HomeMy WebLinkAbout2011 06 27 Regular 601 - Resolution 2011-29 Establish Economic Development Grant Fund - Business Tax Receipt UCF COMMISSION AGENDA Consent Informational ITEM 601 Public Hearing Regular X June 27, 2011 Meeting Mgr. / Dept Authorization REQUEST: The City Manager and the Community Development Department-Customer Service Division request that the City Commission consider Resolution 2011-29 establishing an Economic Development Grant Fund and application process to assist with the payment of Business Tax Receipts for eligible businesses within the University of Central Florida Incubation Business Program. SYNOPSIS: The City Commission has expressed interest in providing economic development opportunities for businesses enrolled in the UCF Incubation Business Program (“Incubation Program”). As such, staff was directed by the City Commission to establish a grant program for eligible City Incubation Program businesses to assist with payment of City and County business tax receipt fees. CONSIDERATIONS: 1.There are currently sixteen (16) City of Winter Springs businesses enrolled in the Incubation Program. The annual City fee for each commercial Business Tax Receipt is $100.00. The annual Seminole County fee for each Business Tax Receipt is $25.00 for a non-regulated business and $45.00 for a regulated business. 2.Resolution 2011-29 establishes an Economic Development Grant Fund to assist businesses enrolled in the Incubation Program with payment of City and County business tax receipt fees. 3.Pursuant to Resolution 2011-29, the City Commission can elect to allocate money to the Economic Development Grant Fund as it deems appropriate, but is not be obligated to allocate money to the fund at any time. Applicants will receive grant funds on a first- come, first-served basis. June 27, 2011 Regular Item 601 Page 2 4.Resolution 2011-29 establishes a process whereby interested eligible City businesses will file their business tax receipt application and include with it a certification from the University of Central Florida that the City business is currently enrolled in the Incubation Program. Staff will process these applications like any other business tax receipt application, and upon approval, will utilize available grant funds to pay the business tax receipt on behalf of the business. Pursuant to the Commission’s direction at the June 13, 2011 Regular Meeting, Staff is evaluating the feasibility of an expansion of this program to other businesses within the City. This proposal will include details relative to the intent of the program, eligibility requirements for participation, and the application, evaluation, and approval process. Staff will bring back the proposal for this expansion at a future date for consideration by the City Commission. FISCAL IMPACT: The fiscal impact depends on the amount allocated to the fund by the City Commission at any given time. The UCF Incubation Business Program currently has sixteen (16) clients. The annual city fee for each commercial Business Tax Receipt is $100.00. The annual Seminole County fee for each Business Tax Receipt is $25.00 for a non-regulated business and $45.00 for a regulated business. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and all eAlert/eCitizen recipients; and is available on the City’s website, LaserFiche, and the City’s server. Additionally, portions of this Agenda Item are typed verbatim on the respective meeting agenda which has also been electronically forwarded to the individuals noted above; and which is also available on the City’s website, LaserFiche, and the City’s server; has been sent to City staff, media/press representatives who have requested agendas/agenda item information, homeowner’s associations/representatives on file with the City, and all individuals who have requested such information; and has been posted outside City Hall; posted inside City Hall with additional copies available for the general public; and posted at five (5) different locations around the City. This Agenda Item is also available to any new individual requestors. City Staff is always willing to discuss this or any Agenda Item with any interested individuals. RECOMMENDATION: The City Manager and Community Development Department-Customer Service Division are requesting that the City Commission approve Resolution 2011-29 establishing an Economic Development Grant Fund to assist eligible City businesses enrolled in the University of Central Florida Incubation Business Program with payment of City and County business tax receipt fees. June 27, 2011 Regular Item 601 Page 3 ATTACHMENTS: A Resolution 2011-29 RESOLUTION NO. 2011-29 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, ESTABLISHING AN ECONOMIC DEVELOPMENT GRANT FUND AND APPLICATION PROCESS TO ASSIST ELIGIBLE CITY BUSINESSES WITHIN THE UNIVERSITY OF CENTRAL FLORIDA INCUBATION BUSINESS PROGRAM; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City of Winter Springs and Seminole County collect fees for commercial business tax receipt applications; and WHEREAS, the City Commission desires to assist City businesses enrolled in the University of Central Florida Incubation Business Program with payment of City and County business tax receipt fees; and WHEREAS, the City Commission desires to establish an economic development grant fund to pay the cost of business tax receipts fees for eligible City businesses that are enrolled in the Incubation Program; and WHEREAS, the City Commission of the City of Winter Springs finds that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER 5PRINGS, SEMINOLE COUNTY, FLORIDA, THAT: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by this reference. Section 2. Establishment of Economic Development Grant Fund. The City Commission hereby establishes an economic development grant fund ("Fund") for the purpose of paying the cost of City and County business tax receipt fees for eligible City businesses that are enrolled in the University of Central Florida Incubation Business Program ("Incubation Program"). The City Commission is hereby authorized to allocate money to the Fund as it deems appropriate. Nothing herein shall obligate the City Commission to allocate money to the Fund at any time. In order to be eligible to receive money from the Fund for payment of business tax receipt fees, a business located within the City must file its business tax receipt application with the City and shall include with it a certification from the University of Central Florida that the CiTy business is currently enrolled in the Incubation Program. The City shall process the application for the business tax receipt in the same manner as it processes other business tax receipt applications, except that on approval of the application, the City may utilize available money within the Fund to pay applicable City and County business tax receipt fees on behalf of the business. Eligible City businesses shall receive money from the Fund to the extent such money is available on a first-come, first-served basis. Section 4. Severabilitv. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida.
