A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY,
FLORIDA; ESTABLISHING SPEED LIMITS ON
DESIGNATED CITY STREETS AND HIGHWAYS AND
ADOPTING A RELATED SPEED LIMIT MAP PURSUANT
TO ORDINANCE 2012 -04; PROVIDING FOR REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY;
AND AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under section 2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, the City Commission adopted Ordinance No. 2012 -04 which updated the
maximum speed limit on City streets and highways and provided that the City Commission or
City Manager may adopt maximum speed limits lower than the maximum set forth in the
Ordinance upon investigation and compliance with section 316.189, Florida Statutes; and
WHEREAS, section 316.189, Florida Statutes provides that a municipality may set
speed zones altering the speed limit, both as to maximum and minimum, after an investigation
determines such a change is reasonable and in conformity to criteria promulgated by the
Department of Transportation; and
WHEREAS, during the time period between November 2011 and April 2012, the City
Engineer and the City's Police Department conducted an investigation to reevaluate current
speed limits and to establish new appropriate speed limits, if necessary, on local City streets and
highways; and
WHEREAS, the City conducted the aforesaid investigation in conformance with section
316.189, Florida Statutes by using the criteria and procedure set forth in the Florida Department
of Transportation's (FDOT) publication entitled, "Speed Zoning for Highways, Roads, and
Streets;" and
WHEREAS, the City Commission previously accepted and adopted the City
investigation findings through the adoption of Ordinance No. 2012 -04; and
WHEREAS, the City Commission hereby finds that the results of the investigation are
reasonable and therefore, hereby accepts and adopts the findings of said City investigation for
purposes of establishing the speed limits set forth in this Resolution and the attached speed limit
map; and
WHEREAS, the City Commission hereby finds that this Resolution is in the best
interests of the public health, safety and welfare; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this
reference and are deemed a material part of this Resolution.
Section 2. Adoption of Speed Limit Map. The City Commission hereby adopts the
Speed Limit Map attached hereto as EXHIBIT "A" and further adopts the maximum speed
limits for the designated City streets and highways set forth on said Map. The Speed Limit Map
is hereby deemed fully incorporated into this Resolution by this reference. Nothing contained
herein shall prohibit the City Manager from amending the speed limits approved hereunder by
adopting a written administrative order pursuant to section 12 -52 of the City Code.
Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or
portion of this Resolution is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
Section 5. Effective Date. This Resolution shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida.
DONE AND ADOPTED in special meeting of the City Commission of the City of
Winter Springs, Florida, this 29 day of May, 2012.
