REGULAR MEETING C JANUARY 17, 2012 i:::� Q•4 CALL TO ORDER •rte The Regular Meeting of Tuesday, January 17, 2012 of the Code Enforcement Board was i•� called to Order by Vice Chairperson Hugh Fisher at 7:OOp.m., in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708. Roll Call: Chairperson Laura -Leigh Wood, arrived at 7:02 p.m. Vice Chairperson Hugh Fisher, present Board Member Laurie Bates Calhoun, present Board Member Carole Giltz, present Board Member Marvin Kelly, present Board Member Gregg Roero, arrived at 7:02 p.m. Board Member Jim Wentz, present Assistant City Attorney Kate Latorre, present Deputy City Clerk Joan L. Brown, present Vice Chairperson Fisher stated, "We have not heard from Board Member (Gregg) Roero and we have heard that Chairman Wood will be here, but will be late, so at this point, I will say that Board Member Roero's absence is `Unexcused' and I will defer on Chairman Wood to see if whether she gets here or not. If she does not get here, her excuse will be `Excused', because she has notified us." Continuing, Vice Chairperson Fisher announced, "It is my sad duty to inform you that former Board Member Dick Crenshaw passed away this week." Vice Chairperson Fisher added, "We owe a debt of gratitude for all of the good work that he did over the years." There was a moment of silence for former Code Enforcement Board Member Dick Crenshaw and our Troops, followed by the Pledge of Allegiance. Board Member Gregg Roero arrived at 7:02 p.m. Chairperson Laura -Leigh Wood arrived at 7.•02 p.m. Vice Chairperson Fisher commented, "I do note that Board Member Roero has arrived and also Chairperson Wood. At this time, I will declare that (Board Member) Roero's absence is rescinded as is Chairman Wood's and we will proceed. I will now turn the gavel over to Chairman Wood." This Violation was first observed on October 26, (2011)." Continuing, Inspector Flannigan remarked, "The Notice of Code Violation was mailed to the owner of Record on November 15 (2011). The letter was signed for by B. Orr on November 1 ` (2011). Property has been routinely checked and is still in Violation as of today. There has been no corrective actions observed. Certified Mail of the Code (Enforcement) Board meeting was mailed Return Receipt on December 30 (2011) and signed for by B. Orr on January 3 (2012). Property was Posted on December 30 (2011) by myself." Photographs were shown to all present. Inspector Flannigan noted, "In regards to this Case, I am recommending that the owner be given until February 10 (2012) if found in Non - Compliance. A Fine of one hundred and fifty dollars ($150.00) a day Fine." Inspector Flannigan stated, "Where it says, `Certified Mail of Code — (Enforcement) Board meeting was mailed and Return Receipt on December 30 (2011) it says `2012', it should say `2011'. Trash And Debris Sec. 6 -217. No Pool Enclosure Date Of Service: December 29, 2011 Inspector — Jim Flannigan Corporal Jim Flannigan, Code Enforcement Division, Police Department presented this Case and stated, "I would like to present in this Case `WS -2', [`WS -]3', and [`WS -]4' which are the green cards for the 'N.C.V.' (Notice of Code Violation) Notices and the Notice for tonight's Hearing which were signed for by Certified Mail. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - JANUARY 17, 2012 PAGE 9 OF 14 r This Violation was first observed on October 31 (2011). There were complaints of multiple Violations on the property. While on the property, I did observe that the pool was stagnant and the screen for the pool enclosure was not secured to the frame along with other Violations that have been since been corrected. The Notice of Code Violation was mailed to the owner of Record Jaimi and Gregory Putze on November 20 (2011). This Notice was signed for on November 23 (2011). Certified Mail to the Code (Enforcement) Board meeting was mailed on December 30 (2011) and signed for on December 31 (2011). This property has been routinely inspected and is still in Violation as of today. Property was Posted of tonight's Hearing as well by (Inspector) Christi Flannigan on December 30 (2011)." Corporal Flannigan remarked, "In regards to this Case, I am recommending the owners be given until February 1 2012 to correct this Violation and a Fine of two hundred and fifty dollars ($250.00) a day imposed if found in Non - Compliance." With further discussion, Corporal Flannigan stated, "We are asking for a Finding of Fact and Relief (Order) for the two hundred and fifty [dollar] ($250.00) a day Fine." VICE CHAIRPERSON FISHER STATED, "IN THE PAST WHEN WE HAVE ENCOUNTERED SUCH SITUATIONS SUCH AS THIS, WE HAVE ADDED THE `SERIOUS THREAT TO PUBLIC HEALTH AND SAFETY WELFARE' — I THINK IN THIS CASE, IT IS WARRANTED. The (Code Enforcement) Board issued an Order giving the Respondent until November 30 (2011) to correct the Violations if in Non - Compliance and a Fine of one hundred dollars ($100.00) be imposed. The property has been routinely checked and still found in Violation today. Certified Mail of the Code (Enforcement) Board meeting was mailed on December 30 (2011) and January 10 (2012). This Notice was also mailed First Class and has not been returned by the owner of Record. The second Notice was due to improper postage amount on the first Notice. The property was Posted with Notice of Hearing on December 30 (2011) by myself." Photographs were shown to all present. I have not received the green card back in regards to this Case. This Case was first observed August 29 (2011)." Continuing, Inspector Flannigan remarked, "I had no contact with the owner." Inspector Flannigan added, "This Case was originally heard on November 15 (2011). The (Code Enforcement) Board issued an Order giving the Respondent until November 30 (2011) to correct the Violations. If found in Non - Compliance, a Fine of one hundred dollars ($100.00) a day be imposed. The property has been routinely checked and is found to be in Violation as of today. Certified Mail of the Code (Enforcement) Board meeting was mailed on December 30 (2011). The Notice was also mailed First Class and has not been returned.
