The Public Works Department requests the City Commission approve the Jesup's Landing
replat and authorize the plat to be recorded, subject to satisfaction of the recommended
conditions of approval.
SYNOPSIS:
Jesup's Landing is a 171 -unit new townhome subdivision by Mattamy Homes located on the
south side of Orange Avenue in the Winter Springs Town Center. This agenda item is for
the approval of the replat including the dedication of public streets to the City. The site was
previously platted by Levitt & Sons in 2006 as a 185 -unit townhome subdivision but the
project was abandoned before sitework was completed.

Jesup's Landing is a 171 -unit new townhome subdivision by Mattamy Homes located
on a 17.16 -acre site on the south side of Orange Avenue in the Winter Springs Town
Center.

. Final Engineering and a Developer's Agreement Modification for the new Mattamy
Homes subdivision were approved by the City Commission at the February 27,
2012 Commission meeting.
. Jesup's Landing was originally approved by the City Commission in June 2005 as a
185 -unit townhome subdivision by Levitt & Sons. A plat for the Levitt & Sons
project was approved by the City Commission in January 2006. Sitework was under
construction in 2006 but not completed, and in 2007 Levitt & Sons abandoned the site
and filed for bankruptcy. Mattamy Homes purchased the property in 2011 from Bank
of America.
. This agenda item is for a replat of the entire Jesup's Landing subdivision, including
public right -of -way dedications, common area tracts to be owned by the
Homeowner's Association, and easements for items such as drainage, utilities, and
sidewalks. All streets in Jesup's Landing (not alleys) are public and will be dedicated
to the City as rights -of -way.
. Approval of a final subdivision plat is regulated by Chapter 9 of the City Code
(various sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes
requires that the plat be fully executed by the owner(s) of record, by all mortgagees
having an interest in the land to be subdivided, by the professional surveyor and
mapper of record, and by the independent professional surveyor and mapper who
reviews the plat for consistency with Chapter 177, Florida Statutes.
. Before the replat can be recorded, Staff must receive a Certified letter from the
platting surveyor that the permanent reference monuments have been set in
accordance with Florida Statutes.
. Before the replat can be recorded, a new letter of credit in a form acceptable to the
City Attorney is required, pursuant to the City Code and the "Stockpile Agreement"
between the City and Mattamy Homes approved by the City Commission at the
September 26, 2011 Commission meeting. The new letter of credit ensures that all
incomplete public infrastructure and improvements required by the final replat and
final engineering plans will be completed in accordance with the City Code. Upon
acceptance of the new letter of credit and recording of the replat, the City will release
the current letter of credit on file. The current letter of credit was required by the
Stockpile Agreement and represented the cost to complete the public site
improvements on the previously recorded plat.
FISCAL IMPACT:
There is no fiscal impact for the City associated with this agenda item. The applicant is
responsible for payment of all review and recording fees. The letter of credit ensures
completion of all public infrastructure.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals

noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations /Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends the City Commission approve the Jesup's Landing replat, subject to the
conditions that the replat not be signed and released for recording until Staff receives: 1) the
certified letter from the platting surveyor that the permanent reference monuments have
been set in accordance with Florida Statutes; and 2) the new letter of credit in a form
acceptable to the City Attorney.

BEGIN at the Southwest corner of JESUP'S LANDING TOWNHOMES, according to
the plat thereof as recorded in Plat Book 69, Pages 34 through 42, Public
Records of Seminole County, Florida; thence run North 18 039'16" East along the
Westerly line of said plat of JESUP'S LANDING TOWNHOMES, for a distance of
746.31 feet to the Northwest corner of said plat of JESUP'S LANDING
TOWNHOMES, and South right of way line of Orange Avenue; thence run South
71"56'39" East along said Northerly line of said plat of JESUP'S LANDING

