REQUEST:
Mayor John F. Bush and City Manager Kevin L. Smith request that the City Commission
review and Approve Resolution 2010 -54 which if approved, would offer our support for
the City of Oviedo's Community Redevelopment Agency (CRA).
SYNOPSIS:
From time to time, municipalities are asked to support projects related to other
municipalities and in this case, Mayor Bush and Manager Smith are requesting our City
support a Community Redevelopment Agency (CRA) for the City of Oviedo. This
request for support for the City of Oviedo's Community Redevelopment Agency (CRA)
was suggested at the City of Oviedo and City of Winter Springs Joint Meeting held on
September 29, 2010.
CONSIDERATIONS:
Mayor Bush and City Manager Kevin L. Smith are requesting the City Commission to
approve a Resolution of support for a Community Redevelopment Agency (CRA) in the
City of Oviedo.
This request for the City of Winter Springs' support was discussed at a City of Oviedo
and City of Winter Springs Joint Meeting held on September 29, 2010; and at this Joint
Meeting, the Members of the Winter Springs City Commission in attendance noted their
support via Consensus, of a Resolution being drafted.
On behalf of the City Commission, Mayor Bush and Manager Smith know that the City
of Winter Springs wants to support any initiative that benefits one of our closest cities.

FISCAL IMPACT:
Approving Resolution Number 2010 -54 does not have any fiscal impact to the City of
Winter Springs.
COMMUNICATION EFFORTS:
The City of Oviedo is aware that Mayor Bush, the City Commission and the City
Manager are in support of bringing a Resolution to the Winter Springs City Commission
for their official Approval. Additionally, copies or access to this Agenda Item and
Resolution have been given to the Mayor and City Commission, City Manager, City
Attorney, and Department Directors; placed in Press Packets; placed in the Lobby
Binder; and are available on the City's Website, LaserFiche, and the City's Server.
Should this Resolution be Approved, the City of Winter Springs will forward an
executed copy of Resolution Number 2010 -54 to the City of Oviedo, to Seminole
County, and to each member of the Seminole County Board of County Commissioners.
RECOMMENDATION:
Mayor Bush and Manager Smith are asking the City Commission to Approve Resolution
Number 2010 -54.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA SUPPORTING
THE CITY OF OVIEDO'S REQUESTED CHANGES TO
THE SEMINOLE COUNTY DELEGATION OF
AUTHORITY FOR THE CREATION OF THE OVIEDO
COMMUNITY REDEVELOPMENT AGENCY; AND
PROVIDING FOR AN EFFECTIVE DATE.
W HEREAS, the City of Winter Springs acknowledges and whole heartedly supports
Seminole County's successful Redevelopment and Economic Development efforts and its
cooperative efforts to establish a Community Redevelopment Agency (CRA) within the City of
Oviedo; and
W HEREAS, the City of Winter Springs further acknowledges the leadership and
successful stewardship of the Seminole County economic environment by the Seminole County
Board of County Commissioners and its successes heretofore establishing and nurturing
Community Redevelopment Agencies and associated activities within Seminole County to
expedite the redevelopment and reinvestment in various communities within the County; and
WHEREAS, Seminole County and the City of Winter Springs have established and
nurtured a long- standing partnership and strong working relationship that is exemplified by their
mutual commitment to maintain and improve the overall quality of life and job opportunities
available to Seminole County residents; and
WHEREAS, the City of Winter Springs and the City of Oviedo have expressly
demonstrated their commitment to support the shared Economic Development and
Redevelopment objectives championed by Seminole County to create job opportunities for
Seminole County residents and maintain and improve the overall quality of life for its residents;
and
WHEREAS, Seminole County, Florida, is a Charter County created and existing under
the Florida Constitution and the laws of the State of Florida and is a political subdivision of the
State of Florida; and
WHEREAS, the City of Winter Springs and the City of Oviedo, Florida, are Municipal
Corporations created and existing under the laws of the State of Florida with powers under
Chapter 166, Florida Statutes, and are a political subdivisions of the State of Florida, and are
wholly located within the jurisdictional boundaries of Seminole County; and

