I received a complaint stating that the pool enclosure is
falling apart and the fence at Northern Way is falling
down. I observed the screen enclosure has several areas of
screen that have fallen and along Northern Way there is
section of fence that is falling.
• Notice of Violation was mailed on March 5, 2013 . The
USPS website shows the notice delivered on March 11 ,
2013 .
• I received a voicemail message from the property owner
who advised me that he was not going to make the repairs.

• This case was set to be presented at the April Code Board
hearing; Mr. Krack asked for an extension due to his job
circumstances. The case was pulled from the agenda.
• Inspection on July 15, 2013 shows that there was
improvements on other violations that were noted.
• On July 22, 2013, I received a message from the owner
wanting to know if the corrections were sufficient. I left
him a message that they were not.

• I received multiple letters from Mr. Krack in regards to
having this case held until October. I attempted to call Mr.
Krack back and left him a message to return my call in
regards to this case.
• On Sept 15, 201'3, Mr. Krack mailed another letter
requesting that the case not be heard at the September
meeting due to him being out of town. He also mailed in
pictures. The letter and pictures are submitted into
evidence.

• I called Mr. Krack and received his voicemail several
times. I left a message indicating this case would be
presented and the procedure for attendance.
• Mr. Krack indicated he has repaired the fence and in the
front. The fence was replaced the section of fence that has
been observed several times has been secured.

• Notice of Hearing was mailed on August 23, 2013, and
was signed for on August' 31 , 2013 by Mr. Krack. Notice
was also posted at City Hall and at the property.

The original violation with the fence. This has recently been
corrected.

In regards to this case, I am recommending the owner be found
in violation and given until November 15, 2013 to correct the
violations. If found in non-compliance a fine, of $ 100.00 a day
be imposed retroactive to September 24, 2013 .
