Roll Call: Chairperson Laura-Leigh Wood, present Vice Chairperson Hugh Fisher, present Board Member Laurie Bates Calhoun, absent [Excused] Board Member Carole Giltz, present Board Member Marvin Kelly, present Board Member Gregg Roero, absent [Excused] Board Member Jim Wentz, absent [Excused] Assistant City Attorney Kate Latorre, present Assistant to the City Clerk Sean Beaudet, present In reference to the absent Code Enforcement Board Members, Chairperson Wood stated "Please let the Record show that Board Member Calhoun, Board Member Roero, and Board Member Wentz were all `Excused' this evening." A moment of silence was held for the victims in the recent Boston Marathon incident, followed by the Pledge of Allegiance. When asked for Agenda Changes, Assistant to the City Clerk Sean Beaudet noted that "PUBLIC HEARINGS - NON-COMPLIANCE 503.1" would not be heard this evening. Office Of The City Attorney C=1.41 ine=4 Requesting The Code Enforcement Board Discuss and Re-Adopt The City Of Winter Springs' Code Enforcement Board Policy And Procedures Manual For The Current Year With Any Amendments, As Applicable. Assistant City Attorney Kate Latorre addressed the Code Enforcement Board and offered a few revisions to the "City of Winter Springs, Florida Code Enfocrcement Board Policy and Procedures Manual'. To begin, in reference to 'VIII. ANNUAL ORGANIZATIONAL MEETING', Assistant City Attorney Latorre mentioned C., which included "Eliminating the 'Qualification of Posting', which is strictly a technical approval that this Board does every year. It is not required by Statute. Also, the 'Qualification of Code Enforcement Officers' is not technically required." Assistant City Attorney Latorre commented, "I would suggest that you can eliminate those two (2) things from your handbook all together; if there are no objections we'll make a note of that, and then at the end of this discussion we can make a Motion to approve the manual as revised." With further comments, Vice Chairperson Hugh Fisher remarked about the "Qualification of the Winter Springs Code Enforcement Officers" in D., and said, "What I would suggest is that during the regular reporting, as Code Enforcement Officers or Inspectors or Personnel achieve higher levels, that they simply report that as they achieve them;just so that we will know." Chairperson Wood and Assistant City Attorney Latorre suggested that if new people are brought on to the staff, they introduce them to you and let you know their qualifications but not make it a formality at every "Annual Organizational Meeting". Chairerson Wood concurred. Assistant City Attorney Latorre again referred to the "Policy and Procedures Manual" and stated that the "Annual Organizational Meeting" must occur every January and suggested"The manual be revised to say 'The Organizational Meeting' where you elect a Chair and a Vice Chair happen the first meeting of the year when there is board business". Chairerson Wood stated, "Absolutely." Others agreed. Assistant City Attorney Latorre added, "So, if there is no objection to that, we can make that revision as well." No objections were voiced. Related to 'IX. HEARINGS', Assistant City Attorney Latorre pointed, out "There are some real technical formalities about the Chairperson asking the Respondent, 'Do you contest these charges' and if you contest these charges then this happens and if you don't contest these charges, then that happens' -we don't really follow that process either." Chairerson Wood added, "I don't have to ask it though?" Assistant City Attorney Latorre agreed and added, "I would suggest that that be revised." iser Next, Assistant City Attorney Latorre referenced the bottom of page 7, B. `Hearing Procedures', `Objections' and pointed out that "If Evidence is ever objected to, it has to be on the basis of whether the Evidence is relevant." Further comments. Continuing, Assistant City Attorney Latorre remarked, Those are the substantive things that I would recommend removing and revising in the manual. Other things are very minor, typographical error changes, the date of the meeting, we're going to reflect the new date of the meeting, the new tine of the meeting,things like that." Inspector Christi Flannigan, Code Enforcement Division, Police Department