REQUEST: The City Manager and Police Department -Code Enforcement Division
request the Commission authorize the City Manager to extend the permit time period for a
Temporary Storage Structure (POD) located at 671 Vistawilla Drive.
SYNOPSIS: The purpose of this agenda item is to request Commission authorization (in
accordance with the provisions of City Code Section 6 -87(d) - attached) to extend the permit
time period on a temporary storage structure (POD) for an additional 30 days. This request is
being made by the homeowners due to an unfortunate situation involving a plumbing line break
in their home, resulting in the home being temporarily unlivable.
CONSIDERATIONS:
The family at 671 Vistawilla Drive had a recent plumbing line break in their home resulting in
extensive damage. This damage will require the replacement of several walls, ceiling, flooring
and dislodging the family to a hotel until the construction is completed. The completion of the
work required will be finished by the end of January, then allowing them to return home. The
contents of the home and personal belongings must be removed during this time period to
complete the scope of work required.
They have received a permit to have a POD which was delivered on December 29, 2010 to
temporarily store the furniture and personal belongings. While this action does allow for easy
access to their belongings used day to day it also allows for protective storage of large items
during the repair of their home. However, current city ordinance only allows the POD to remain
on the property for 72 hours. with provision for an extension of time by the City Manager until
the date of the next regular City Commission meeting.
The homeowners in this particular instance have endured an emergency and emotional situation
that warrants good cause for an extension of the permit time period. This action would also help
decrease the financial impact on the family while repairing their home, living in a hotel, and

allow them to have access to daily necessities of household goods during the construction time
period.
Under these circumstances and in accordance with authority granted in City Code Section 6 -87,
the City Manager approved an extension of the permit time period until January 10, 2011 (i.e.,
the date of the next regular Commission meeting). The homeowner has been informed by its
insurance company and contractor that it will take until at least January 28, 2011 to complete
construction/repairs and is thus requesting the Commission to approve an additional 30 day
extension until February 9, 2011.
FISCAL IMPACT: There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
No communication efforts beyond the advertising of the Commission agenda are necessary in
conjunction with this agenda item. The Commission Agenda has been posted on the bulletin
board outside City Hall, on the City's electronic sign; the agenda is electronically posted
according to the City Clerk's procedure.
RECOMMENDATIONS:
The City Manager recommends the Commission approve an 30 day extension of the permit time
period, until February 9, 2011, for a Temporary Storage Structure (POD) located at 671
Vistawilla Drive and authorize the City Manager to extend the associated permit, accordingly.

Sec. 6 -87. Temporary storage structures.
(a) Definition: For purposes of this section, "temporary storage structure" shall mean a structure
designed and used primarily for storage of building materials, household goods, and other such
material: and that is not intended for permanent installation.
(b) A supplier of a temporary storage structure shall obtain a permit issued by the building
department prior to supplying and installing or allowing to be installed a temporary storage
structure within the City of Winter Springs. The permit shall be limited to a specific address and
shall allow the installation at such address for a maximum of seventy -two (72) consecutive
hours. Permits shall also be limited to a maximum of two (2) per any twelve (12) month period
for any specific address. A permit fee shall be required by resolution of the city commission and
collected by the city. The permit shall contain the date and time of issuance, the name of the
person to whom the temporary storage structure is supplied, and the address at which the
temporary storage structure will be installed.
(c) In the event of a tropical storm or hurricane watch issued by the National Weather Service,
the city shall have the right to order the supplier to remove the temporary storage structure by
providing the supplier at least twenty -four (24) hours notice of removal. In the event of a tropical
storm or hurricane warning issued by the National Weather Service, the temporary storage
structure shall be immediately removed by the supplier after the warning being issued. In such
situations, the city shall have the right to enter the property and remove the temporary storage
structure if the supplier does not remove the temporary storage structure as required by this
subsection. The supplier shall be liable for all removal costs incurred by the city and failure to
pay said costs, upon demand by the city, shall constitute a code violation and shall result in a lien
being imposed pursuant to Chapter 162, Florida Statutes, in the amount of said costs.
(d) For good cause shown by the owner of the property at which the temporary storage structure
will be supplied, the time periods set forth in subparagraph (b) may be extended by the city
manager or city commission: provided an extension granted by the city manager shall not extend
beyond the date for the next regularly scheduled city commission meeting. Good cause being
limited to emergencies and situations where there exists a reasonable risk or threat to life and
property damage.
