HomeMy WebLinkAbout2013 03 11 Consent 201 Specimen Tree Removal 753 Andover Circle COMMISSION AGENDA Informational Consent X ITEM 201 public Hearings g Regular March 11, 2013 KS RS Regular Meeting City Manager Department REQUEST: The Community Development Department, Arbor Division, asks that the City Commission approve the request of Jan Adams to remove one (1) Specimen Oak tree from the property at 753 Andover Circle. The resident is concerned with the proximity of tree roots to the home and driveway. SYNOPSIS: Property owner Jan Adams of 753 Andover Circle has applied for a tree removal permit (9201300373) to remove a 25" Specimen Oak tree that has caused significant damage to the driveway and will potentially cause damage to the foundation of the dwelling. Section 5-8 (b) of the Arbor Ordinance provides that a specimen tree shall not be removed except for extraordinary circumstances, hardships, and only by approval of the City Commission. CONSIDERATIONS: Based on an assessment of the tree made by the Urban Beautification Manger on February 14, 2013, and review of pictures and other pertinent information by Staff, approval of the request to remove this tree is recommended. There are several large roots growing in such a manner as to uplift and crack the driveway while having the probability in the near future of causing damage to the foundation of the single family dwelling located within 15' of the tree. FISCAL IMPACT: If this request is approved, the applicant will pay a $25 arbor permit fee to the Arbor Fund (I 10) and be required to install five (5) Replacement Credits or pay a total of$1,250 into the tree bank. Consent 201 PAGE 1 OF 2- March 11, 2013 COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission approve the request of Jan Adams to remove one (1) Specimen Oak tree from her property at 753 Andover Circle. The resident is concerned with the proximity of tree roots to the home and there is significant damage to the driveway. Staff finds that this qualifies as an extraordinary circumstance or hardship as referenced in Section 5-8(b) of the Arbor Ordinance.