additionally suggested, under IX. Hearings, 1., where it is stated, "Request the Clerk of the Board to read the Case Information', that the Code Enforcement Officer would read that information. Assistant City Attorney Latorre agreed and stated, "To reflect how we're actually conducting the Hearings now." Summarizing, Assistant City Attorney Latorre stated, "You can make a Motion to adopt it as revised; and then we will bring it back to you; and provide you with a new copy, as soon as it is updated. Or if you would like to see it come back with the revisions incorporated, we can do that as well." Chairperson Wood said to Assistant City Attorney Latorre, "You are going to be checking it?" Assistant City Attorney Latorre responded, "Yes." Chairperson Wood then stated, "My recommendation would be that we adopt it as revised." Vice Chairperson Fisher noted, "I am okay with that." No objections were noted. Continuing, Vice Chairperson Fisher mentioned previous comments on the use of electronic devices to which Assistant City Attorney Latorre remarked, "You are referring to use of the devices to seek further information for our Hearings?" Assistant City Attorney Latorre added, "It is mentioned in the manual very generally. It says that the Board shall only consider Evidence presented at the Hearing. We could elaborate on that if the Board so desired." Vice Chairperson Fisher suggested, "Maybe what we just need to do is do that in the Orientation for the Board Members. Emphasize that at the time of their Orientation." Assistant to the City Clerk Beaudet replied "Absolutely. We could definitely go over that. I will make note of that." No objections were voiced. Maintenance Of Fences Or Walls Date Of Service: April 3, 2013 Inspector: Christi Flannigan Inspector Flannigan presented the Case and submitted into Evidence 'WS-l', which is the CD (Compact Disc) all of all the presentations being presented tonight." With further comments, Inspector Flannigan remarked, "I'd like to present into Evidence `WS-2' which is the Notice of Code Violation envelope that was returned; `WS-3' is the print-out from the United States Postal Service showing that the Notice of Code Violation was unclaimed; `WS-4' is the Affidavit of Posting; `WS-5' is the Certified Mail Receipt for the Code Board; `WS-6' is the Affidavit of Posting for Code Board; `WS-7' is the United States Postal Service for Code Board. Myself and other officers were dispatched out to the address in reference to an aggressive dog. The dog was barking at people who were walking on the sidewalk. We've been over there several times in regards to this particular issue. We've addressed the dog issue with Citations, but the fence has not been addressed by the owner. CITY OF WINTER SPRINGS,FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING-APRIL 23,2013 rEWN PAGE 7OF 13 One of the complaints on the Violation was that the dog was out and the gate was open. That has happened continually. It's consistently left open. The gate would not close and secure when we were at the property for a couple times. We had to use a stake out of my truck and a bungee cord to secure the gate to close it so the dog couldn't get out any Nier further. The fence to the right of the corner of the gate, whenever we started to close it, it fell down; we had to try and put it back up. The Notice of Violation was mailed on March 4th, 2013 and was posted at the property on March 13th, 2013. There has been no contact with the owner of the property. Notice of Hearing was - mailed on April 4th, (2013) and was also Posted at the property and City Hall on April 2°d, (2013). The Untied States Postal Service shows that the Notice of Hearing — they had left a Notice on April 5th, (2013). There has been contact other than the Hearing for last month with Junk and Debris at this property, where he advised that he was going to put up a new fence. That has not happened." Photographs were shown of the property from `WS-1'. Discussion. Inspector Flannigan then stated, "In regards to this Case, I am recommending that the Owner be given until May 10th, (2013) to correct the fence and if in Non-Compliance, a Fine of a hundred dollars ($100.00) a day be imposed — a hundred dollars ($100.00) because of the aggressive dog, retroactive