Roll Call: Chairman Laura -Leigh Wood, present Vice Chairman Hugh Fisher, present Board Member Dick Crenshaw, absent (Excused) Board Member Barbara Croswell, present Board Member Carole Giltz, present Board Member Tony Ingria, absent (Unexcused) Board Member Leah Weisman, absent (Unexcused) Attorney Kimberly Kopp, present Chairman Wood noted, "Let the Record show that Board Members Tony Ingria and Leah Weisman will be absent from tonight's meeting as well as Board Member (Dick) Crenshaw. Board Member Crenshaw's absence is Excused." There was a moment of silence for all the people in Japan followed by the Pledge of Allegiance. Office Of The City Clerk Requesting Approval Of The February 15, 2011 Code Enforcement Board Regular Meeting Minutes. Chairman Wood asked, "Do I have Motion for the Approval of February 15 2011 Regular Meeting Minutes ?" "SO MOVED." MOTION BY VICE CHAIRMAN FISHER. SECONDED BY BOARD MEMBER GILTZ. DISCUSSION. VOTE: CHAIRMAN WOOD: AYE VICE CHAIRMAN FISHER: AYE BOARD MEMBER CROSWELL: AYE BOARD MEMBER GILTZ: AYE MOTION CARRIED. PUBLIC INPUT Chairman Wood announced, "Seeing no one here, Public Input is closed." INFORMATIONAL AGENDA INFORMATIONAL 100. Office Of The City Attorney Review Of Meeting Procedures And Forms. Attorney Kimberly Kopp noted, "As you know, tonight there were going to possibly be twenty -eight (28) Hearings and that's what got us talking in my office about possibly giving you some options as to streamlining the meetings; so that they could be more efficient in the event that you have a long Agenda like that. And one thing that we came up with as a suggestion for you to consider is respect to the scripts. Some of our other cities — just do Motions and then they authorize the City Clerk to basically put the Findings of Facts and the other items that you have in your scripts into the Order. So, they are incorporated that way. But they don't need to be read into the Record for each Case during the meeting." Following, Attorney Kopp provided the Board sample Motions for consideration. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING -MARCH 15, 2011 PAGE 3 OF 14 Attorney Kopp then reviewed Ordinance Number 2010 -14 and remarked, "You are not required to have Alternates on this Board and currently in your procedure manual — there are several provisions dealing with Alternates. The City Commission has the option of Appointing Alternates, but other than that you're just to have your seven (7) Members." Continuing, Attorney Kopp recommended the "City of Winter Springs, Florida Code Enforcement Board Policy & Procedure Manual" be Amended and then commented, "You can look through your procedures and policy manual in general if you like and come up with any other suggested revisions that you might have for the next meeting, or we can look at it for you and come up with some suggested revisions in addition to that issue at the next meeting; however you want to direct us to handle it." Discussion. Chairman Wood asked, "Is there any Board Members that would like to make a Motion to discontinue using the scripts of the Findings of Fact and the Relief Orders and have the Clerk incorporate it in the typed Orders, but do not need to be — read into the Record ?" "SO MOVED." MOTION BY VICE CHAIRMAN FISHER. SECONDED BY BOARD MEMBER GILTZ. DISCUSSION. That will be changed in the `(City Of Winter Springs, Florida Code Enforcement Board) Policy And Procedure (Manual)' and we will begin tonight using the Code Enforcement Board Motions." Attorney Kopp then summarized Ordinance Number 2011 -05 stating, "City Advisory Boards - the meetings need to end by 10:00 p.m. unless you Vote otherwise." CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING -MARCH 15, 2011 PAGE 5 OF 14 Next, Inspector Flannigan introduced this Agenda Item and provided Testimony stating, "This Violation was first observed on August 18 2010. I received Complaints from neighbors of a stagnant pool. I could observe the pool - on the side of the house from the property which has a screen enclosure but there's no fence for the property. The house is vacant and all attempts to contact the Owner have proven unsuccessful to date. The Notice of Code Violation was Certified Mailed to the Owners William and Sandra Campbell. It was returned as Undeliverable." Following, Inspector Flannigan noted the dates this Violation failed Re- Inspection and remarked, "Certified Mail of Code Board Meeting was delivered on February 18 2011 and the property was Posted with a Notice of Code Board for this evening by (Inspector) Butch West (Code