REQUEST:
The Public Works Department requests the City Commission approve the Amberly plat and
authorize the plat to be recorded.
SYNOPSIS:
Amberly is a 36 -unit single - family residential subdivision located on Dovera Drive, north of
Red Bug Lake Road, within the Oviedo Marketplace Planned Unit Development. This
agenda item is for the approval of the plat including the dedication of public streets to the
City.

Amberly is a 36 -unit all single - family subdivision by KB Home located on Dovera Drive,
north of Red Bug Lake Road, within the Oviedo Marketplace Planned Unit Development
(PUD). The property subject to this plat is referred to as Parcel 14B.
Final Engineering for Amberly was approved by the City Commission at the July 23, 2012
Commission meeting. Sitework construction commenced in August 2012 and the

construction of the first model unit is expected to begin within the next 60 days.
The land subject to this plat consists of a total of 45.69 acres, consisting of the following
components:
• 36 single - family residential unit Amberly subdivision by KB Home (approx. 8.7
acres)
• Conservation Areas to the west (Tract G) and south (Tract H) of the residential
subdivision that will be owned and maintained by the Viera Company
• Future Development area south of the residential subdivision owned by the Viera
Company
The Amberly plat includes public right -of -way dedications within the 36 single - family unit
subdivision, common area tracts to be owned by the Homeowner's Association, and
easements for items such as drainage, utilities, open space, and sidewalks. All streets
in Amberly are public and will be dedicated to the City as rights -of -way.
One condition of the City Commission's approval of the Final Engineering plans for
Amberly was a requirement for the Dovera Community Development District (CDD) to
grant the City an easement for emergency access and maintenance of the existing
stormwater system on the CDD property, which is not subject to this plat. This easement
has been recorded.
Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various
sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the
plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the
land to be subdivided, by the professional surveyor and mapper of record, and by the
independent professional surveyor and mapper who reviews the plat for consistency with
Chapter 177, Florida Statutes.
Before the plat can be recorded, per Section 9 -76 of the City Code KB Home is required to
provide a bond, letter of credit, or cash deposit in favor of the City in an amount equal to the
construction cost of the site improvements that have not been completed.
City Staff including the City's independent surveyor, Tinklepaugh Surveying Services, have
reviewed the plat and have no outstanding review comments.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations /Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional

City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested

RECOMMENDATION:
Staff recommends the City Commission approve the Amberly plat, subject to provision of
the required bond, letter of credit, or cash deposit, and authorize the City Manager and City
Attorney to prepare and execute any and all applicable documents.