to April 23"d, 2013." Discussion ensued on the dog getting loose by the fence being in disrepair; Seminole County Animal Control has also responded to the property; and the breeds of the dogs being pit-bull mixes. Note: The Respondent was not present. "I MOVE TO FIND THE RESPONDENT, BEN BLACKMAN, IN VIOLATION OF THE CITY CODE AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL MAY 10TH, 2013 TO CORRECT THE VIOLATION. Date Of Service: April 4, 2013 Inspector: Christi Flannigan Related to this Case, Inspector Flannigan offered into Evidence "WS-2, which is the United States Postal Service print-out for the Notice of Violation; `WS-3' is the United States Postal [Service] print-out for Code Board Hearing; `WS-4' is the Affidavit of Posting for Code Board. On March 5th, 2013 I observed that the pool enclosure had fallen screens. There has been a portion of the patio that has unprotected wood. Notice of Violation was mailed on March 1301, 2013 and was delivered on March 16th from the United States Postal Service website. There has been no contact with the Owner of Record. Notice of Hearing was mailed on April zith, 2013. According to United States Postal Service website it was delivered April 8th, 2013. The Notice was also Posted at the property and at City Hall on April 2"d, 2013." Photographs of the Violations were shown from previously submitted 'WS-1'. Further comments. Continuing, Inspector Flannigan stated, "In regards to this Case, I am recommending the Owner be given until May 15th, 2013 to correct the Violations. If found in Non- Compliance, a Fine of a hundred dollars ($100.00) a day be imposed retroactive to April 23111, 2013." Assistant to the City Clerk Beaudet swore in Mr. Glen Peter Ahlers. Mr. Glen Peter Ahlers, 1100 Gator Lane, Winter Springs, Florida: noted he was residing at the property as part of a lease to buy transaction; and said that the landlord was not making the mortgage payments and the bank is foreclosing on the property; and inquired as to whom was actually receiving the Code Violation Notices. Assistant City Attorney Latorre remarked, "Because it's Titled under the LLC (Limited Liability Corporation) name, the LLC (Limited Liability Corporation) gets the Notices." Chairperson Wood said, "You are not the Owner, but we appreciate you being here, very much so." Further discussion. Correct, is that what you are asking the owner do?" Inspector Flannigan answered, "Correct. If that's part of the porch, then it still has got to have some kind of protective treatment." Discussion. Obstructing Streets And Sidewalks; Permit Required Date Of Service: April 4, 2013 Inspector: Christi Flannigan Presenting the Case and entering into Evidence, Inspector Flannigan provided "`WS-2, which is the Postal Service print-out for the Notice of Violation; `WS-3' is the United States Postal Service print-out for the Code Board Hearing; `WS-4' is the Affidavit of Posting." CITY OF WINTER SPRINGS,FLORIDA MINUTES CODE ENFORCEMENT BOARD �7 REGULAR MEETING-APRIL 23,2013 PAGE 10 OF 13 Continuing, Inspector Flannigan stated, "On March 18th, 2013 I observed a basketball 4 hoop in the right-of-way; and that the basketball hoop was tethered to a concrete light � ••i pole. The neighbor's address was used originally due to the location. The Notice itself was Posted on the basketball hoop itself. This is not the only basketball hoop in the area that is tethered. There were other violations written in that area. Notice of Violation was mailed on March 25th, (2013). The United States Postal Service shows that it was delivered on March 28th, 2013. Captain (Chris) Deisler spoke with the Owner and advised that he requested to allow the Code (Enforcement) Board to rule on this Violation." Inspector Flannigan noted that Captain Deisler had referenced Section 17-28. from the City's Code of Ordinances and suggested this be adhered to with regard to right-of-ways. Furthermore, Inspector Flannigan added, "Notice of Hearing was mailed on April 4th, 2013. The United States Postal Service website shows that it was delivered April 5th, (2013). The Notice was Posted at the property and at City Hall on April 3`a, (2013). The Respondent requested for this Case to be heard, although he's not present." Chairperson Wood added, "Please let