WHEREAS, the City of Oviedo is located immediately adjacent to the City of Winter
Springs and has expressly identified the reciprocal commitment to providing job opportunities
and improving the overall quality of life for the residents of Oviedo, Winter Springs and
Seminole County as a whole; and
WHEREAS, the City of Oviedo and the City of Winter Springs have identified a shared
mutual interest in coordinating their Redevelopment and Economic Development activities in
order to more expressly implement the overall Economic Development objectives of Seminole
County and to expedite the creation of job opportunities for residents of Seminole County while
stimulating private sector investment within the Downtown Oviedo Community Redevelopment
Area; and
WHEREAS, the City of Oviedo has identified, through the completion of a `Finding of
Necessity' Report, an area within the City limits that satisfies the criteria of Chapter 163, Florida
Statutes regarding a "blighted- area" and thus justifies the creation of a Community
Redevelopment Agency to address the identified blight conditions; and
WHEREAS, on June 24, 2008, Seminole County adopted Resolution Number 2008 -R-
163 (the "Delegation of Authority ") pursuant to which it delegated to the City the authority to
create a Community Redevelopment Agency within the City in accordance with the provisions
of Section163.410, Florida Statutes; and
WHEREAS, on June 30, 2008, the City of Oviedo adopted Resolution 1836 -08 pursuant
to which it created a Community Redevelopment Agency named the "Oviedo Community
Redevelopment Agency" (the "Oviedo CRA "), in accordance with the provisions of Section
163.357, Florida Statutes; and
W HEREAS, the City of Oviedo established a Community Redevelopment Agency
(CRA) to address the blight conditions identified by the `Finding of Necessity' Report, as the
appropriate mechanism to address the identified blight conditions; and
W HEREAS, the operation of a Community Redevelopment Agency (CRA) has been
demonstrated to rejuvenate blighted areas, enable and stimulate new development, create new
job opportunities, and focus public investment in the blighted area to foster additional private
development; and
WHEREAS, the Delegation of Authority provided, inter alia, that the County would not
participate in the operation and implementation of the Oviedo CRA; and
WHEREAS, the Delegation of Authority provided, inter alia, that the County would not
provide any County Tax Increment Funds to the Oviedo CRA; and

WHEREAS, the Delegation of Authority provided, inter alia, that the County would
limit the lifespan of the Oviedo CRA to twenty (20) years; and
1WHEREAS, the City has requested that the County amend the Delegation of Authority to
provide for County representation on the Oviedo CRA Board to increase intergovernmental
coordination and enable County participation in the operation and governance of the Oviedo
CRA; and
WHEREAS, the City has requested that the County amend the Delegation of Authority to
enable County Tax Increment Funds participation in the Oviedo CRA; and
WHEREAS, the City has requested that the County amend the Delegation of Authority to
provide that the term of the Oviedo CRA shall be thirty (30) years; and
WHEREAS, the twenty (20) year lifespan of the Oviedo CRA would limit the City of
Oviedo to pursue only a fifteen (15) year Bond financing mechanism rather than a twenty -five
(25) year Bond financing mechanism associated with a thirty (30) year CRA lifespan thus
exposing the City to potentially higher costs associated with interest and issuance compared to a
twenty -five (25) year Bond; and
WHEREAS, by changing the lifespan of the Oviedo CRA from twenty (20) years to
thirty (30) years, the City of Oviedo would be more readily able to secure an advantageous Bond
financing mechanism to install infrastructure improvements that would enable a greater potential
Ad- Valorem Tax Revenue to the County and the City in shorter period of time; and
WHEREAS, the County through the years has successfully and effectively used and
provided County Tax Increment Funds to Community Redevelopment areas in Sanford, Lake
Mary, Altamonte Springs, Casselberry, and Winter Springs; and
WHEREAS, only the City of Longwood and the City of Oviedo have not benefited from
County tax increment fund participation in a Community Redevelopment Area; and
W HEREAS, the County's contribution of County Tax Increment Funds to the Oviedo
CRA would provide an equitable treatment for each Municipality located within the County; and
W HEREAS, the County's contribution of County Tax Increment Funds to the Oviedo
CRA is expected to accelerate development within the Oviedo CRA, and adjacent areas and
create additional job opportunities for Seminole County residents and tax base diversification for

the City and County; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA THAT:
Section I. That the City of Winter Springs encourages and supports the City of
Oviedo's and Seminole County's on -going redevelopment efforts and activities that address
blight- conditions within Seminole County and provides for the creation of additional job
opportunities for Seminole County residents; and
Section II. That the City of Winter Springs encourages the County to amend the
Delegation of Authority to provide for County representation on the Oviedo CRA Board, and
participation in the operation and governance of the Oviedo CRA; and
Section III. That the City of Winter Springs encourages Seminole County to amend the
Delegation of Authority to enable Seminole County participation in the Tax Increment Funding
mechanism as proposed by the City of Oviedo; and
Section IV. That the City of Winter Springs encourages Seminole County to amend
the Delegation of Authority to provide that the term of the Oviedo CRA shall be thirty (30) years
as requested by the City of Oviedo; and
Section V. That the City of Winter Springs shall forward a copy of this Resolution to
the City of Oviedo, to Seminole County, and to each member of the Seminole County Board of
County Commissioners for his or her respective consideration.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a
Regular Meeting duly assembled on the day of October 2010.
