HomeMy WebLinkAboutCode ChangesCaptain Glenn Tolleson, Commander of Code Enforcement, WSPD gave a presentation to the THOA Board and thirteen hardy residents who braved frigid temperatures at our January Membership meeting. He outlined the current code changes that have been approved by the City Commission during 2009 and 2010. 2009 -02 — Regulate Parking of Vehicles on Front Yards — The parking of any vehicle within the front yard of any residential lot shall be prohibited unless said vehicle is parked on a driveway, or designated parking area. A maximum of one DPA (designated parking area) shall be allowed per residence within the front or side yard to accommodate at least 1 vehicle. Materials that can be used include concrete, etc. 2009 -03 — Regulate of Temporary Signs — On residential zoned property no temporary sign may exceed 6 square feet and the total number posted shall not exceed four signs. 2009 -04 — Minimum Setback Requirements Zero Lot line — On residential zoned zero lot line property Front yard not less than 25 feet, Rear yards were changed from 10 feet to 3 feet, side yards not less than 5 feet on one side. 2009 -07 — Regulation of Commercial Vehicles — Residents are allowed one small commercial vehicle. The change to the ordinance is the sections that were removed and they are: Lettering, storage racks, behind the front setback, behind 6 foot fence, and covering of the lettering. Vehicles may not be semi - trailers or semi - trailer truck trailers and may not be construction - related equipment such as a backhoe, front end loader, utility tractor, etc. Ordinance includes length and weight restrictions too. 2009 -11— Regulations and Operations for Golf Carts — On any city street, the driver must possess a valid driver's license and the cart must be insured. Golf carts may be operated on roadways where the posted speed limit is 30 mph or less, but shall not exceed (20) mph. Carts may not be operated on any street with posted speed limits higher than 30 mph. NOTE: Registration and inspection of golf carts will be held again this year, date to be determined. 2010 -04 — Amending Criteria for Tree Removal — On residential lots a permit may be issued for trees that prohibit or have the effect of prohibiting the installation or operation of a solar collector, clothesline, or other energy device based on a renewable resource. Additionally, the applicant must submit manufacturer's guidance for amount of sunlight required for operation and other evidence for removal. Must use the device for 3 years or replace the trees or pay to the tree bank replacement fees. 2010 -08 — Amending Criteria for Accessory Dwelling Units (ADU) — On residential lots a permit may be issued for one ADU. Shall have a maximum of 800 sq ft or 30% of the air conditioned area of the principal residence, whichever is less. Owner of property must reside either in the principal residence or in the accessory dwelling unit; aesthetic review for compatibility, Public hearing with notice sent to all property owners within 150 ft, If HOA prohibits will not be approved. The ADU shall not be used for commercial purposes. A minimum lot size of 6,600 square feet is required and the principal residence shall be a minimum of 1,350 square feet of air conditioned area. 2010 -11 — Amending Irrigation Rules — Irrigation rules change with change to Daylight savings time. From the second Sunday in March, (311312011) through the first Sunday in November (111612011), watering is permitted on Wednesdays and Saturdays for residences with odd numbered addresses, and Thursdays and Sundays for even numbered residences. When Daylight savings time ends on November 7, 2011 through March 10, 2012 irrigation is only permitted on Saturdays for odd number addresses and only on Sundays for even numbered properties. Through March 12th, 2011, properties should only be irrigating one day per week. Properties served by reclaimed water may irrigate two days all year. 2010 -13 — Red Light Cameras — Authorizes the use of traffic infraction detectors to promote compliance with red light directives, all in accordance with general law, including Chapter 2010 -80, Laws of Florida (2010) ( the "Mark Wandall Traffic Safety Act "). The purpose is to further reduce the running of red lights; to further enhance the safety of every citizen and traveler in Winter Springs, 2010 -22 Pain Clinics, Gambling internet Cafe — The City established a moratorium for 270 days to provide the City with an opportunity to research and study various regulatory options.
