trucks in there." Further discussion.
Chairperson Fisher sought clarification and asked, "Is it your testimony that these
vehicles were not parked there overnight?" Mr. Savoie answered"No. I'm not saying that
never happened. But, they were never there on a permanent basis at all. One time I think
it broke down. They are not there on a permanent basis and they are not there ever
anymore. Like I said,just to drop off and pick up tools and that's it." Then, Chairperson
Fisher restated, "But, you are in effect conducting business."
Discussion ensued on the purpose of issuing a Finding of Fact by the Code Enforcement
Board for this Case.

AMOUNT OF ONE HUNDRED DOLLARS ($100.00) FOR EACH DAY THE

Continuing, Inspector Flannigan stated, "I received a complaint about several boats and
trailers parked in the yard and the driveway and in the street at that location. I observed a
boat in the street, one on the side yard, and one in the driveway. Notice of Violation was
mailed on September 20th, 2013 and signed for by M. Sheikh on September 24th, 2013.
There was no contact with the owner until yesterday and today. Notice of (Code
Enforcement Board) Hearing was mailed on October 3rd, 2013."

Inspector Flannigan ended her testimony by stating, "I was recommending the owner be
given some time to correct it. As of today, the trailer has been moved and I did speak
with him and explain to him that I'm going to recommend a Finding of Fact, so if the
Violation occurs - for the Record he was here and we discussed it, because of other
obligations, he decided to go ahead and leave. If the Violation reoccurs, than a Finding
of Fact state that there is a fifty dollar($50.00) a day Fine imposed." Further discussion.

Inspector Flannigan presented the Case and began by noting, "As of October 9th, (2013)
the Owner of Record — Beneficial (Bank) was issued Title. The Owner of Record
changed from the Montano's to Beneficial (Bank)." Further comments.

Continuing, Inspector Flannigan submitted into Evidence "`WS-1', the CD (Compact
Disc) for the presentations tonight; `WS-2' is the Return Receipt for the Notice of Code
Violation; `WS-3' is the Return Receipt for the Notice of Code Violation, both of those
are to the Montano's. I had two (2) different addresses, `WS-4' is the United States
Postal Service print-out for the Notice to Beneficial (Bank), for the Notice of Code
Violation; `WS-5' is the letter from the owners; `WS-6' is the Return Receipt; `WS-7' is
also Return Receipt; `WS-8' is the Affidavit of Posting for Code (Enforcement) Board
Hearing.
I received a complaint about junk in the driveway of this residence. Inspection showed
that there was a large pile of household items, some hazardous materials, other junk and
debris in the driveway. Speaking with the neighbors, I was advised that there was a
stagnant pool in the back. I observed the pool initially from the neighbor's yard. It was in
poor condition.
Notice of Intent to Remedy and Code Violation was Posted and mailed on October 2nd.
The owner did call and leave a message to say that the house had been sold to Beneficial
(Bank), which was also Noticed due to seeing the filed Foreclosure paperwork on the
house.
Ms. Montano also advised that they had issues with Waste Pro of Florida picking up the
garbage that they had put out. A neighbor advised that Waste Pro of Florida removed
some trash that was put in the right-of-way.
Notice of Hearing was mailed on October 7th, 2013. After speaking with Mike in the EPA
(Environmental Protection Agency), myself and other Code Enforcement Officers went
to the property and removed all the hazardous materials, including paint cans, fire
extinguishers, liquid lighter fluid, and oil containers.
Nader (Farahmandfar) from the Seminole County Health Department was noticed in
regards to the pool. He advised that he did treat the pool for mosquitoes and he mailed a
letter to the owners that gave them ten (10) days to respond to the health issue, in regards
to the pool. They did put chemicals in the pool, but it's not going to resolve the issue,
because they cannot continue to maintain the pool without any support from the bank.
There are also two (2) shed buildings in the rear of the property that are unsecure and full
of plastic boxes."
Photographs were shown from "WS-1" with further comments. In reference to the
accessibility to the stagnant pool, Inspector Flannigan testified that "As of today when I
went over there, the fence is broken. The front gate is broken, so it's not really secure."
Inspector Flannigan added that the neighbors were reporting vermin related issues with
the property.

