REQUEST:
The Community Development Department, Arbor Division, asks that the City Commission
approve the request of Greg Pearlman to remove one (1) specimen Live oak from his
property at 503 Pleasant Grove Drive. The resident is concerned with the proximity of the
tree to his home and damage the tree has caused to his driveway.
SYNOPSIS:
A 25" specimen Live oak has significantly lifted the driveway at 503 Pleasant Grove Drive.
The tree is within 10 feet of the driveway and will likely cause further damage as it grows.
Mr. Pearlman is also concerned that the tree may cause damage to the house as
well. Section 5-8(b) of the Arbor Ordinance provides that a specimen tree shall not be
removed except for extraordinary circumstances, hardships, and only by approval of the
City Commission.
CONSIDERATIONS:
Based on an assessment of the tree made by the City Arborist on February 21st, 2013 and
review of pictures and other pertinent information by Staff, approval of the request to
remove this tree is recommended. The specimen live oak measures 25" in diameter and has
caused significant damage to the driveway.
During the same tree assessment it was noted that the tree had an irregular root mass located
at it's base. If the tree were to remain, Staff feels that it has significant potential to cause
further damage to the driveway and to damage the building structure. The option of root
pruning was discussed and Staff concluded that the pruning process would further reduce
the viability of the tree and cause irreparable damage with the potential of failure during a

high wind event.
FISCAL IMPACT:
If this request is approved, the applicant will pay a $25 arbor permit fee to the Arbor Fund
(I 10) and be required to install five (5) Replacement Credits or pay a total of $1,250 into
the tree bank.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends that the City Commission approve the request of Mr. Pearlman to remove
one (1) specimen Live oak tree from his residence at 503 Pleasant Grove Drive. Staff is
recommending approval due to the damage caused to the driveway and the trees potential to
cause further damage. Staff finds that this qualifies as an extraordinary circumstance or
hardship as referenced in Section 5-8(b) of the Arbor Ordinance.
