REQUEST:
The Community Development Department, Arbor Division, wishes to provide additional
information regarding recently approved changes to the City's Arbor Code found in
Ordinance 2011-16, as requested by Deputy Mayor Bonner at the City Commission Meeting
on February 27, 2012.
SYNOPSIS:
Arbor Ordinance 2011-16, Section 5-4 (b) (2) was approved on second reading by the City
Commission on February 27, 2012 under Agenda Item 501. Deputy Mayor Bonner
requested that Staff examine arbor permits issued during the past five (5) years to determine
if, related to Sec 5-4 (b) (2), any residents would have benefitted from the
revised Arbor Ordinance had the new policy applied to their permit at the time of issuance.
Staff wishes to update the City Commission of our findings.
CONSIDERATIONS:
Ordinance 2011-16, Section 5-4 (b) (2), was revised to allow trees that are located within 10
feet of a structure, and that pose a clear hazard, or that have caused damage to a structure, to
be removed without requiring replacement trees to be installed. Previously, trees within 10
feet of a structure were able to be removed, but replacement trees were required regardless
of whether or not the tree had caused damage to a structure.
Staff completed a review of permit records relating to specimen trees within the past five (5)
years and have determined that no resident was denied a permit for removal under the
previous ordinance that would now be approved under the new ordinance. With the revised
ordinance, if a specimen tree is within 10 feet of a structure, but is found to be structurally

sound and has not caused any damage to surrounding structures, a request for removal
would likely be denied, just as it would have with the former arbor ordinance. The revision
to the City's Arbor Ordinance, found in (2011-16), relating to trees located within 10 feet of
a structure, only effects whether or not replacement trees are required, not whether or not a
tree permit is denied or issued.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and
the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City’s Website, LaserFiche, and the City’s
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff requests the City Commission receive and review the information provided in this
Agenda Item.
