REQUEST: The Public Works Department Requesting the City Commission validate the
Staff recommendation finding the Choices In Learning Charter School
sitework to be built in substantial accordance with the Final Engineering
plans and to accept the public infrastructure for ownership and
maintenance.
SYNOPSIS:
Sitework for the Choices in Learning Charter School is substantially complete and
has been conditionally approved by all applicable City Departments. This agenda
item provides the site acceptance necessary before a certificate of occupancy can
be issued by the building official.
CONSIDERATIONS:
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots;
exceptions.
(c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as withholding
occupancy, the building official may issue building permits upon advising the developer
that all or partial occupancy will be restricted until satisfactory completion of the
improvements has be accomplished.
(d) … Certificates of occupancy will not be issued until all improvements are accepted
by the city commission.
The Choices In Learning Charter School is a new 51,200 square foot, 2-story charter
school (grades pre-K through 5) located on the crescent-shaped 8.7-acre site at the
northeast corner of S.R. 434 and Central Winds Drive in the Town Center District. Final
Engineering was approved by the City Commission at the January 24, 2011 City
Commission meeting.

A Development Agreement (DA) was approved by the City Commission on September
13, 2010. The DA documented approval of the concept plan, the civic site, aesthetic
commitments associated with the civic site designation, hours of operation (to avoid
traffic conflicts with the high school), phasing, perimeter fencing, deferring on-street
parking along the eastern site boundary, Hicks Avenue improvements, future joint use of
City park and charter school facilities, parking and queuing, and possible joint signage
for the school and Central Winds Park. The DA was recorded on October 26, 2010. A
First Modification to the DA was approved by the City Commission in conjunction with
the Final Engineering approval on January 24, 2011, and the First Modification to the
DA was recorded on August 10, 2011. The modifications included: allowing canopies
and awnings at 9-foot elevations above the sidewalk, allowing a 4-foot black vinyl coated
chain-link fence along a portion of the site perimeter (with a vegetative screen), allowing
building expression lines to be located below the second floor windows, allowing
selected curb radii to be greater than 15-feet to accommodate school buses, and
permitting the window glazing at the north elevation of the building to be 13%
transparent glass.
The Development Agreement requires that a Joint Facility and Use Agreement between
the City and the Charter School be approved and fully executed prior to issuance of the
Certificate of Occupancy. The Agreement is expected to be complete and on the City
Commission agenda for approval at the October 24, 2011 meeting or the next meeting on
November 14, 2011.
The Choices In Learning Charter School sitework has been constructed in substantial
accordance with the Final Engineering plans approved by the City Commission on
January 24, 2011, except as noted on the attached conditions of approval, Exhibit A. In
addition, All Development Agreement requirements applicable to the sitework have been
completed.
The Charter School has provided the required easement documents for the public
underground utilities, public sidewalks, and landscape buffers. The public infrastructure
being accepted by this agenda item includes:
A new water main and fire hydrant located along the front of the property
New public sidewalks along Hicks Avenue, Central Winds Drive, and Central
Winds Parkway.
Parallel parking spaces along Hicks Avenue
Signage, striping, and other miscellaneous roadway improvements in the
public right-of-way
The Charter School is currently planning to open for operation in late November 2011.

RECOMMENDATION:
Staff recommends that the City Commission validate the Staff recommendation finding
the Choices In Learning Charter School sitework to be built in substantial accordance with the
Final Engineering plans, subject to completion of all conditions of approval to Staff’s satisfaction
prior to issuance of the Certificate of Occupancy, and to accept the public infrastructure for
ownership and maintenance.

1. Provide Engineer of Record's final certification letter to the City
2. Provide FDOT Permit Certification for work completed in the FDOT right-of-way
3. Provide a complete set of record drawings (hard copy and digital file)
4. Provide the 2-Year Escrow Deposit or Letter of Credit in the amount of $8,150 (10% of the value of
the improvements to be owned and maintained by the City)
5. Provide a Bill of Sale for improvements that will be owned and maintained by the City
6. Provide a copy of the Engineer’s as-built certification letter to SJRWMD
7. Complete the following construction punchlist items:
a. Replace broken sidewalk panel on Hicks Avenue
b. Finish sodding and site restoration
c. Repair asphalt segregation in various places at the entrances and nearby parallel parking spaces
d. Pond cleanup, including removal of weeds, trash, restoration of washouts, stabilization of areas
with no sod, etc.
e. Repair sidewalk crack near the north end of Hicks Avenue (one panel to be replaced)
f. Repair cracks in the concrete valley gutter at the entrances
g. Install decorative street signs for all new signs in the public right-of-way
h. Complete site restoration and cleanup, including areas along the perimeter of the site that were
disturbed as part of construction
i. Repair miscellaneous concrete cracks and chips in sidewalks, curbs, and other locations
j. Restoration and cleanup of the area at the western end of the site between the sidewalk and the
FDOT right-of-way (remove weeds, trash , sediments, etc., then stabilize
k. At the reclaimed water backflow preventer, paint all above-ground piping and fittings black
l. Paint the irrigation pump system box “Forest Green” as called out on the plans
