REQUEST: The Community Development Department presents to the City Commission a
request to extend the final engineering/site plan approval for an approximately 3,500 square foot
(SF) daycare facility within the R -3 (Multiple Family Dwelling) zoning district, pursuant to
Section 9 -346 of the City Code.
SYNOPSIS: In 2008 the Park Manor Academy received a conditional use to construct and
operate a daycare facility at lot 5 of the Excelsior Business Park (135 Excelsior Parkway) and
subsequently received a building setback waiver to "fit" the facility onto the site. The
conditional use and waiver have expired since no building permit has been issued for the site
(Sec. 20 -36). An aesthetic review approval of the building, site, wall, and signage (which
proceeded concurrently with the site plan) has an 18 month (6 more months) timeframe before it
expires (Sec. 9 -604). The applicant would need to receive a new conditional use and waivers,
before commencing construction or obtaining a building permit, if the Commission votes to
extend the site plan.

CHRONOLOGY:
January 11, 1990 — Excelsior Business Park plat was recorded with Excelsior Parkway as a
private cul -de -sac roadway.
July 9, 2007 — Ordinance No. 2007 -20 was adopted, allowing day nurseries, kindergartens, and
daycare as a conditional use in the R -3 zoning district (Sec. 20 -208).
February 25, 2008 — Conditional use for daycare was approved.
September 19, 2008 — City receives site plan application package.
October 27, 2008 — Setback waiver (allows 15' front setback, in lieu of 25') was approved.
February 3, 2010 — Final engineering/site plan receive recommendation for approval from P &Z.
February 22, 2010 — Final engineering/site plan and aesthetic review approved by Commission.
DISCUSSION:
The financial crisis has stalled a number of construction projects. The applicant was unable to
build within the time required by code and requests and extension for the most expensive and
time consuming portion of the approval "package." Both a conditional use and setback waivers
must be re- approved to allow construction, as currently proposed. Any modifications to either
the conditional use or code (setback) waivers could require modifying the site plan (possibly re-
opening the site plan review process, depending upon the nature of the modification).
FISCAL IMPACT:
The Seminole County Property Appraiser's office states that, within Seminole County, the
average building size for a daycare center is 5,528 S.F. (this facility will be approximately 3,500
S.F.) and that the average just value of these facilities is $110.70 per square foot. Therefore,
without knowing further specifics, the estimated total just value of the facility is $387,450 (3500
SF x $110.70). The applicant projects 3 full -time and 2 part-time employees. Tax revenue
projections are as follows:
3,500 square feet - assessed at $110.70 /square foot: $387,450 assessed tax value
$387,450/1000 = 387.45
387.45 (2.5814) = $1,000.16
$1,000.16 (less the 4% statutory discount) = $960.16 tax revenue
COMMUNICATION EFFORTS:
This Agenda Item has been forwarded to the Mayor and City Commission; City Manager; City

Meeting binder; and is available on the City's Website, LaserFiche, and the City's Server.
Additionally, information related to this Agenda Item has been sent to media/press
representatives who have requested Agendas/Agenda Item information, all Homeowner's
Associations on file with the City, all individuals who have requested Agendas /Agenda Item
information, Department Directors; and also posted outside City Hall; posted inside City Hall
with additional copies available for the general public; and posted at five (5) different locations
around the City.

RECOMMENDATION:
Staff recommends the final engineering plans approval be extended for six (6) months or
whatever timeframe the City Commission deems appropriate, pursuant to Sec. 9 -346, subject to
the applicant obtaining new conditional use and setback waiver approvals.

February 25, 2008. I am trying to calculate the best business plan that will allow for
growth and success for my school.
