REQUEST: Utility Department requesting Approval to Terminate Participation in the SR
46 Alternative Water Supply Project
SYNOPSIS:
This authorization is requested due to the St. Johns River Water Management District
(SJRWMD) withdrawing as a 30% funding partner from the Alternative Water
Supply Project near SR 46 which will substantially increase the City’s cost share.
CONSIDERATIONS:
The City Commission approved on April 13, 2009 a Memorandum of Agreement with
the Cities of Casselberry, Deltona, Maitland, Oviedo, Sanford, Orange County, and the
SJRWMD to pursue development of an Alternative Water Supply Project near SR 46.
Staff recommended participation in the project at that time to maximize the options
available to the City Commission when considering the long term water supply needs of the
City. The City’s share of the costs for a consultant to develop a Conceptual Design Report
and to complete the Consumptive Use Permit application for the project was anticipated to
be approximately $250,000.
The SJRWMD recently notified the SR 46 partners that due to State mandated
budget cuts, they would no longer be able to participate as a 30% funding partner. It is
likely that the City’s financial obligation would increase by 50% with the withdrawal of the
SJRWMD funds and reduction in partners (Maitland has already withdrawn). In addition, the
City has received all permits needed to proceed with the Lake Jesup Reclaimed Water
Augmentation Project which serve as the City’s Alternative Water Supply Project.

FISCAL IMPACT:
Authorizing termination in the partnership agreement will reduce future costs to the
Utility Enterprise Fund by at least $250,000. The first $75,000 budgeted in FY 2012 and
Phase II future costs of $175,000 will be removed from the budget and CIP documents.
COMMUNICATION EFFORTS:
This Agenda Item Has Been Electronically Forwarded To The Mayor And City
Commission, City Manager, City Attorney/Staff, And All eAlert/eCitizen Recipients; And Is
Available On The City’s Website, LaserFiche, And The City’s Server. Additionally, Portions
Of This Agenda Item Are Typed Verbatim On The Respective Meeting Agenda Which Has
Also Been Electronically Forwarded To The Individuals Noted Above; And Which Is Also
Available On The City’s Website, LaserFiche, And The City’s Server; Has Been Sent To City
Staff, Media/Press Representatives Who Have Requested Agendas/Agenda Item Information,
Homeowner’s Associations/Representatives On File With The City, And All Individuals Who
Have Requested Such Information; And Has Been Posted Outside City Hall; Posted Inside
City Hall With Additional Copies Available For The General Public; And Posted At Five (5)
Different Locations Around The City. This Agenda Item Is Also Available To Any New
Individual Requestors. City Staff Is Always Willing To Discuss This Or Any Agenda Item
With Any Interested Individuals.
RECOMMENDATION:
Staff recommends that the Commission authorize the termination of the City’s
participation in the Memorandum of Agreement with the Cities of Casselberry, Deltona,
Maitland, Oviedo, Sanford, Orange County, and the SJRWMD for the Alternative Water
Supply Project near SR 46 and authorize the City Manager and City Attorney to prepare and
execute any and all applicable documents necessary to complete the termination.
