REQUEST:
Finance and Administrative Services and the Community Development Departments
are requesting that the City Commission adopt Resolution 2012 -24, authorizing the
submittal of the Certificate to Non -Ad Valorem Assessment Roll, Assessment
Summary and FY 2012 -2013 Annual Assessment Roll for Tax Year 2012 Relating to
the Oak Forest Assessment Area and the Tuscawilla Lighting and Beautification
Assessment Area Phases I and II to the Seminole County Tax Collector by September
15, 2012.
SYNOPSIS:
Final assessment rolls and documents need to be authorized and submitted to the Seminole
County Tax Collector for Tax Year 2012 (fiscal year 2013) relating to the Oak Forest Wall
and Beautification District and the Tuscawilla Lighting and Beautification Assessment Area
(Phases I and II) by September 15, 2012. The adoption of the annual resolution is required
under the City's Ordinance No. 98 -704. All assessment rates for both assessment areas
remain unchanged from last year.
CONSIDERATIONS:
Oak Forest Wall and Beautification District (OFWBD)
• On May 10, 2000, the City Commission created and imposed special assessments
within the Oak Forest Assessment Area also known as Oak Forest Wall and
Beautification District.
• On May 29, 2007 a Public Hearing (Agenda Item 509) was held, whereby the
Commission adopted Resolution Number 2007 -23, which approved the assessment

rates at $72.00 per BU for capital and $57.00 per BU for maintenance as related to the
Oak Forest Wall and Beautification District. These rates were approved to cover
forecasted expenditures for the five fiscal year periods FY 2007 -2008 to FY 2011-
2012.
• Each year residents are allowed to make capital assessment prepayments until July
15th. The final roll cannot be calculated until the prepayment period has
ended. During fiscal year 2011 -2012 there were no capital assessment prepayments
for OFWBD.
Tuscawilla Lighting and Beautification Assessment Area — Phases I and II (TLBAA)
• On August 23, 1999 the City Commission created and imposed special assessments
within the Tuscawilla Improvement Area known as the Tuscawilla Lighting and
Beautification District (TLBD). On November 14, 2005, the City Commission
created and imposed special assessments within the Tuscawilla (Phase II) Assessment
Area. The maintenance assessments for Phase I and II were later combined into one
maintenance assessment, while the two capital assessments remain distinct. The three
assessments within the Tuscawilla Lighting and Beautification Assessment Area are
Phase I Capital, Phase II Capital, and Maintenance (Phase I and II, combined).
• On May 29, 2007 a Public Hearing (Agenda Item 510) was held, wherein the
Commission adopted Resolution Number 2007 -24, approving assessment rates of
$43.00 per ERU for Phase I capital, $17.00 per ERU for Phase II capital and $126.00
per ERU for maintenance (Phases I and II combined) as related to the Tuscawilla
Lighting and Beautification Assessment Area — Phases I and II. These rates were
approved to cover forecasted expenditures for the five fiscal year periods FY 2007-
2008 to FY 2011 -2012.
• On June 3, 2009, the TLBD Board voted to reduce the FY 2009 -2010 maintenance
assessment from $126.00 per ERU to $120.00 per ERU until an adequate fund
balance reduction had been achieved. The Board agreed that the reduction would be
for a limited time period and the rate change would be revisited annually.
• The TLBD Board voted unanimously to increase the maintenance assessment to its
legal maximum of $128.00 per ERU for FY 2012 -2013 to prevent the legal maximum
from being increased in the near future as fund balance has continued to decrease
related to maintenance operations. After factoring in the 4% statutory discount, each
dollar of assessment translates to $4,127 in assessment revenue available for
expenditures.
• Staff has reviewed the financial status of the TLBD Maintenance Fund Budget and
fees and determined that sufficient fund balance currently exists to maintain the rate
at $120 per ERU for fiscal year 2013. At the budget workshop on July 16,
2012 Commission consensus was gained to maintain the lowered assessment of $120
per ERU. Staff will continue to closely monitor the financial position of this fund and
report back to the Commission for future action as may be required.
• Residents are permitted to make capital assessment prepayments until July 15th. The
final roll cannot be calculated until the prepayment period has ended. During fiscal
year 2011 -2012 there were no capital assessment prepayments for TLBD.
Both Assessment Areas /Districts
• The Certificate to Non -Ad Valorem Assessment Roll, Assessment Summary and FY
2012 -2013 (Tax Year 2012) Annual Assessment Rolls are attached for both entities.
• The assessment roll, both by parcel number and alphabetically by property owner, for

the Oak Forest Wall and Beautification District and for the Tuscawilla Lighting and
Beautification District, are available in the City Hall lobby, the City Clerk's office,
and the Urban Beautification Division of the Community Development Department.
FISCAL IMPACT:
The annual assessment service fees for NBS and Nabors Giblin are budgeted costs in the
following assessment district funds and do not adversely impact the General Fund:
• Oak Forest Maintenance Fund - #191
• Oak Forest Debt Service Fund - #214
• Tuscawilla Maintenance Fund - #184
• Tuscawilla Debt Service Fund - Phase 1 #211
• Tuscawilla Debt Service Fund - Phase 2 #213
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,

the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals

RECOMMENDATION:
It is recommended that the City Commission adopt Resolution 2012 -24 authorizing the
submission of the Certificate to Non -Ad Valorem Assessment Roll, Assessment Summary
and FY 2012 -2013 Annual Assessment Roll for Tax Year 2012 relating to the Oak Forest
Wall and Beautification District and the Tuscawilla Lighting and Beautification Assessment
Area — Phases I and H to the Seminole County Tax Collector by September 15, 2012.

