I find it ironic, coincidental and odd that this situation happened for another time. You previously sent me a violation for these same items a few months ago. I immediately fixed the fence upon receiving that letter. I have pictures to prove this. I was ready with those pictures at the July Code Board meeting. However, you were sick and I could not submit my pictures or my side of the story. I showed Officer Deisler (I know his dad) the photos and he said that the situation should be resolved then. The fence remained fixed until the weekend I went out of town for a few days. It was still fixed on Friday evening when I left. When I came back on Tuesday, it had mysteriously been broken and you had been out there at that exact time to give me another violation. The odd thing is that this is the same scenario that happened last time. It was fixed until I went out of town and when I got back the fence was mysteriously broken and you had been there to give me a violation. This last time the gate had been fixed, a locking bolt had been installed and dirt had been put behind the gate at that location so that this would not happen again. It had to be forced open to break. I still feel that there is a connection between these violations and my neighbor(whom I stated in prior letters has an ex-husband in the WSPD). There seems to be no other rational explanation. I have now removed the gate (it was never used and there is a gate on the other side of the house that never has an issue). A full panel of fence is now located there. I have pictures to prove this as well. There should be no other way to have that fence be broken in that location again! As for the pool screen enclosure, I was still waiting for some type of response from somebody related to whether I needed the screen fixed or not. I had mentioned in previous correspondences that I was trying to sell the house as is and since this was in the fenced back yard, was I required to fix it. I guess my answer is yes based on this violation, since I have never received a correspondence, a call, or any other confirmation from WSPD or yourself on the question. I have been receiving quotes from various screen repair companies. I have finally received all of them as of this week. I have accepted the quote of A-Screen Repair, Inc of Oviedo. They are the company that fixed my enclosure after the hurricanes as well. I have enclosed a copy of that quote as proof. The problem with the screen repair is that it cannot be done by them before the September 20, 2013 imposed deadline. It will be done shortly after it however. I am going away on a family cruise that has been scheduled for many months now. It happens to be the week of the Code Board meeting. I definitely want to be there for the meeting so that I can voice my view of this matter. I was there for the last scheduled appointment but you had to cancel. I was wondering if it could be reciprocated this month since I will be out of town. I think that is fair! Additionally, the screen will be fixed by that date. I will inform you immediately of when the screen is completed. Even if you decide that you do not want to postpone again, the case should be able to be closed anyway. The fence/gate is fixed. The screen is in the process of being fixed. As an aside, I still have not heard anything regarding the question I raised related to my new neighbors putting weed killer on the side of the lawn we share that resulted in my lawn being killed well onto my property. I have pictures of that as well. Please let me know if the case can be postponed until next month. I desperately want to attend to show all of my evidence related to the items have discussed. If not, I will determine what my course of action will be in that case. I look forward to hearing from you soon. The entire situation has been frustrating, annoying and aggravating since its start. This weekend I went to fix the fence gate that you stated needed fixing. During my last letter I stated that it had been fixed since you issued me the original warning back in February. I, also, stated that the fence had stayed fixed, at least through the July 4th weekend, and it seemed odd that it had fallen down now. Upon going out to fix the fence this weekend, I discovered that the planks had not just fallen down like I stated previously. In fact, the plank with the locked latch on it had been knocked/pushed down. The plank next to it had been broken slightly as well. After fixing the gate, I discovered that the screen door latch going into my screened pool area next to that broken fence gate was also broken. It had been locked and was now unusable. ,• I surveyed my back yard further to see if any other issues were present. I discovered that a whole section of my backyard fence had been broken. One cross beam had been snapped in half while another one had been broken slightly. The ground behind that section of fence had a trench that looked like somebody had tried to push that section in and out numerous times to get out of the yard. The section was found somewhat bent in half, so there was enough area for somebody to get out. It then dawned on me that it appeared like somebody may have broken into my back yard and escaped out that fence area. I have surveyed the rest of the yard as best I could and do not see anything missing or any other damage. I had already fixed both of the broken fence sections since I was under this code violation time crunch. I later thought that it may have been better to call the WSPD before fixing the fence areas. That way you could review the damage if you felt it necessary. I did take pictures and have them on my telephone if you think that would be needed. I, also, did my best to clean the brown growth spots that you cited. The spots on the left side of the house looking from the street have been cleaned. As I stated in the previously letter, the remaining spots are actually worn paint areas and not brown growth. The spots on the other side of the house have been substantially cleaned. There are still some small areas that need to be cleaned again since the spot did not come out entirely the first time. However, I had to stop yesterday as the rains came. I will try my best again to get the rest of the spots off as soon as possible. As with the other side of the house, some of the spots are just worn paint areas. The screened in pool area was not worked on pending your response to my prior letter. Please let me know if you will require me to paint my house and fix the screen area. My prior letter discussed why I had put off doing those tasks previously. I will abide by whatever decision you decide to make. I just need to know what that decision is. I, also, would like to know whether I will still be on the agenda for the July 23, 2013 meeting. If I am, I will attend the meeting. I was originally notified of this violation via a certified letter dated March 5, 2013. I did not take possession of the letter until March 8, 2013 (I believe that was the date). Upon receiving the original "Notice of Code Violation", I immediately fixed the fence on Saturday March 9, 2013. I have continued to monitor the fence's condition ever