Call to Order (Open to Public) The Attorney - Client Session of Monday, February 7, 2011 of the City Commission was called to Order by Mayor Charles Lacey at 5:05 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Mayor Charles Lacey, present Deputy Mayor Jean Hovey present Commissioner Rick Brown, present Commissioner Gary Bonner, present Commissioner Cade Resnick, present Commissioner Joanne M. Krebs, present City Manager Kevin L. Smith, present City Attorney Anthony A. Garganese, present II. Attorney - Client Session (Closed to Public) Pursuant To Section 286.011(8), Florida Statutes, The City Attorney will be seeking the advice of the City Commission regarding settlement negotiations and strategy and litigation expenditures related to the pending litigation titled Atlantic Housing Partners, LLLP v. City of Winter Springs, Case Number 10-57 - AP, in the 18` Judicial Circuit in and for Seminole County, Florida and Atlantic Housing Partners, LLLP, et at v. City of Winter Springs, Case Number 6:10 -CV- 01905- MSS -DAB, in the United States District Court, Middle District, Orlando Division. The persons scheduled to be in attendance are Mayor Charles Lacey, Deputy Mayor Jean Hovey, Commissioner Rick Brown, Commissioner Gary Bonner, Commissioner Cade Resnick, Commissioner Joanne M. Krebs, City Manager Kevin L. Smith, the City Attorney's Office (Anthony A. Garganese, Usher L. Brown, and Gary Glassman) and a court reporter. City Attorney Anthony A. Garganese briefly spoke on this Attorney - Client Session. Mayor Lacey stated, "Persons scheduled to be in attendance at the meeting are Mayor Charles Lacey, Deputy Mayor Jean Hovey, Commissioner Rick Brown, Commissioner Gary Bonner, Commissioner Cade Resnick, Commissioner Joanne Krebs, City Manager Kevin Smith, and from the Attorney's Office, Anthony Garganese and Gary Glassman and a Court Reporter." This portion of the Attorney - Client Session was then closed. Those attending this Attorney- Client Session left the Commission Chambers at 5:06p.m. At 5:25 p.m., Mayor Lacey, the City Commission, Manager Smith, and Attorney Garganese returned to the Commission Chambers; and Mayor Lacey then called the Attorney- Client Session back to Order.