A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA,
APPROVING ASSESSMENT ROLLS FOR
VARIOUS ASSESSMENT AREAS ESTABLISHED
PURSUANT TO ORDINANCE NO. 98 -704;
ESTABLISHING THE LIEN ASSOCIATED
THEREWITH; DIRECTING THAT THE
ASSESSMENT ROLLS BE CERTIFIED TO THE
SEMINOLE COUNTY TAX COLLECTOR;
PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS; PROVIDING
FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission (the "Commission ") of the City of
Winter Springs, Florida, enacted Ordinance No 98 -704 on July 27, 1998 (the
"Ordinance "), to provide for the creation of assessment areas and authorize the
imposition of special assessments to fund the construction and maintenance of
local improvements to serve the property located therein; and
WHEREAS, pursuant to the Ordinance, the Commission created and
imposed special assessments within the Tuscawilla Improvement Area on August
23, 1999, the Tuscawilla Service Area on August 23, 1999, the Oak Forest
Assessment Area on May 10, 2000 and the Tuscawilla (Phase II) Assessment Area
on November 14, 2005; and
WHEREAS, pursuant to the provisions of the Ordinance, the Commission
is required to adopt an "Annual Assessment Resolution" during its budget process
for each fiscal year to approve the assessment roll for such fiscal year and
WHEREAS, the Commission deems that this Resolution is in the best
interests of the public health, safety and welfare of the citizens of the City of
Winter Springs, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS
FOLLOWS:
SECTION 1. RECITALS. The above recitals are deemed true and
correct and are hereby made a specific part of this resolution.

SECTION 2. AUTHORITY. This Resolution is adopted pursuant
to the Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of
law.
SECTION 3. DEFINITIONS. All capitalized terms in this
Resolution shall have the meanings defined in the Ordinance and the
implementing resolutions adopted pursuant thereto.
SECTION 4. APPROVAL OF ASSESSMENT ROLLS. The
assessment rolls on file with the City Clerk for the Tuscawilla Improvement Area,
the Tuscawilla Service Area, the Oak Forest Assessment Area and the Tuscawilla
(Phase II) Assessment Area are hereby approved. Pursuant to Section 197.3632,
Florida Statutes, each assessment roll shall be certified to the Seminole County
Tax Collector prior to September 15, 2012, along with any necessary changes
subsequent to the date hereof permitted under Sections 3.12 and 4.12 of the
Ordinance and the Uniform Assessment Collection Act.
SECTION 5. ASSESSMENT LIENS. Special assessments
imposed within the assessment areas listed on the rolls described in Section 4
hereof shall constitute a lien against assessed property equal in rank and dignity
with the liens of all state, county, district or municipal taxes and other non -ad
valorem assessments. Except as otherwise provided by law, such lien shall be
superior in dignity to all other liens, titles and claims, until the ad valorem tax bill
for such year is otherwise paid in full pursuant to the Uniform Assessment
Collection Act. The lien shall be deemed perfected upon adoption of this
Resolution and shall attach to the property included on the assessment roll as of
January 1, 2012, the lien date for ad valorem taxes.
SECTION 6. CONFLICTS. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of such conflict
SECTION 7. SEVERABILITY. If any clause, section, other part
or application of this Resolution is held by any court of competent jurisdiction to
be unconstitutional or invalid, in part or application, it shall not affect the validity
of the remaining portions or applications of this Resolution.

SECTION 8. EFFECTIVE DATE. This Resolution shall take
effect immediately upon its passage and adoption.
RESOLVED BY the City Commission of the City of Winter Springs,
Florida, in a regular meeting assembled this 13th day of August, 2012.

Valorem Assessment Roll (the "Non -Ad Valorem Assessment Roll ") for the City is
properly assessed so far as I have been able to ascertain; and that all required
extensions on the above described roll to show the non -ad valorem assessments
attributable to the property listed therein have been made pursuant to law.
I FURTHER CERTIFY that, in accordance with the Uniform Assessment
Collection Act, this certificate and the herein described Non -Ad Valorem Assessment
Roll will be delivered to the Seminole County Tax Collector by September 15, 2012.

I, the undersigned, hereby certify that I am the Chairman of the Board, or authorized
agent of City of Winter Springs , located in Seminole County,
Florida; as such, I have satisfied myself that all property included or includable on the
Non -Ad Valorem Assessment Roll for the aforesaid county is properly assessed so far
as I have been able to ascertain; and that all required extensions on the above
described roll to show the non -ad valorem assessments attributable to the property
listed therein have been made pursuant to law.
I further certify that, upon completion of this certificate and the attachment of same to
the herein described Non -Ad Valorem Assessment Roll as part thereof, said Non -Ad
Valorem Assessment Roll will be delivered to the Tax Collector of this county.
