REQUEST: The City Attorney and City Manager request that the City Commission consider
adopting Resolution. No. 2011 -20 initiating the Interlocal Service Boundary Agreement Act
process with Seminole County regarding the annexation of existing enclaves within the City.
SYNOPSIS: The City Commission has expressed a strong desire to expedite the annexation of
the existing enclaves within the City. The City Commission directed that the City Attorney and
City Manager work with Seminole County to mutually agree to initiate the process set forth in
the Interlocal Service Boundary Agreement Act for purposes of negotiating an agreement for the
City to annex the enclaves over a period of time. Seminole County has expressed a willingness
to participate in the process with the City given the particular characteristics of the enclaves in
Winter Springs. To initiate the ISBA process, the City Commission must adopt an initiating
resolution which identifies the issues and land areas to be negotiated.
CONSIDERATIONS:
1. The City and Seminole County are parties to a 1987 Interlocal Agreement which
provides that Seminole County will "encourage" the annexation of enclaves within
the City.
2. On January 14, 2008, the City Commission considered a very detailed agenda item
explaining the various options available to the City to perhaps expedite the
annexation of the remaining existing enclaves within the City over a period of time.

3. In order to provide a more flexible approach to annexing the particular existing
enclaves within the City, the City Attorney recommended that the City consider
initiating, with Seminole County's agreement, the procedures and criteria set forth in
the Interlocal Services Boundary Agreement Act ( "ISBA j.
4. After considering all the available options, the City Commission directed the City
Attorney and City Manager to consult with Seminole County management about the
possibility of initiating the procedures and criteria set forth in the ISBA.

5. ISBA generally sets forth a more flexible process for a city to annex existing enclaves
by written agreement with the county. Unlike section 171.046, Florida Statutes,
which has certain narrow limitations regarding the enclaves that can be addressed by
agreement, ISBA would permit the City and Seminole County to negotiate terms and
conditions for the annexation of all the enclaves within the City.
6. ISBA requires that before negotiations commence, the city and county must adopt
resolutions defining the issues to be negotiated.
7. The City Attorney and City Manager have met with Seminole County Manager and
Attorney on several occasions to discuss the Commission's desire to amend the 1987
Interlocal Agreement and to initiate ISBA. The City's planning staff has also met
with their counterparts at the County to discuss the same.
8. At this time, it appears that Seminole County and the City are in agreement to initiate
the ISBA process to address the annexation of the existing enclaves within the City.
The sole issue to negotiate will be the enclaves. The enclaves are identified in the
attachment to the proposed Resolution.
9. In order to initiate the ISBA process, the City Commission is required to adopt an
initiating resolution. The County will then have 60 days to adopt a responding
resolution. After the resolutions have been adopted, the City and County can
commence negotiations and adopt a written agreement to address the terms and
conditions under which the City and the County will agree to eliminate the existing
enclaves within the City over a period of time.
FISCAL IMPACT:
Over time, the annexation of the enclaves will add additional properties to the City's tax roles
and thereby increase the City's tax base. The increase will be determined at such time the
properties are annexed and on the millage rate at that time. The increase may also depend on the
kind of future development of vacant enclaves.
COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the
Mayor and City Commission, City Manager, City Attorney /Staff, and all eAlert/eCitizen
recipients; and is available on the City's website, LaserFiche, and the City's server. Additionally,
portions of this Agenda Item are typed verbatim on the respective meeting agenda which has also
been electronically forwarded to the individuals noted above; and which is also available on the
City's website, LaserFiche, and the City's server; has been sent to City staff, media/press
representatives who have requested agendas /agenda item information, homeowner's
associations /representatives on file with the City, and all individuals who have requested such
information; and has been posted outside City Hall; posted inside City Hall with additional
copies available for the general public; and posted at five (5) different locations around the City.
This Agenda Item is also available to any new individual requestors. City Staff is always willing
to discuss this or any Agenda Item with any interested individuals.
RECOMMENDATIONS: The City Attorney and City Manager recommend that the City
Commission adopt Resolution No. 2011 -20 initiating the ISBA process with Seminole County

regarding the annexation of existing enclaves within. the City. Further, that the City Clerk shall
send Resolution No. 2011 -20 to the Seminole County Manager by United States Certified Mail
pursuant to section 171.203(1)(b), Florida Statutes.

