REQUEST: The Public Works Department Requesting the City Commission validate the Staff
recommendation finding the Starlight Baptist Church Basketball Court Enclosure
site to be built in substantial accordance with the Final Engineering plans and to
accept the potable water infrastructure for ownership and maintenance.
SYNOPSIS:
Sitework for the Starlight Baptist Church Basketball Enclosure at 190 East Bahama
Road is substantially complete and has been approved by all applicable City
Departments. This agenda item provides the site acceptance necessary before a
certificate of occupancy can be issued by the building official.
CONSIDERATIONS:
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots; exceptions.
(c) Where the building official has an authoritative method of assurance that the improvements
will be completed in accordance with approved plans, such as withholding occupancy, the
building official may issue building permits upon advising the developer that all or partial
occupancy will be restricted until satisfactory completion of the improvements has be
accomplished.
(d) … Certificates of occupancy will not be issued until all improvements are accepted by the
city commission.
Final Engineering for the Starlight Baptist Church Basketball Court Enclosure project was
approved by the City Commission at the April 26, 2010 City Commission meeting. The project
consists of the enclosure of the church’s existing covered basketball court and its conversion
into the church’s new indoor assembly area. Additional improvements completed as part of
this project include connections to City water and sewer service, site landscaping, a dumpster
enclosure, and the provision of stabilized parking for buses. The Basketball Enclosure project
is a scaled back version of a more comprehensive project that was approved by the City
Commission on May 12, 2008, which included a new 30,000 square foot building and related
site improvements.

The site has been constructed in substantial accordance with the Final Engineering plans
approved by the City Commission on April 26, 2010.
All City agencies have found the work to be acceptable, with the exception of the following
punchlist items:
a.Complete site restoration, sodding, and cleanup
The engineer-of-record has certified the sitework and provided a signed and sealed set of
record drawings.
The owner has provided a Bill of Sale and two-year warranty for the water distribution system
improvements in the Hayes Road right-of-way being turned over to the City for ownership and
maintenance.
The potable water and sanitary sewer systems have been cleared by FDEP.
FISCAL IMPACT:
All applicable fees associated with the development of the Starlight Baptist Church
Basketball Enclosure project have been paid by the owner.
COMMUNICATION EFFORTS:
This Agenda Item has been forwarded to the Mayor and City Commission; City
Manager; City Attorney/Staff; placed in Press Packets; placed in the City Hall (Lobby) City
Commission Meeting binder; and is available on the City’s Website, LaserFiche, and the City’s
Server. Additionally, information related to this Agenda Item has been sent to media/press
representatives who have requested Agendas/Agenda Item information, all Homeowner’s
Associations on file with the City, all individuals who have requested Agendas/Agenda Item
information, Department Directors; and also posted outside City Hall; posted inside City Hall
with additional copies available for the general public; and posted at five (5) different locations
around the City.
RECOMMENDATION:
Staff recommends that the City Commission validate the Staff recommendation finding
the Starlight Baptist Church Basketball Enclosure site to be built in substantial accordance with
the Final Engineering plans and to accept the potable water infrastructure for ownership and
maintenance, subject to satisfactory completion of all site punchlist items listed herein.
