REQUEST: The Public Works Department Requesting the City Commission validate the
Staff recommendation finding the Jesup’s Reserve Phase 2 sitework to be
built in substantial accordance with the Final Engineering plans and to
accept the public infrastructure for ownership and maintenance.
SYNOPSIS:
Sitework for Jesup’s Reserve Phase 2, consisting of improvements to Roberts
Family Lane, is substantially complete and has been approved by all applicable
City Departments. This agenda item provides the site acceptance necessary
before a certificate of occupancy can be issued by the building official for any of
the 10 townhome units fronting Roberts Family Lane.
CONSIDERATIONS:
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots;
exceptions.
(c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as withholding
occupancy, the building official may issue building permits upon advising the developer
that all or partial occupancy will be restricted until satisfactory completion of the
improvements has be accomplished.
(d) … Certificates of occupancy will not be issued until all improvements are accepted
by the city commission.
Jesup’s Reserve is a 161-unit townhome development on 11.03 acres located on the south
side of S.R. 434 and west of Tuskawilla Road in the Winter Springs Town Center. Final
Engineering for Jesup’s Reserve was approved by the City Commission at the August 8,
2005 City Commission meeting. The Final Engineering consisted of two phases, with
Phase 1 consisting of 151 units and Phase 2 consisting of 10 units at the two buildings
facing Roberts Family Lane at the eastern end of the subdivision.

Sitework for Phase 1 was conditionally accepted by the City Commission at the
December 11, 2006 City Commission meeting. Many of the incomplete items that were
listed as conditions of approval at that time were not completed by the original developer,
Levitt & Sons, who filed for bankruptcy and abandoned the site. The incomplete
sitework items in Phases 1 and 2 have since been substantially completed by either the
new developer, bonding company, or the City using bond settlement proceeds.
At the July 23, 2007 City Commission meeting, the Commission approved a modification
to the Final Engineering plans to allow Roberts Family Lane to be built as a one-way
half-street with traffic movement from north to south. Roberts Family Lane has been
completed as a half-street, with portions of construction being completed by various
entities including the original developer, the bonding company, the new builder (DR
Horton), and the City using bond proceeds. The remaining portion of Roberts Family
Lane will be built when the right-of-way from the adjacent property becomes available.
The Phase 2 sitework being accepted with this agenda item includes:
Roberts Family Lane half-street improvements
o
Parallel parking along the west side of Roberts Family Lane
o
Curb, gutter, sidewalk, and stormwater facilities at Roberts Family Lane
o
Signage and striping
o
The Jesup’s Reserve Phase 2 sitework has been constructed in substantial accordance
with the Final Engineering plans approved by the City Commission on August 8, 2005,
and per the the approved modifications on July 23, 2007.
Some sitework items, such as sidewalks and landscaping in the immediate vicinity of
townhome buildings yet to be constructed, will be constructed in conjunction with
townhome construction to minimize damages to the public infrastructure.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.

RECOMMENDATION:
Staff recommends that the City Commission validate the Staff recommendation finding
the Jesup’s Reserve Phase 2 sitework to be built in substantial accordance with the Final
Engineering plans and to accept the public infrastructure for ownership and maintenance.