the Record reflect the Respondent was not present." Photographs of the Violations were shown and discussion ensued on the location of the basketball hoop being in the right-of-way; safety concerns; and that there are no restrictions to children playing in the street. Discussion. "I MOVE TO FIND THE RESPONDENT, SARAH AND EDWARD MORRISSEY, IN VIOLATION OF THE CITY CODE AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL MAY 3RD, (2013) TO CORRECT THE VIOLATION. (e) Stagnant Pool Sec. 6-195. Maintenance Of Fences Or Walls IPMC 304.13 Window, Skylight And Door Frames. Date of Service: April 9, 2013 Inspector: Christi Flannigan Inspector Flannigan presented the Case and submitted into Evidence "`WS-2, the United States Postal Service — Notice of Code Violation print-out; `WS-3' is the Affidavit of Posting for the Notice of Code Violation; `WS-4' is the Affidavit of Posting for Code Board; `WS-5' is the United States Postal Service print-out for the Notice of Code Board." With further comments, Inspector Flannigan stated, "On January 23`d, 2013 I received a complaint from the neighbors in regards to a dog. While I was in contact, I observed a stagnant pool, broken fence slats and a broken window on the front of the house. Notice of Violation was mailed January 31St, 2013. It was delivered on February 7th, 2013. Owner of Record, Clayton (Nott), called on February 11th, 2013. He advised that he had a company working on the pool and he was getting the window fixed. There has been no other contact with the Owner. At the time, he provided me an address of 160 West Bahama (Road) for himself and advised that his ex-wife, Laletta, is on Galloway Drive. There has been no other contact since then. Notice of Hearing was mailed on April 9th, 2013 and it was also Posted at the residence and City Hall on April 9th , (2013). United States Postal Service website shows it was delivered on April 13th, (2013) The second Notice departed the sort facility on April 13th, (2013). Just for the Record, Notice was sent to the address of record and also the Bahama (Road) address that was given. The neighbors complained of the fence in the rear of the yard and the sides that still have broken slats. The stagnant pool has been observed by several Officers and myself— we did not take any photos of the stagnant pool." Chairperson Wood then asked, "Why didn't you take pictures of the stagnant pool?" Answering, Inspector Flannigan stated, "Whenever I was there I couldn't get a clear shot because of some of the junk and debris in the back of their yard." Responding, Chairperson Wood noted, "Okay that is fine, you are testifying. Could you see the bottom of the pool?" To which Inspector Flannigan answered, "The bottom of the pool? Inspector Flannigan also noted that the property was =. occupied by renters; and bags of trash had been left in the yard and could be viewed from `l the street. Inspector Flannigan then stated, "In regards to this Case, I am recommending that the Owner be given until May 15th, (2013). If found in Non-Compliance, a Fine of a hundred fifty dollars ($150.00) a day be filed retroactive to April 13th, (2013)." Further comments. Vice Chairperson Fisher asked, "Would you consider that pool is secure?" Inspector Flannigan replied"No. Not across the back, I would not." Further discussion. Tape 1/Side B Vice Chairperson Fisher commented on increasing the Fine due to a stagnant pool and the accessibility. Other Members of the Board were in full agreement. Note: The Respondent was not present. "I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL MAY 15TH, (2013) TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT FAILS TO COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF TWO HUNDRED FIFTY DOLLARS ($250.00) FOR THE FIRST DAY AND TWO HUNDRED AND FIFTY DOLLARS ($250.00) FOR EACH DAY THE VIOLATION CONTINUES THEREAFTER SHALL BE IMPOSED RETROACTIVE TO APRIL 23RD, (2013). FURTHER, THE VIOLATIONS CONSTITUTE A SERIOUS THREAT TO THE PUBLIC HEALTH, SAFETY, AND WELFARE, AND IN THE EVENT THE RESPONDENT DOES NOT CORRECT THE VIOLATION BY THE DATE SET IN THIS ORDER, THE CODE INSPECTOR SHALL BE NOTIFIED AND APPROPRIATE ACTION SHALL BE TAKEN BY THE CITY CONSISTENT WITH CHAPTER 162, FLORIDA STATUTES, TO BRING THE PROPERTY INTO COMPLIANCE."