Enforcement Bureau, Police Department) on March 5 2011. We are asking for Finding of Fact and Relief in this matter." Next, photographs of this stagnant pool were displayed to those in attendance. Discussion. Chairman Wood noted, "For the Record, please note that the Respondent was not here to give any Testimony." "I MOVE TO FIND THE RESPONDENT IN THIS CASE IN VIOLATION OF THE CITY CODE AS CHARGED AND THAT RESPONDENT CORRECT THE VIOLATION BEFORE 1:00 P.M. ON MARCH 21, 2011. (Stagnant Pool) Date Of Service: Certified — Proof Of Delivery February 19, 2011 Inspector — Jim Flannigan Inspector Flannigan began his Testimony by stating, "This Violation was first observed — on August 19', 2010. I received a Complaint from neighbors of a stagnant pool. I could observe the pool from the side of the house of the property which has a screen enclosure. That house is vacant and all attempts to contact the Owner have proven unsuccessful to date." Next, Inspector Flannigan discussed the dates Certified Mail was returned Undeliverable and dates the property failed Re- Inspection as shown on the PowerPoint presentation. Following, Evidence of Certified Mail of this Code Board Meeting that was signed by Ms. Olivia J. Herrera on February 19, 2011 was provided to the Board. Inspector Flannigan then stated, "We are asking for Finding of Fact and Relief — on this property." Photographs of this property in Violation were then viewed. "I MOVE TO FIND THE RESPONDENT IN THIS CASE IN VIOLATION OF THE CITY CODE AS CHARGED AND THAT RESPONDENT CORRECT THE VIOLATION BEFORE 1:00 P.M. ON — MARCH 21 2011. (Stagnant Pool) Date Of Service: Certified — February 18, 2011 Inspector — Jim Flannigan Inspector Flannigan provided Testimony on this Case indicating the Violation has been in effect since August 27, 2010 and stated, "The house is now vacant and all attempts to contact the Owner since — August 27 th , ( 20 10) has proven unsuccessful." Following, Inspector Flannigan mentioned that the Notice of Code Violation sent Certified Mail to the Owner, Mr. Michael Levine was returned Undeliverable and listed dates the property failed Re- Inspection. It was also noted by Inspector Flannigan, that "Certified Mail of the Code Board Meeting was delivered on February 18 2011. The property was Posted with Notice of Code Board by Butch West on March 5 2011, of this evening's meeting." The Notice was provided to the Board as Evidence and Inspector Flannigan then stated, "We are asking for Finding of Fact and Relief on this matter." A photograph of the stagnant pool was then shown. (Fence In Disrepair) Date Of Service: Certified — February 22, 2011 Inspector — Christi Flannigan Inspector Jim Flannigan presented the PowerPoint presentation for Inspector Christi Flannigan, Code Enforcement Bureau, Police Department and noted the date of the Violation was first observed on December 22, 2010. Inspector Flannigan then listed dates the property failed Re- Inspection. Next, Inspector Flannigan mentioned, "Certified Mail receipt was not signed by Cari Brown — and Certified letter was returned on January 31 2011. Notice of Hearing was Posted on the property March 5 2011 by — Mr. West." Further comments followed along with photographs of this property. Vice Chairman Fisher inquired, "Is there a pool in the back?" Inspector Flannigan replied, "To my knowledge there is no pool." Discussion ensued regarding Fines. "I MOVE TO FIND RESPONDENT IN THIS CASE IN VIOLATION OF THE CITY CODE AS CHARGED AND THAT RESPONDENT CORRECT THE VIOLATION BEFORE 1:00 P.M. ON MARCH 21 2011. IN THE EVENT RESPONDENT DOES NOT COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF FIFTY DOLLARS ($50.00) PER DAY WILL BE IMPOSED FOR EACH DAY THE VIOLATION CONTINUES PAST THE AFORESTATED DATE. (Fence In Disrepair) Date Of Service: Certified — Proof Of Delivery February 19, 2011 Inspector — Christi Flannigan Inspector Flannigan again provided the PowerPoint presentation related to this Case and noted, "This Violation was first observed on December 29, 2010. The Notice of Code Violation was Certified Mailed to the Owner Theresa and Scott Mandigo on January 14 2011." Continuing, Inspector Flannigan provided dates this property failed Re- Inspection, including the date of this meeting and mentioned, "Certified Mail receipt was not signed by Theresa and Scott Mandigo. The Certified letter was returned on February 2" 2011. Notice of Hearing was signed for on February 19 2011 by Kelly Mandigo and I do have proof of that. I would like to turn over as Evidence." Inspector Flannigan then asked the Board for Finding