• This violation was first observed July 5, 2011. The neighbors
advised that the pool was stagnant, while checking the other
violations.
• I have spoke with the owner of record who stated that they had
filed bankruptcy and it included this property and Bank of
America is responsible for the property.
• The Notice of Code Violation was mailed to the owner of record
on September 22, 2011, and to the Bank on November 4, 2011.
The Bank notice was signed for by Zemina Spahle on November
4,2011.

• This property has been routinely checked and was found to
still be in violation as of December 19, 2011.
•Certified mail of Code Board meeting was signed for on
December 5, 2011 by a representative of Bank of America. This
notice was also mailed First Class and Certified to the owners
of The Cannon's was signed for on December 14, 2011.
• Property was posted with notice of this hearing on November
29, 2011 by Inspector Christi Flannigan with notice of Code
Board Meeting.

Regarding this case, I am recommending the owner is given
until January 15, 2011 to correct the violation and a fine of
$150.00 a day imposed if found in non - compliance.
•We are asking for finding of fact & relief.
