REQUEST:
The Community Development Department, Arbor Division, asks that the City Commission
approve the request of Lisa Shuman to remove two (2) Specimen oak trees from her
property at 300 Panama Road. The resident is concerned with the proximity of tree roots to
the home and driveway.
SYNOPSIS:
Property owner Lisa Shuman of 300 Panama Road has applied for a tree removal permit
(#201300821) to remove (1) 25" Specimen oak tree and (1) 27" Specimen oak tree, both
having caused significant damage to the driveway and will potentially cause damage to the
foundation of her home. Section 5-8 (b) of the Arbor Ordinance provides that a specimen
tree shall not be removed except for extraordinary circumstances, hardships, and only by
approval of the City Commission.
CONSIDERATIONS:
Based on an assessment of the trees made by the City Arborist and Urban Beautification
Manager on April 1, 2013, and review of pictures and other pertinent information by Staff,
approval of the request to remove these trees is recommended. One of the specimen trees is
within 10' of the house and has significantly lifted the driveway slab so that it is no longer
level with the bottom of the garage door. The other specimen tree is within 1' of the
driveway and has caused cracking and lifting of the concrete. Both trees have the potential
of causing damage to the foundation of Ms. Shuman's home.
FISCAL IMPACT:
If this request is approved, the applicant will pay a $35 arbor permit fee to the Arbor Fund

(110) and be required to install eight (8) Replacement Credits or pay a total of $2,000 into
the tree bank.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and
the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City’s Website, LaserFiche, and the City’s
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends that the City Commission approve the request of Lisa Shuman to remove
two (2) Specimen oak trees from her property at 300 Panama Road. The resident is
concerned with the proximity of tree roots to the home and there is significant damage to
the driveway. Staff finds the existing damage to the driveway and potential of damage to the
structure of the home as an extraordinary circumstance or hardship as referenced in Section
5-8(b) of the Arbor Ordinance.