Notes

2. Except as set forth in Note # 8 below, Tracts A and B are Drainage Retention Areas and are
to be owned and maintained by the Jesup's Landing Homeowners' Association, Inc. There is a
Utility and Drainage Easement over, under and across said Tracts A and B hereby dedicated to
the City of Winter Springs, Florida.
3. Lift Station Easement to be dedicated to and maintained by the City of Winter Springs.
4. Except as set forth in Note # 8 below, Tracts C, D and E are Recreation Areas and are to be
owned and maintained by the Jesup's Landing Homeowners' Association, Inc. There is a Utility and
Drainage Easement over, under and across said Tracts C, D and E hereby dedicated to the
perpetual use of the public and the City of Winter Springs, Florida. There is a public pedestrian
access easement across Tracts D and E hereby dedicated to the perpetual use of the public and
City of Winter Springs, Florida. And Tracts D and E are hereby reserved for signage.
5. Tracts F, G, H, I, J, K and L are Open Space and Alley areas and are to be owned and
maintained by the Jesup's Landing Homeowners' Association, Inc. There is an Ingress /Egress,
Utility and Drainage Easement over, under and across said Tracts F, G, H, I, J, K and L hereby
dedicated to the perpetual use of the public and the City of Winter Springs, Florida. Said tracts
are for the use of all members, their tenants, agents and invitees to access their respective lot.
The driveways and parking areas within said tracts are for the benefit and use of the respective
of owner.
6. This property is subject to an exclusive easement in favor of VBBC Development, LLC pursuant
to that certain Agreement for Exclusive Easement recorded December 16, 2005 in Official Records
Book 6042, page 798, Public Records of Seminole County, Florida; and is subject to a
nonexclusive easement for ingress and egress in favor of VBBC Development, LLC pursuant to that
certain Easement Agreement with Respect to Shared Alley recorded December 16, 2005 in Official
Records Book 60422 page 774, Public Records of Seminole County, Florida. Said easement areas
are shown hereon on pages 4, 5 and 6.
7. All platted utility easements shall also be easements for the construction, installation, and
maintenance for all utilities; provided, however, no such construction, installation, maintenance,
and operation shall interfere with the facilities and services of any other utility. In the event a
utility company damages the facilities of a public utility, it shall be solely responsible for the
damages. This section shall not apply to those easements granted to or obtained by a particular
electric, telephone, gas, or other public utility. Such construction, installation, maintenance, and
operation shall comply with the National Electrical Safety Code as adopted by the Florida Public
Service Commission.
8. The City of Winter Springs shall own and maintain the stormwater infrastructure within the
public right —of —way, within Tracts A, B, and D, and the portion of the pond outfall pipe in Tract
E. The Jesup's Landing Homeowners' Association shall own and maintain the stormwater facilities
in all other Tracts and easements. Drainage easements dedicated to the City over privately owned
and maintained stormwater facilities are for emergency access and emergency maintenance
purposes.
9. Mill Stream Lane and Oak Lake Lane are public right —of —ways that will be extended up to the
adjacent property to the east as public streets to provide cross — access for public use.
10. The Jesup's Landing Homeowners' Association shall own and maintain the 20 —foot wide
stabilized emergency access path located in Tract E at the southwest corner of the property.
11. There is a cross — access easement over Tracts I and L dedicated to the City of Winter Springs.
12. All retaining walls and handrails are to be owned and maintained by the Jesup's Landing
Homeowners' Association, Inc.
NOTICE: This plat, as recorded in its graphic form, is the official depiction
of the subdivided lands described herein and will in no circumstances be
supplanted in authority by any other graphic of digital form of the plat.
There may be additional restrictions that are not recorded on
this plat that may be found in the public records of this county.

described in this plat (the "Property "), and that it has caused
the some to be surveyed, and this plat, made and in accordance
with said survey, is hereby adopted as the true and correct plat
of the Property. All road rights of way, ingress /egress
easements, drainage easements, utility easements, pedestrian
access easements, cross access easements and lift station
easement as noted on the face of this plat, are hereby
dedicated to the perpetual use of the public and the City of
Winter Springs, Florida.
NOTWITHSTANDING the foregoing: An emergency access

for emergency ingress /egress access for fire, police and

granted above does not impose any obligation, burden,
