Authorization
REQUEST: The Public Works Department requests the City Commission approve the
Winter Springs Village Phase 1 Plat and authorize the plat to be recorded,
subject to satisfaction of all outstanding Staff review comments.
SYNOPSIS: Winter Springs Village Phase 1 consists of the first 99 of 202 total single - family
lots in the proposed subdivision located on the east side of North Tuskawilla Road
in the Winter Springs Town Center. This agenda item is for the approval of the
Phase 1 Plat including the dedication of public streets to the City.

• Winter Springs Village is a 202 -unit all single - family subdivision located on a 40 -acre
parcel on the east side of North Tuskawilla Road in the Winter Springs Town Center.
• Final Engineering and a Developer's Agreement were approved by the City Commission
at the March 28, 2011 Commission meeting.
• At the March 28, 2011 City Commission meeting, the Commission approved a 4- parcel
plat which conveyed Wetlands Park and a portion of the Michael Blake Boulevard right -
of -way to the City. This 4- parcel plat has been recorded.
• This agenda item is a replat of the portion of the 4- parcel plat owned by Meritage Homes
for the Winter Springs Village subdivision. The replat creates Phase 1 of 2 and includes

the first 99 of 202 total single - family lots in Winter Springs Village. The replat also
includes public right -of -way dedications, common area tracts to be owned by the
Homeowner's Association, and easements for items such as drainage, utilities, tree
preservation, and sidewalks.
• All streets in Winter Springs Village are public and will be dedicated to the City as
rights -of -way. In addition, the west 14.50 -feet of the property is being dedicated to the
City as additional Tuskawilla Road right -of -way.
• Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various
sections) and Chapter 177, Florida Statutes. A title certification has been submitted and
is currently under review by Staff and City Attorney's office. Chapter 177, Florida
Statutes require that the plat be fully executed by the owner(s) of record, by all
mortgagees having an interest in the land to be subdivided, by the professional surveyor
and mapper of record, and by the independent professional surveyor and mapper who
reviews the plat for consistency with Chapter 177, Florida Statutes.
• As of September 1, 2011, City Staff including the City's independent surveyor,
Southeastern Survey and Mapping Corporation, had several outstanding review
comments that Meritage Homes was in the process of addressing. In addition, the street
names are still in the process of being reviewed and approved by Seminole County.
These comments must be satisfied before the City signs off on the plat certifying its
compliance with Chapter 177, Florida Statutes. As such, this agenda item is requested
for City Commission approval conditioned upon the satisfaction of all Staff review
comments.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item. The applicant is responsible
for payment of all review and recording fees.

RECOMMENDATION:
Staff recommends the City Commission approve the Winter Springs Village Phase 1 Plat,
subject to satisfaction of all Staff review comments, and authorize the City Manager and City
Attorney to prepare and execute any and all applicable documents.
