REQUEST:
The Community Development Department is requesting that the City Commission establish
a date and time for a workshop to discuss the City's process for considering lot split requests.
SYNOPSIS:
Sections 9-10 and 9-11 of the City's Code of Ordinances detail the City's process and related
criteria for consideration of the lot split request. The purpose of the workshop is to discuss
the background/history of this issue and whether or not modifications to these sections of
the Code should be made; specifically, the requirement that all lots that are the result of a lot
split be equal to or greater than the average size of all lots within a one thousand (1,000)
foot radius around the outer perimeter of the proposed lots and have the same city zoning
designation as the proposed lots.
CONSIDERATIONS:
Ordinance 2005-23, approved on September 12, 2005, added language to the Code of
Ordinances to allow lot splits as an option to platting for the creation of exactly one (1)
additional lot or tract of land subject to certain conditions.
Ordinance 2006-11 was approved on September 11, 2006 and added the language requiring
the proposed lot be equal to or greater than the average size of all lots within a one thousand
(1,000) foot radius around the outer perimeter of the proposed lots and have the same city
zoning designation as the proposed lots.
On March 19, 2013, the City received a request for a lot split in the Ranchlands area of the
City. the request did not meet the requirements of Section 9-10 of the City's Code of

Ordinances related to the average size of all lots within a one thousand (1,000) foot radius.
Over the past few years, the City has received several lot split requests that proposed lots
that were larger than the minimum zoning requirement and larger than abutting lots, but did
not meet the requirements of Section 9-10 of the Code.
The latest applicant, from March 2013, made a request to amend Section 9-10 of the Code
of Ordinances to allow lot splits where the resultant lot meets the minimum lot size
required by the zoning district and lot the average size of the lots within a one thousand
(1,000) foot radius.
FISCAL IMPACT:
There is no direct fiscal impact associated with this request.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
The Community Development Department requests that the City Commission establish a
date and time during the month of October 2013, or later, for a workshop to discuss the
City's process for considering lot split requests.