Inspector Flannigan stated "In regards to this case, I am recommending an Order be
imposed to authorize the cleanup of the property, draining of the pool, and a Lien for all
costs imposed liened against the property."
Discussion ensued on the contents of the plastic bins in the sheds, the property being
vacant, the foreclosure; and the timeframe for issuance of Certificate of Title to
Beneficial Bank, which occurred October 9th, 2013.
Inspector Flannigan also added, "Captain (Chris) Deisler is recommending that in regards
to the property on our Order to correct it, we would also like to have the bank fined two
hundred and fifty dollars ($250.00) a day after a certain date if they do not correct the
issues."
Captain Chris Deisler, Code Enforcement Division, Police Department reiterated the need
to correct the public safety issues and allow Code Enforcement Staff to correct the issues
as quickly as possible.

Board Member Criswell asked how they would go about remedying the stagnant pool.
Captain Deisler noted that at this point, Code Enforcement Staff would have to drain the
pool, secure the fence, and remove the junk and debris.
Further discussion followed on a corrective action date.

"I MOVE TO FIND BENEFICIAL BANK IN VIOLATION OF CITY CODE AND
ORDER THAT BENEFICIAL (BANK) BE GIVEN UNTIL NOVEMBER 5TH,
(2013) TO CORRECT THE VIOLATION, WHICH WOULD BE CLEANING UP
THE AREA, DRAINING THE POOL,AND MAKING THE AREA SAFE.
IN THE EVENT THE RESPONDENT FAILS TO COMPLY BY THE DATE, A
FINE OF TWO HUNDRED AND FIFTY DOLLARS ($250.00) FOR EACH DAY.
ALSO, MAY A LIEN BE PUT ON THE PROPERTY FOR THE COST OF
CLEANING THE AREA, IF BY CHANCE BENEFICIAL BANK DOES NOT DO
IT WITHIN THAT TIME AT TWO HUNDRED AND FIFTY ($250.00) FOR
EACH DAY THE VIOLATION CONTINUES THEREAFTER SHALL BE
IMPOSED.
FURTHER, THE VIOLATION CONSTITUTES A SERIOUS THREAT TO THE

ASSISTANT CITY ATTORNEY LATORRE ASKED, "IS EVERYONE ON
BOARD WITH THAT? THAT ALLOWS THE STAFF TO GO IN AND FIX THE
IMMEDIATE THREATS TO THE PUBLIC, BUT STILL HOLDS THE
PROPERTY OWNER, WHICH IS BENEFICIAL (BANK), ACCOUNTABLE TO
THE VIOLATIONS. TO HAVE THEM FULLY COMPLIED WITH BY THE
(NOVEMBER) 5TH, (2013)." DISCUSSION.
IN ADDITION, ASSISTANT CITY ATTORNEY LATORRE CLARIFIED,
"WITH THIS FINDING OF THE BOARD, THE STAFF CAN GO AND
CORRECT THESE SERIOUS HEALTH VIOLATIONS AND THEN LIEN THE
PROPERTY FOR THE COST OF DOING SO."
BOARD MEMBER KAPROW INQUIRED, "THE BANK HAS UNTIL
NOVEMBER 5TH TO DO THAT. THEN AFTER NOVEMBER 5TH IS WHEN
THE CITY CAN STEP IN?" ASSISTANT CITY ATTORNEY LATORRE
STATED, "BECAUSE OF THE SEVERITY OF THE ISSUES, THE STAFF WILL
HAVE THE ABILITY TO IMMEDIATELY ADDRESS THEM." FURTHER
COMMENTS.

Chairperson Fisher opened "Public Input".
Mr. Ted Johnson, 1107 Pheasant Circle, Winter Springs, Florida: as the President of the
Tuscawilla Homeowners Association, Mr. Johnson thanked Captain Deisler and the Code
Enforcement staff for their efforts in addressing PUBLIC HEARINGS "502.4"; and
noted that the commercial trucks had indeed been at the property continuously, for days
at a time.
Chairperson Fisher closed "Public Input".
Brief discussion followed on the necessity of the November Code Enforcement Board
Meeting.
ADJOURNMENT
Chairperson Fisher adjourned the Regular Meeting at 6:28 p.m.