since receiving that notice. It has remained fixed ever since. That was why I was confused when I received this new notice. I immediately looked at the fence and saw that a few planks of the gate were, in fact, down. This was not the case before I left for the July 4th weekend. I checked it before I left. As I have written you before,the cause of this continued issue is simple. My fence is an older variety wooden fence. My neighbor's sprinklers continue to spray my entire fence causing it to age faster and get softer quicker. I realize that is no excuse for me not to maintain the fence. I just wanted you to be aware of its cause. The fence will be fixed again this weekend. Hopefully to your satisfaction. The second issue raised on the original notice related to "brown growth on exterior walls". At that time I called twice and left you messages stating I was unsure where you were talking about related to this brown growth. I asked for a return call so you could tell me where I needed to fix the issue. I never received a return call from you. I subsequently determined where I thought you had the issue. I immediately cleaned that area as best I could. The resulting stain is actually more from worn paint then from brown growth. Doing another inspection upon receiving this new notice I discovered another area on the other side of the house. I plan on cleaning that area this weekend. I am not sure if that will suffice or not. I assume that the same issue will result when I clean that area. The result will be worn spots in the paint rather than brown growth. I have discussed selling my house with a realtor. They informed me to not paint the house unless you required it. They recommended selling it as is since the new person may want to paint it another color and I would not get my cost back out of it. If my cleaning does not suffice in this, I would consider painting the house to avoid any future issues. The final issue raised was related to the screen on my pool area. During the prior two telephone messages I left you that were not responded to, I asked if I now needed to fix the screen enclosure since the fence gate was fixed. I stated I would wait to hear your response before having it fixed. There were only two screen panels that were broken and they were both on the top. There was no danger of anybody wondering into my yard (which is fenced anyway) and falling in. The sides were all in good condition. In addition, the enclosure cannot be seen from any location but my back yard. It is not an eyesore since nobody from any direction can see it based on the location of trees in my backyard. Since I had not heard from you since my March 12, 2013 call, I assumed not fixing it was fine until I received this new notice four months later. Again,the realtor informed me not to fix the screen unless you require it since we were going to sell the house as is. As stated above, I would consider fixing it if you require me to do so. I have attached copies of the prior correspondence I sent you on May 18, 2013. It related to others matters I wanted to bring to your attention. Again, it is two months later and I have not received a response to that correspondence either. I thought I wrote a letter back in March 2013 in response to the original notice you sent but I cannot find a copy of that. I apologize for not having a copy of that for you. I plan on fixing the fence this weekend. I also plan on trying to clean the brown growth this weekend as well. I will again wait to hear from you related to having fixing the screen. If I must fix the screen, I will need some time to get some quotes and to get somebody out here to fix it. It may not be done by the July 22, 2013 deadline but I will try to get it done as soon after that as I can. As I stated in my May 18, 2013 letter, I always try to cooperate on any of these issues that may arise. I try to rectify the matters as soon as I can. I try to stay to myself and not bother anybody but I seem to have been singled out since my new neighbors (whose ex- husband is ironically one you high ranking police officers)moved in a year or two back. I don't think that is a coincidence! I will attend the July 23, 2013 meeting, if required, to have this matter resolved. I hope what I have stated in this letter will resolve this issue so that it will not be required to attend the Commission meeting. I am notifying you about the remedy to this "notice of violation and remedy of public nuisance". I am a little confused on receiving a"violation" since I have not previously received a"warning"related to this same matter. In addition,the wording of"nuisance" seems odd since it is in my fenced back yard and only I can see that the grass may be a little long unless somebody peers over my fence. Your letter seems to indicate that it was prepared on Tuesday, May 14, 2013. I was out of town for several days. Upon arriving home I mowed both the front and the back yard on Wednesday May 15, 2013. This was done before ever receiving this "notice" from you. I can supply pictures if needed but a re-review by you will show that this has been done. I am not sure if this is the case or not, but it seems that my house has been singled out over the last year or two. I have received several "warnings"regarding various things. I have heard from some neighbors that WSPD personnel sit outside my house for long periods of time. I, also, have had patrol (not sure if this is the correct terminology so I apologize if not) officers (not code enforcement personnel) come to my door. I served several years on the Casselberry Civil Service Board and I don't think that is a usual practice. Ironically, this started about the same time my new neighbors moved in next door. Her ex-husband happens to be in the WSPD. I don't know if that is coincidence or not but most of the items that have been cited as violations are on that side of my house. Related to that, and I am not sure if this is a code enforcement topic or not but I will ask anyway, I have a little complaint about my new neighbors to my left(looking from the street). First, they connected their new fence into mine without ever asking. I think the fence is on my property and permission would have to be given for them to do that. I would have given that permission without a question had they asked. They also planted new bushes along our boundary. Those plants seem very close to actually being on my property. I am not totally sure however. In addition, the sprinklers used to water those plants spray onto my property and fence. The fence, which is a little older already, becomes wet and more worn. I never said anything since I don't want to be a nuisance. However, now it appears that they have sprayed some type of weed killer along our boundary. The problem with that is that the killed area has extended into my yard by a good bit. There is a long strip of dead yard extended the length of the property line. I normally would not say anything but since my house has seems to be under scrutiny for what I feel are some minor things, I would appreciate it if you would look at the items I mentioned above when you come out to look at my"notice"re-review.