of Fact and Relief. Next, photographs of the fence in disrepair were shown to those in attendance and Inspector Flannigan confirmed the property was not vacant. Vice Chairman Fisher asked, "Is the pool enclosure intact ?" Inspector Flannigan responded, "Yes to my knowledge." Discussion regarding Fines ensued. PUBLIC HEARINGS - NEW CASES 502.7 Code Enforcement Bureau — Police Department CASE #11- 0024545 William Riggin 601 Marlin Road Winter Springs, Florida 32708 Section 13 -2. (Trash And Debris) Date Of Service: Certified — Returned "Unclaimed" March 3, 2011 Inspector — Butch West Chairman Wood asked Assistant to the City Clerk Coutant, "Will you please make sure that the Record reflects that there is no one here in the audience and there have been no Respondents for every Case ?" Assistant to the City Clerk Coutant nodded in agreement. Inspector West presented his Testimony by giving a PowerPoint presentation stating, "On the 4 t11 of January, 2011, I first observed the front screen door at this residence to be hanging open. On closer inspection I revealed that it was hanging from its hinges and propped in the entrance way. Trash and debris, including an old plastic chair and what appeared to be construction material, littered the front yard by the porch. Old tires, plastic buckets and wood scrap also littered the back yard. Front window shades were also torn and tattered. Because the house appeared vacant, warning Notices which normally would have been Posted on the front door were mailed to the Homeowner by regular First Class Mail." CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING —MARCH 15, 2011 PAGE 11 OF 14 Additionally, Inspector West provided information relating to Certified Mail and dates in which the property failed Inspection and continued by noting, "Based on that information, I set this Case for Code Board in March of this year and Noticed the Hearing as mailed to Mr. Riggin by Certified Mail. He signed for that Notice on the 28 of February." Inspector West stated, "The property again failed inspection on the 5 th of March and a copy of the Notice of Board Hearing was Posted at the front door of the residence on that date." A copy of the Posting was provided to the Board as Evidence and Chairman Wood commented, "Thank you for your diligence." Continuing, Inspector West stated, "The property is still in Non - Compliance and we are asking for Finding of Fact and Relief." Following, photographs of this property in Violation were displayed. Chairman Wood inquired, "Are we addressing the stagnant pool this evening ?" Inspector West replied, "No." After some discussion relating to Fines, Attorney Kopp reviewed the Florida Statutes, and addressed the Board stating, "In determining the amount of the Fine you can consider the following: 1) Is the gravity or seriousness of the Violation; 2) Is any action taken by the Violator to correct the Violation, if any, and 3) Is any previous Violations committed by the Violator." PUBLIC HEARINGS - NEW CASES 502.8 Code Enforcement Bureau — Police Department CASE #11- 0024630 William C. Wise, Sr. 1101 Trotwood Boulevard Winter Springs, Florida 32708 Section 13 -2. (Stagnant Pool) Date Of Service: Certified — February 22, 2011 Inspector — Christi Flannigan Inspector West presented this Case for Inspector Flannigan and began Testimony by stating, "This Violation was first observed on the 12 of January — the Notice of Code Violation — was Certified Mailed to the Owner William Wise, Sr. on the 19 of January of this year." Dates that this property failed Re- inspection were listed on the PowerPoint presentation and then read by Inspector West. Next, Inspector West said, "Certified Mail Receipt was signed for by Richard Langry on the 29 of January, (2011). Notice of Hearing was Certified Mailed on the 18 and no one signed for that Notice. property was Posted by myself on the 5 th of March of this year. Inspector Flannigan observed parts of the fence did not close and saw that there was a screen enclosure with a stagnant pool. The son of the property Owner, William Wise Jr., called on February the 2" ( 2011) and advised that the property Owner moved north and he would take care of the property and asked for more time. Nothing has been corrected as of yet and no word from the son has been received as of yet. We are asking for a Finding of Fact and Relief on this." Photographs of the property in Violation were observed by those in attendance. Discussion ensued. Chairman Wood then noted the Return Receipt and Affidavit of Posting which was submitted as Evidence.