A RESOLUTION OF THE CITY COMMISSION OF
WINTER SPRINGS, FLORIDA, INVITING SEMINOLE
COUNTY TO BEGIN DISCUSSIONS AND
NEGOTIATIONS REGARDING THE ANNEXATION
OF UNINCORPORATED "ENCLAVES" EXISTING
WITHIN THE CITY OF WINTER SPRINGS
PURSUANT TO INTERLOCAL SERVICE BOUNDARY
AGREEMENT ACT SET FORTH IN CHAPTER 171,
PART II, FLORIDA STATUTES; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, in 2006, the Florida Legislature enacted the Interlocal Service Boundary
Agreement Act, which was codified as section 171.20 et. seq. (the "Act "); and
WHEREAS, the principle goal of the Act is to encourage local governments to jointly
determine how to provide services to residents and property in the most efficient and effective
manner while balancing the needs and desires of the community; and
WHEREAS, the intent of the Act is also to provide a more flexible process for adjusting
municipal boundaries and to address a wider range of the effects of annexation; and
WHEREAS, the Act encourages intergovernmental coordination in planning, service
delivery, and boundary adjustments and to reduce intergovernmental conflicts and litigation
between local governments; and
WHEREAS, it is also the intent of the Act to promote sensible boundaries that reduce the
costs of local governments, avoid duplicating local services, and increase political transparency and
accountability; and
WHEREAS, the City Commission recognizes that the Florida Legislature has determined
that enclaves can create significant problems in planning, growth management, and service delivery,
and that the Florida Legislature has declared that it is the policy of the state to eliminate enclaves;
and
WHEREAS, in accordance with the policy of the state to eliminate enclaves, it is the intent
and purpose of this Resolution to invoke the provisions of the, Act in order to permit the City of
Winter Springs and Seminole County to engage in meaningful and structured negotiations regarding
the elimination of enclaves that currently exist in the City of Winter Springs; and
WHEREAS, for purposes of this Resolution, the term "enclave" shall have the same
meaning as provided in section 171.031, Florida Statutes; and
WHEREAS, the City Commission hereby finds that the adoption of this Resolution is in the
best interests of the citizens of Winter Springs.
NOW THEREFORE, BE IT RESOLVED by the City Commission of Winter Springs,
Florida, as follows:
Section 1. Recitals The foregoing recitals are hereby fully incorporated herein by this
reference.

Section 2. Unincorporated Enclave Area to be Discussed Pursuant to section
171.203(1) of the Act, this Initiating Resolution identifies the .,.,,,,,....
unincorporated enclave areas
within the City of Winter Springs which are depicted in EXHIBIT "A ." Said EXHIBIT "A" is
hereby fully incorporated herein by this reference. Said EXHIBIT "A" is attached hereto for
purposes of identifying the parcels of land to be discussed and negotiated for possible annexation
into the City of Winter Springs by Interlocal Service Boundary Agreement.
Section 3. Enclave Annexation Issues. The Interlocal Service Boundary Agreement
shall address the annexation of the unincorporated enclaves identified in EXHIBIT "A" and
may also address those issues related to the annexation of said enclaves including, but not
limited to, the issues listed in section 171.203(6), Florida Statutes.
Section 4. Distribution of Initiating Resolution. The City Clerk is hereby
instructed to send this Initiating Resolution by United States certified mail to the chief
administrative officer of Seminole County, Florida.
Section 5. Effective Date. This Resolution shall take effect immediately upon
its final passage and adoption by the City Commission.
ADOPTED by the City Commission of Winter Springs, Florida in a regular meeting
assembled on the 9 T4 day of May, 2011.
