REQUEST:
City Manager requesting the Commission approve Resolution 2012 -44, designating
Monday, December 24, 2012 as a City Holiday.
SYNOPSIS:
This agenda item is presented for the Commission's consideration of granting an additional
holiday for City employees, for 2012 only, to be observed on Christmas Eve (day),
December 24, 2012.
CONSIDERATIONS:
In accordance with current City Personnel Polices, Christmas Day is an approved City
Holiday. This year, Christmas Day falls on a Tuesday.
Relatedly, the preceding Monday, in accordance with current policy, is not an approved
City holiday. However, the City Manager is requesting the Commission consider, for 2012
only, the approval of Monday December 24, 2012 as a City Holiday for our employees.
By way of historical information, in 2008, Christmas fell on a Thursday. At that time, the
Commission approved, via Resolution, the designation of Friday, December 26, 2008 as a
City Holiday.
Granting this additional holiday, or any change to the current Personnel Policy, would
require Commission approval via resolution. Accordingly, this issue, and the attached
Resolution, are being presented to the Commission for its consideration.

FISCAL IMPACT:
A decision to designate December 24, 2012 as a City Holiday would have no additional
personnel budget impact on the City for the majority of employees. However, there would
be a resultant personnel incremental cost impact relative to "shift" employees, due mainly to
minimum - manning scheduling and associated necessary coverage for Public Safety
personnel.
Estimated additional incremental costs for all Departments for this purpose are
approximately $10,000 and would be proactively absorbed by the Departments within
current FY 2013 budget allocations._
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
The City Manager recommends the City Commission approve Resolution 2012 -44,
designating Monday, December 24, 2012 as a City Holiday.

RESOLUTION NO. 2012-44
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY,
FLORIDA, DESIGNATING DECEMBER 24, 2012 AS A CITY
HOLIDAY; PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, the City's current Personnel Policy does not recognize December 24th as a City
holiday; and
WHEREAS, the City Commission desires to approve December 24, 2012 a City holiday;
and
WHEREAS, City Commission deems that this Resolution is in the best interests of the
public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT:
Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and
correct and are hereby fully incorporated herein by reference.
Section 2. Designating December 24, 2012 as a City Holiday. The City Commission
of the City of Winter Springs, Florida hereby designates December 24, 2012 a City holiday.
Section 3. Severability. If any section, subsection, sentence, clause, phrase, word, or
portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent
jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate,
distinct, and independent provision, and such holding shall not affect the validity of the remaining
portions of this Resolution.
Section 4. Repeal of Prior Inconsistent Resolutions All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 5. Effective Date This Resolution shall become effective immediately upon

ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular
meeting assembled on this 10th day of December, 2012.
