PURPOSE: This Agenda Item is being provided as requested in the City of Winter Springs Code Enforcement Board Policy And Procedures Manual For The Current Year With Discussion On Any Changes. ATTACHMENT: City of Winter Springs, Florida Code Enforcement Board Sample Motions City of Winter Springs Code Enforcement Board Sample Motions A. REGULAR CASES: 1. Finding of Violation; Imposing Fine: I move to find Respondent(s) in violation of the City Code and order that Respondent be given until[DATE] to correct the violation. In the event Respondent fails to comply by this date, a fine in the amount of$ for each day the violation continues thereafter shall be imposed. If violation serious threat to public health, safety and welfare, add: Further, the violations constitute a serious threat to the public health, safety and welfare, and in the event the Respondent does not correct the violation by the date set in this order, the Code Inspector shall be notified and appropriate action shall be taken by the City consistent with Chapter 162, Florida Statutes, to bring the property into compliance. 2. Finding of Violation; No Fine: I move to find that Respondent(s) violated the City Code and failed to correct the violation by the time specified for correction by the Code Inspector; that the violation is currently corrected; and that no fine be imposed. Any subsequent violation of the same City Code provision(s) by Respondent(s) within five years from the date of this order shall be considered a repeat violation,for which a fine of up to $500.00 per day may be imposed. 3. Finding No Violation: I move to find that Respondent(s) has (have) not violated the City Code. B. COMPLIANCE CASES: 1. Finding Noncompliance: I move to find the property in noncompliance and that the penalty set forth in this Board's Order shall be imposed consistent with that Order. 2. Finding Compliance: I move to find the property in compliance and that no fine shall be imposed. C. REPEAT VIOLATION CASES: 1. Finding of Repeat Violation; Still in Violation at Hearing: I move to find the Respondent(s) in violation of the City Code and that such violation constitutes a repeat violation under Chapter 162, Florida Statutes. A fine in the amount of$ for each day the repeat violation continues thereafter shall be imposed. 2. Finding of Repeat Violation; Corrected Prior to Hearing: I move to find that Respondent(s) committed a repeat violation of the City Code and that the violation is currently corrected. The Respondent(s) corrected the violation(s) on [DATE]. A fine in the amount of $ shall be imposed as a result of the repeat violation. 3. Finding No Repeat Violation: I move to find that Respondent(s) has (have) not committed a repeat violation of the City Code. D. MISCELLANEOUS ISSUES: 1. Motions on Requests for Reduction or Satisfaction of Lien: I move to recommend that the City Commission reduce the lien to$ OR I move to recommend that the City Commission satisfy and release the lien.
